The contract for the erection of the "Exhibit" building for the County fair, in
aocordance with plans and specifications, and cts awarded on June 9th, to W. H. Murphy,
W. H. Hofsohulte and H. K. Chittock , was duly signed and executed. Same was ordered filed.

BRIDGE.
In a000rdance with advertisement heretofore made, calling for bids for the
construction of a bridge over St. Vrain Creek , near Sections 9 and 16, Twp. 3, Range 67,
bids were received as follows:
Chris. O'Neill, $1144.00
Levy Construction Co, 850.00
And the Board having considered said bids, and being sufficiently advised, on motion
it was ordered that contract be and it hereby 1s awarded to The Levy Construction Company
for the co nstruetion of said bridge, in accordance with specifications, for the sum of
$850.00.
There being no further business for the day. a recess was ordered taken to a further
date, subject to call of the Chairman.

The Board having under consideration the matter of installing steam radiators in
the Jury and Bailiffs' rooms on the fourth floor of the Court House , for heating those rooms
without running the heating system for the entire building. And the J. D. Potter Plumbing
& Heating Company having Submitted a price of $ 560.85 for doing the necessary work, ,
furnishing material etc. , on motion it was ordered that said work be done by said J. D.
Potter Plumbing & Heating Company at said price.

And the surety being deemed sufficient , on motion said Pond was approved and the Treasurer
ordered notified thereof.

`\ The resignation oF Cecil A. Deane as Justice oF the Peace, Justice Precinct # 30, at
Roggen, was presented to the Board. Or, motion said resignation was accepted.

The resignation of G. P. McLaughlin as Justice of the Peace, Justice Precinct # 2, was
presented to the Board. On motion said resignatiou was accepted.
And J. G. Jardine of Frederick having been suggested as successor, and the Board being
sufficiently advised in the premises, on motion it was ordered that said J. G. Jardine be
and he hereby is appointed Justice of the Peace, Justice Precinct #2, providing he qualify
as required by law.

recorded.

It appearing to the Board that petitions for Abatement , Rebate, or Refund of Taxes have
heretofore been approved by the Board; that same have been approved by the Colorado Tax
Commission and returned to this office.

PROPOSED DISTRICT NO 20 • PETIT ION 'FILED.
There was presented to the Board a petition purporting to oOntain the signatures of 6°'74
the majority of the resident land owners within Twp. 7, Range 63 West of the 6th P. M. , a
territory not exceeding 36 square miles, stating their desire to create and form said
territory into a pest district for protection against prairie dogs and ground squirrels,
under the provisions of Chapter 95 of the Session laws of Colorado, 1915. Said petition
being verified byL. G. Halsey, one of the signers thereto.
On motion, said petition was ordered filed.

COUNTY AGRICULTURAL AGENT.
The Board having under consideration the matter of County Agricultural Agent , and it
appearing that Mason E. Knapp has heretofore tendered his resignation , effective June 15th,
1922, and the same having been accepted by the Board, and it further appearing that hereto-
fore on to-wit: the 16th day of June, a oontraot was made and entered into by and between
the Board of County Commissioners and the Colorado Agrioultural College, parties of the
first part and H. H. Simpson as party of the second part , with the view to the appointment of
H. H. Simpson to fill such vacancy. Now, therefore, on motion it is ordered that said
H. H. Simpson be and he hereby is appointed County Agricultural Agent to date from July 1st,
1922, for the period of one year, at a compensation of $3200.00 per year, of which $2000.00
per year is to be paid by Weld County. and the remaining 11200.00 per year is to be paid
jointly by the Colorado Agricultural College and the U. S. Department of Agriculture.
The further allowance of $1800.00 per year, account auto depreciation and expense; also
suitable offioe and stenographer to be furnished by Weld County.

