BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
NOVEMBER 23, 1998

The Board of County Commissioners of Weld County, Colorado, met in regular
session in full conformity with the laws of the State of Colorado at the regular
place of meeting in the Weld County Centennial Center, Greeley, Colorado,
November 23, 1998, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following
members were present, constituting a quorum of the members thereof:
Commissioner Constance L. Harbert, Chair
Commissioner W. H. Webster, Pro-Tem
Commissioner George E. Baxter
Commissioner Dale K. Hall
Commissioner Barbara J. Kirkmeyer
Also present:
County Attorney, Bruce T. Barker
Acting Clerk to the Board, Esther E. Gesick
Director of Finance and Administration, Donald D. Warden
MINUTES: Commissioner Baxter moved to approve the minutes of the Board of County
Commissioners meeting of November 18, 1998, as printed. Commissioner Hall
seconded the motion, and it carried unanimously.
CERTIFICATION
OF HEARINGS: Commissioner Webster moved to approve the Certification of Hearings
conducted on November 18, 1998, as follows: 1) A Site Specific Development
Plan and Final Plat for a five (5) lot Minor Subdivision - Grandview Acres,
S#469, Larry Intermill. Commissioner Hall seconded the motion, which carried
unanimously.
ADDITIONS TO
AGENDA: There were no additions to the agenda.
CONSENT AGENDA: Commissioner Baxter moved to approve the consent agenda as printed.
Commissioner Kirkmeyer seconded the motion, and it carried unanimously.
PUBLIC INPUT: There was no public input.

WARRANTS: Donald Warden, Director of Finance and Administration, presented the following
warrants for approval by the Board:
All Funds $544,564.30
Commissioner Webster moved to approve the warrants as presented by Mr.
Warden. Commissioner Hall seconded the motion, which carried unanimously.
BUSINESS:
NEW: CONSIDER RENEWAL APPLICATION FOR CLUB LIQUOR LICENSE FOR
THE EATON COUNTRY CLUB AND AUTHORIZE CHAIR TO SIGN: Bruce
Barker, County Attorney, stated Deputy Ron Richardson expressed no concerns
with this application. Commissioner Webster moved to approve said application
and authorize the Chair to sign. Seconded by Commissioner Kirkmeyer, the
motion carried unanimously.
CONSIDER 1999 APPLICATION FOR LICENSE TO CONDUCT PUBLIC
DANCE OR DANCES FROM THE EATON COUNTRY CLUB: Commissioner
Hall moved to approve said application. Seconded by Commissioner Kirkmeyer,
the motion carried unanimously.
CONSIDER AMENDMENT TO INTERGOVERNMENTAL AGREEMENT AND
AUTHORIZE CHAIR TO SIGN -CITY OF GREELEY: Mr. Barker explained on
December 22, 1992, the City of Greeley and Weld County entered into an
Intergovernmental Agreement through which the County pays the City of Greeley
for accepting, processing, and storing evidence. He stated this amendment will
increase the amount for these services to $34,750. In response to
Commissioner Kirkmeyer, Mr. Warden stated the increased amount has already
been included in the budget. Commissioner Baxter moved to approve said
amendment and authorize the Chair to sign. Seconded by Commissioner
Webster, the motion carried unanimously.
CONSIDER INTERGOVERNMENTAL AGREEMENT FOR CRIMINAL JUSTICE
RECORDS MANAGEMENT SERVICES AND USE OF COMMUNICATIONS
RECORDS AND CRIMINAL JUSTICE INFORMATION SYSTEMS AND
AUTHORIZE CHAIR TO SIGN - JOHNSTOWN POLICE DEPARTMENT: Mr.
Warden stated the Town of Johnstown would like to be included in the Criminal
Justice Program. Commissioner Hall moved to approve said agreement and
authorize the Chair to sign. Seconded by Commissioner Kirkmeyer, the motion
carried unanimously.
CONSIDER RESOLUTION RE: AMENDMENT #4 TO THE WELD COUNTY
RETIREMENT PLAN: Mr. Warden stated on November 13, 1998, the
Retirement Board approved Amendment#4 to the Weld County Retirement Plan.
He explained Section 5.2 is being amended to change the County Contribution
to the Retirement Plan which requires approval by the Board of County
Commissioners. Commissioner Kirkmeyer moved to approve said resolution.
Commissioner Baxter seconded the motion, which carried unanimously.

CONSIDER RESOLUTION RE: ADOPTION OF WELD COUNTY QUALIFIED
GOVERNMENTAL EXCESS BENEFIT ARRANGEMENT UNDER IRS
SECTION 415(M)AND AUTHORIZE CHAIR TO SIGN: Mr. Warden explained
IRS Section 415(m) has been amended to create a Qualified Governmental
Excess Benefit Arrangement to eligible members. Commissioner Kirkmeyer
moved to approve said resolution. Seconded by Commissioner Webster, the
motion carried unanimously.
SECOND READING OF ORDINANCE#30-D,IN THE MATTER OF AMENDING
WELD COUNTY ORDINANCE #30-C, REGARDING THE GREELEY-WELD
COUNTY AIRPORT AUTHORITY: Commissioner Baxter moved to read
Ordinance #30-D by title only. Seconded by Commissioner Hall, the motion
carried unanimously. Mr. Barker read said title for the record. There was no
public input concerning this matter. Commissioner Hall moved to approve
Ordinance #30-D on second reading. The motion, which was seconded by
Commissioner Kirkmeyer, carried unanimously.
SECOND READING OF ORDINANCE #82-T, IN THE MATTER OF SETTING
OF FEES FOR SERVICES PROVIDED BY THE WELD COUNTY HEALTH
DEPARTMENT: Commissioner Hall moved to read Ordinance #82-T by title
only. Seconded by Commissioner Kirkmeyer, the motion carried unanimously.
Mr. Barker read said title for the record. There was no public input concerning
this matter. Commissioner Webster moved to approve Ordinance #82-T on
second reading. Commissioner Kirkmeyer seconded the motion, which carried
unanimously.
SECOND READING OF ORDINANCE #84-T, IN THE MATTER OF SETTING
OF FEES FOR SERVICES PROVIDED BY WELD COUNTY: Commissioner
Baxter moved to read Ordinance #84-T by title only. Seconded by
Commissioner Hall, the motion carried unanimously. Mr. Barker read said title
for the record. There was no public input concerning this matter. Commissioner
Hall moved to approve Ordinance #84-T on second reading. Commissioner
Baxter seconded the motion, which carried unanimously.
SECOND READING OF ORDINANCE#136-M, IN THE MATTER OF SETTING
OF THE AMOUNT OF PURCHASES WHICH MUST BE BY WRITTEN SEALED
BIDS WITH A TEN-DAY PERIOD FOR CONSIDERATION: Commissioner
Kirkmeyer moved to read Ordinance #136-M by title only. Seconded by
Commissioner Baxter, the motion carried unanimously. Mr. Barker read said title
for the record. There was no public input concerning this matter. Commissioner
Webster moved to approve Ordinance#136-M on second reading. Seconded
by Commissioner Baxter, the motion carried unanimously.
RESOLUTIONS AND
ORDINANCES: The resolutions were presented and signed as listed on the consent agenda.
Ordinances #30-D, #82-T, #84-T, and #136-M were approved on second
reading.
Let the minutes reflect that the above and foregoing actions were attested to and
respectfully submitted by the Acting Clerk to the Board.
