RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST HUBERT AND MARGARET COLLINS FOR VIOLATION OF THE
WELD COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Hubert and Margaret Collins, VI #2229, are allegedly in violation of the Weld
County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of November, 1995, a public hearing was held before the
Board of County Commissioners forthe purpose of hearing testimony relating to said violation, and
WHEREAS, Hubert and Margaret Collins, property owners, were not present or represented
at said hearing, although all parties were notified of said hearing by Department of Planning
Services staff, and
WHEREAS, the Board of County Commissioners deems it advisable to delay referral of said
violation to the Weld County Attorney's Office for a period of thirty days to allow adequate time for
the property owners to apply for a Use by Special Review Permit, and
WHEREAS, the Board deems it advisable to proceed with legal action against the above
named individuals without further Board action if the subject property is not brought into compliance
within thirty days.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that if said violation still exists on December 14, 1995, the Weld County Attorney
be, and hereby is, authorized to proceed with legal action against Hubert and Margaret Collins to
remedy the violation of the Weld County Zoning Ordinance, and any other persons occupying the
properties, any persons claiming an interest in the properties, and any persons acting in active
concert with the identified parties.

unscreened noncommercial junkyard located on the property. I consists of two vehicles without
license plates. On talking with the owner I did find that the property is being used in conjunction
with the property owners car dealer business. The owner did say that he would apply for a Use by
Special Review permit for the business. The vehicles that are considered derelict would be a part
of the Use by Special Review. A five day compliance letter will be sent to the property owner
concerning the business and informing him of the Use by Special Review application process.

The noncommercial junkyard is a violation of Section(s) 31.2 and 31.3..9 of the Weld County
Zoning Ordinance. To correct the violation a screening plan must be submitted and approved
by the Department of Planning Services before installation or the noncommercial junkyard must
be removed from the property.
The Department of Planning Services also recommends that the County Attorney be authorized
to proceed with legal action against any other persons occupying the properties, any person
claiming an interest in the properties, and any persons acting in active concert with the
identified parties.

10:00 a.m. to consider the Zoning Violation occurring on your property. This meeting will take
place in the County Commissioners' Hearing Room, first floor, Weld County Centennial Center,
915 Tenth Street, Greeley, Colorado. It is recommended that you or a representative be in
attendance to answer any questions the Board of County Commissioners might have about the
violation.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation, the
action necessary to correct the violation, and that you were given sufficient time to remedy the

Subject: Revised Screening Plan on a parcel of land described as part of the NW4 of
Section 6, Township 4N, Range 67W of the 6th P.M., Weld County, Colorado
Dear Mr. and Mrs. Collins:
After meeting with you on Friday, July 21, 1995 and doing further research on the adjacent
property owners, we have determined that the adjacent parcel to the east is family owned farm
land. On July 25, 1995, the staff of the Department of Planning Services approved your
screening plan with the following conditions:
1. The screening will be located to the south, west and north, so that the derelict vehicles will
not be visible from those directions on Weld County Road 13.
2. If at any time in the future, the property to the east is sold or the present use becomes a
problem in any way ( ie: more derelict vehicles outside screened area, business located on the
property, or visible to adjacent land owners or public rights of way), the east side would need to
be screened and a violation notice could be issued. All derelict vehicles must be stored within
the screened area or in a building (garage). If a new structure is built to store the vehicles, the
appropriate permits must be obtained.
3. The screening must be completed within 30 days from the date of this letter. If this is not
possible, please let us know in writing how much time is needed to complete the screening.
If you have any further questions, please do not hesitate to call any time during normal
business hours: Monday -Friday 7:30 am to 4:30 pm. Thank you for your cooperation in this
matter.

The property was inspected to determine compliance with section 31.2 and 31.3.9 of the Weld
County Zoning Ordinance. The property is not in compliance at this time.
I met with Mr. and Mrs. Collins at the time of inspection. They gave me a tour of their property
and the surrounding property, which is owned by family members. To the east of the property is
all farm land, which is farmed by the Collins' family. The derelict vehicles are all visible from
Weld County Road 13 from the south, west and north. To bring the property into compliance the
derelict vehicles would need to be removed or screened from all adjacent properties and public
rights of way. I will take the revised screening plan to staff on July 25, 1995.
No photographs were taken at the time of inspection.

Subject : Screening Plan on a Parcel of land described as Pt. of the NW4 of Section 6, T4N, R67W of the
6th P.M., Weld County, Colorado.
Dear Mr. and Mrs. Collins
Thank you for the additional information on your screening plan. The Department of Planning Services
cannot approve the proposed screening plan as submitted. The Weld County Zoning Ordinance requires
that all noncommercial junkyards in the "A" (agricultural) zone be screened from all adjacent properties
and public rights -of -way. Through an inspection conducted from WCR 13 and through researching an
aerial photo of the property it was determined that the material being screened will be visible from the
adjacent parcel to the east of your property, and possibly from the two parcels to the north. If you intend
to extend the screening along the east portion of the proposed area then a revised plan would need to be
submitted to the Department of Planning Services for approval.

SECTION 6, T4N, R67W OF THE 6TH P.M., WELD COUNTY, COLORADO
Dear Mr. Kramer:
In response to your letter of February 14, we will comply with the request to install a 7 -
foot high fence. This fence will be supported by 4 x 4, or larger, posts cemented eight
feet on center and four 2 x 4, or larger, stringers.
We intend to put this fence on the west side of the property and also approximately 50
feet on the south side of the property. Your letter indicates fencing should be on the east
side, but that side of the property does not face any public right-of-way; it is a
continuation of family property. It cannot be seen by the public. We do not intend to
fence the east side.

Thank you for the screening plan received on February 13, 1995. Planning Staff has reviewed the plan
and determined that the screening would need to be a minimum of seven feet high because of the large
trucks that will be enclosed by the screening. Also the Weld County Zoning Ordinance requires that
noncommercial junkyards be screened from all adjacent properties and public rights -of -way. This would
require screening to be installed along the east side of the proposed area. The proposed material of brown
sheet metal or cedar privacy fence will be adequate however the screening plan does not show how the
fence will be supported ie: four-by-four posts cemented eight feet on center, three two-by-four stringers
etc.
Please submit a revised screening plan or call if you have any questions.

SUBJECT: C-95-8 Property located at Pt of the NW4 of Section 6, T4N, R67W of the 6th P.M., Weld
County, Colorado.
Dear Mr. and Mrs Collins
It has come to the attention of the Department of Planning Services' staff that the uses on your property may
not be in compliance with the Weld County Zoning Ordinance. The potential noncompliance with the zoning
ordinance is a noncommercial junkyard (derelict vehicles ) located on the property without proper screening
from adjacent properties and public rights -of -way. Also a commercial business ie: (automotive salvage
operation) being operated from the property without the appropriate zoning permits. This is not a use allowed
by right in the A (agricultural) zoned district.
Please call me within five working days of the date of this letter to review the concern with me.