WHEREAS, the UNION PACIFIC RAILROAD COMPANY has tendered to WELD COUNTY, COLORADO, a

of a portion of its right of way in said County, which said lease is in words and

"THIS AGREEMENT , made and entered into, in duplicate, this -- day of ,1922
by and between the UNION PACIFIC RAILROAD COMPANY, a corporation of tt1e State of Utah, (herein-
after called "Lessor") , Tarty of the first part , and WELT) COUNTY, COLORADO, (hereinafter
called "Lessee") , party of the second part , WITNESSETH:
The Lessor hereby leases to the Lessee for a period oomsencing on the first day of June
1922, and terminating five years thereafter, unless sooner terminated in accordance with the
terms hereof, the following described strip or parcel of land to be used for highway purposes
only:
A strip of land thirty (30) feet in width, situate in the Southwest Quarter (SW ) of
Section Twenty-four (24) , Tcwnship One (1) North, Range Sixty-eight (66) West of the Sixth
Principal Meridian, being all that part of Lessor's right of way, and station grounds at
St. Vrains, Colorado, included between lines parallel with and distant respectively one hun—
dred twenty (120) feet and one hundred fifty (150) feet westerly, at right angles from the
center line of Lessor's main track, and extending northerly from the south line of said
Southwest Quarter (sri) of Section Twenty—four (24) to a straight line intersecting said
center line of main track, at right angles, at a point thereon which is distant two thousand
two hundred seventy (2270) feet northerly from said south line of the Southwest Quarter (SW-.k)
of Section Twenty—four (24) . when measured along said center line of main track, as shown
shaded in green on the attached print marked "Exhibit A" and made a part hereof._
As a consideration for this lease the Lessee is to pay in advance to the Lessor five
dollars ($5.00) per annum; to assume all taxes and assessments levied upon the leased premises
during the continuance of this lease, not including taxes or assessments levied against the
leased premises as a component part of the railroad property of the Lessor in the State as a
whole; to keep the leased premises free fron oombustible material; to plant no trees or
shrubbery, and to erect no structures thereon except such as may be necessary for highway
purposes; to put nothing upon the leased premises which might obstruct or interfere with
the view; to provide such culverts and ditches as may be necessary to properly care for the
drainage from said premises and the adjoining right of way of. the Lessor; and to hold the
Lessor harmless from any and all damages to any bridges or culverts on said leased premises
arising from fire caused directly or indirectly by sparks or fire emitted from the engines
or trains of the Lessor; and to further hold the Lessor harmless from any damages to the
highway upon the leased premises which may result from the oonstruotion or maintenance of
drainage ditches or waterways by the Lessor. The Lessor reserves the right to take temporary
or permanent possession of all or any portion of the leased premises whenever their use may
become necessary or expedient , in the judgment of the Lessor, for railroad purposes,
including the location of public or private warehouses, elevators, or other structures with
the design to facilitate and promote troffic; PROVIDED, however, that in the event the Lessor
elects to take permanent possession of all or any portion of the leased premises in accord—
ance with this reservation, it shall first serve upon the ?Jesaee ninety (90) days'
written notice of such election.
Nonuser by the Lessee of the leased premises for highway purposes continuing at any time
during the term hereof for a period of eighteen (18) months shall, at the option of the
Lessor, work a termination of this lease and of all rights of the Lessee hereunder, and
nonuser by the Lessee of a portion of said leased premises continuing for a like period, shall
at the option of the Lessor, work a termination of all rights and interests of the Lessee
with respect to such portion.

This lease is subject to all outstanding superior rights, ncludingg those in
favor of telegraph and telephone companies , and the right of re ewals and extensions of same,
If, by reason of a line change or otherwise, the title of the L ssor shall cease before
the expiration of the term above provided, or if the lease of t e above described premises
is held to be, or should become inconsistent with the law of th land, this lease shall
thereupon terminate.
This lease is to become null and void upon the failure of the Lessee to keep any of
the conditions hereof and is not to be assigned, nor is Any portion of the leased premises
to be sublet , without the written consent of the Lessor. The Lessee will Surrender
peaceable possession of sari premises at the expiration of this lease.
It is understood that all covenants and agreements herein recited are made by the
parties hereto, for , and shall be binding upon themselves and their successors and assigns.

