Harbert, Chair Commissioner W. H. Webster, Pro-Tern Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer- EXCUSED Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Shani Eastin Health Department representative, Sheble McConnellogue Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated December 4, 1997, and duly published December 31, 1997, in the Platteville Herald, a public hearing was conducted to consider the request of Brian and Lisa Wallace for a Site Specific Development Plan and Special Review Permit #1167 for a Commercial Use (Sports Marketing Business) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Shani Eastin, Department of Planning Services representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Eastin stated the proposal is consistent with the Weld County Zoning Comprehensive Plan which allows for commercial and industrial uses to locate in the A (Agricultural) Zone District when the impact to surrounding properties is minimal, and where adequate services and infrastructure are available. Ms. Eastin also stated the proposal is compatible with the existing surrounding land uses, which are rural residential acreages, pasture land and agricultural uses. She said the site lies within three miles of the Town of Mead, and the Town's comments are attached and incorporated into the Conditions of Approval and Development Standards. Responding to Chair Harbert, Ms. Eastin stated the conditions from the Town of Mead have been met. Brian Wallace, applicant, explained that the Mountain View Fire Protection District requires a $350 deposit to review a structure; therefore, they decided to wait for a few years to have the district complete its review after Mr. Wallace has obtained a building permit for the arena. Responding to Chair Harbert and Commissioner Webster, Mr. Wallace stated the hours of operation will be from 6:00 a.m. to 10:00 p.m., as indicated in Development Standard #13, and explained most business is conducted by phone, organizing rodeo events across the country; therefore, they will not have 980072 L L' : PL PL1237 HEARING CERTIFICATION -WALLACE (USR #1167) PAGE 2 clients at the site. Mr. Wallace also stated the arena was included in the proposal for possible future construction without an amendment being required. Ms. Eastin stated there is a violation in progress which requires a Special Use Permit to bring the business into compliance, and added the applicant may need to amend this USR if the arena is moved from the proposed site and additional acreage is added. No public testimony was offered concerning this matter. Commissioner Hall moved to approve the request of Brian and Lisa Wallace for a Site Specific Development Plan and Special Review Permit #1167 for a Commercial Use (Sports Marketing Business) in the A(Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Webster, and it carried unanimously. This Certification was approved on the 19th day of January, 1998.