Section 2. As a oonsiderat ion for this lease the Lessee agrees to pay in aiva.nee to the
Lessor a rental of five dollars ($5.00) per annum; to assume alli taxes and assessments levied
upon the leased premises during the continuance of this lease; to keep the leased premises
free from combustible material; to plant no trees or shrubbery thereon without the previous
written consent of the Lessor, end to erect no structures there n except such as may be
necessary for highway purposes ; to put nothing upon the leased premises which might
obstruct or interfere pith the view; to provide such ditches, culverts, bridges and
other structures as may be necessary properly to care for the drainage from said premises and
the adjoining right of way of the Lessor; and to hold the Lessor harmless from any and all
damages to any of such structures on said leased premises arising from fire caused directly
or indirectly by sparks or fire emitted from the engines or trai s of the Lessor; and to
further hold the Lesso» harmless from any damages to the highway upon the leased premises
which may result from the construction of drainage ditches or wa er ways by the Lessor.
Section 3. The Lessor reserves the right to take possessio of all or any portion of
the leased premises whenever the use thereof may become neoessar or expedient in the
judgment of the Lessor for railroad purposes; PROVIDED. however that in the event the
Lessor elects to take possession of all or any portion of said 1 ased premises in accord—
ance with this reservation, it shall give to the Lessee six (6) onths written notice of
its intention so to do and at the expiration of said six (6) mon hs the Lessee shall
surrender the premises described in said notice and shall at its own expense move the
highway from said described premises.
Section 4. The Lessor reserves the right to maintain, open te, repair and renew
all of its existing railroad tracks crossing said leased premise* and also to cross said
leased premises with such additional railroad tracks as may be required for its convenience
or purposes in such a manner as not to interfere with the use of said premises as a public
highway. In the event the Lessor shall plane additional traoks upon the leased premises
in accordance with this reservation it shall restore the highway so occupied by its said
additional tracks to its former state of usefulness.
Section 5. The Lessee shall not at any time use or permit the use by others of said
leased premises for railroad or traction purposes, or use or permit the said premises to be
used except for the usual and ordinary purposes of a street or highway.
Section 6. This lease is subject to all outstanding superior rights, ( including
those in favor of telegraph and telephone companies and leases to abutting property
owners and others) . and the right of renewals and extensions of the same; and it is
understood that nothing in this lease contained shall be construed as a covenant to put
the Lessee into possession or to protect the Lessee injthe peaceable possession of said
premises. //
Section 7. No special assessments for establishing or improving the highway located
upon the leased premises are to be made against the adjacent railroad right of way of the
Lessor, and the Lessee agrees to protect the Lessor against and save it harmless from such
special assessments.
Section S. The Lessee agrees, at its -awn cost and expense , to move the existing
right of way fence of the Lessor from its present location to the inner margin of the
leased premises, except in such locations where such fence is at present on the outer margin
of the Lessor' s right of way, in which excepted cases the Lessee will construct at its
own expense the necessary fence on the inner margin of the lease premises, and the Lessee
further agrees to make such arrangements as may be necessary wit the owners or Lhe lessees
of property abutting upon the highway as to the establishment, maintenance and repair of
fences on the outer margin of the leased premises, the intention 'being to relieve the Lessor

at the expense of the Lessee from all obligation, if any ttere be, to establish or maintain
a fence upon the outer margin of its right of way.
Seotion 9. For the purpose of pr eteetir:g the reversionary interests of the Lessor against
the assertion of adverse rights, the Lessee agrees to prevent encroachments upon the leased
premises, and to this end will, at its own expense , take all necessary action, including
as far as practicable the building of its ditches on and the borrowing of earth from the
outer margin of said leased premises.
Section 10. If the Lessee shall breach or fail to keep any of the covenants or
conditions hereof, or fail to perform such covenants or conditions or to remedy the sane
for thirty (30) days after written notice of such failure or breach on the part of the
Lessee given by the Lessor to the Lessee, then this lease shall be null and void.
Section 11. Nonuser by the Lessee of the leased premises for highway purposes continu—
ing at any time during the term hereof for a period of eighteen ( 18) months shall, at
the option of the Lessor, work a termination of this lease e.nd of all rights of the Lessee
hereunder, and nonuser by the Lessee of A. portion of said leased premises continuing for a
like period shall, at the option of the Lessor, work a terrination of all rights and interests
of the Lessee with respect to such portion.
Section 12. This lease is not to be assigned, nor is any portion of the leased premises
to be sublet , without the written consent of the Lessor. The Lessee will surrender peaceable
possessio.i of said premises et the expiration of this lease.
Section 13. On th6 execution of this lease, that oerts.in lease from the Lessor to the
Lessee dated September 1, 1916, being the Lessor' s lease Audit Number A—lfe032, as supplem€' ted
by a lease dated March 1, 1921, providing for the use by the Lessee for highway purposes of
certain portions of the right of way of the Lessor, including certain of the premises herein
leased, shall ipso facto be cancelled, and such lease as supplemented shall thereafter be of
no further fore(' and effect as between the parties hereto.
Section 14. All covenants and agreements herein contained are made by the parties

the State as a whole; to keep the leased premises. free from com ustible material; to plant

with the view; to provide such culverts and ditches as may he n pessary to properly care
for the drainage from said premises and the adjoining right of ay of the Lessor ; and to hold
the Lessor harmless from any and all damages to any bridges or ulverts on said leased
premises arising from fire caused directly or indirectly by spa ks or fire emitted from
the engines or trains of the Lessor; and to further hold the Lessor harmless from any
damages to the highway upon the leased premises which may resul from the construction
or maintenance of drainage ditches or waterways by the Lessor. The Lessor reserves the
right to take temporary or permanent possession of all or any p rtion of the leased
premises whenever their u6e may become necessary or expedient , n the judgment of the Lessor,
for railroad purposes, including the location of public or pri'. to warehouses, elevators, or
other structures with the design to facilitate and promote traf to; PROVIDED, however,
that ir�the event the Lessor elects to take permanent possession of all or any portion of
the leased premises in accordance with this reservation it steal first serve upon the Lessee
ninety (90) days' written notice of such election.
Nonuser by the Lessee of the leased premises for Highway purposes continuing at any
time during the term hereof for a period of eighteen (18) months shall, at the option of
the Lessor, work a termination of this lease and of all rights of the Lessee hereunder,
and nonuser by the Lessee of a portion of said leased premises continuing for a like period
shall, at the option of the Lessor, work a termination of all rights and interests of the
Lessee with respect to such portion.
This lease is subject to all outstanding superior rights, including those in favor of
telegraph and telephone companies, and the right of renewals en' extensions of same. If,
by reason of a line change, or otherwise, the title of the Less r shall cease before the
expiration of the term above provided, or if the lease of the a ove described premises is
held to be, or should become inconsistent with the law of the l nd, this lease shall
thereupon terminate.
This lease is to become null and void upon the failure of he Lessee to keep any of
the conditions hereof and is not to be assigned, nor is any por ion of the leased premises
to he sublet , without the written consent of the Lessor. The L ssee will surrender
peaceable possession of said premises at the expiration of this lease.
It is understood that all covenants and agreements herein recited are made by the
parties hereto, for, and shall be binding upon themselves and their successors and
assigns.

ROCKY MT. FUEL CO. ROAD.
A petition signed by the President of the Rocky Mountain Fuel Company and numerous
others, praying for the laying out of a public road described as follows, to-wit:
Commencing at the north east corner of Section 28, T. 1 N. , Range 6e West , and
continuing due west for a distanoe of three miles, to the intersection of the Township road
leading north and south between T. 1 N. , Range 68 West and T. 1. N. , Range 69 West. The
road which is sought to be established, lies on Section line, and is bounded on the North
by Sections 19, 20 anrt. 21, and on the South by Sections 28, 29 and 30.
was presented to the Board when the following action was taken and entered of reoord to-wit:
It appearing to the Board that the right of way for the line of road prayed for
is not all granted and Forrest C. Northcutt having deposited $15.00 to pay the expense
of v'ewing in case said road be not granted, on motion it was ordered that Commissioners
A. F. Peters, Dan C. Straight and F. L. Powars be and they are hereby appointed viewers to
meet at the starting point at 11: 00 o'o loc k A. M. , Wednesday, the 23rd day of August, 1922,
and view the line of road herein prayed for and file their report thereon, as required by
law, with the County Clerk ten days before the next regular meeting of the Board. The Rocky
Mountain Fuel :CR any is hereby appointed to post notioes as required by law.

RESOLVED that the County TreaSurer is directed to assign for the sum of $10.35, plus an
assignment fee of $1.00, tax sale certificate # 1525 for tax sales of the year 1921, A
covering the S. 115' of 11 and 12, except the S. 40' , Blk. 15, Town of Platteville. Said
assignment, however, not to include any indorsement of 1921 taxes thereon, if such indorse gent
has been made. It being understood that the 1921 assessment on said property is to be
corrected by the Treasurer.
Motion was seconded and upon vote, was unanimously carried.

N THE MATTER OF VOTING PRECINCTS
1\\ AND APPOINTMENT OF ELECTION JUDGES.
The Board having under consideration the matter of establishment of Voting Precincts,
and numerous oral petitions having been presented to the Board for the establishment of a
Voting Precinct composed of part of Precinct 32, as Low constituted, and the Boar:1 having
thoroughly investigated said matter, and it appear_ng that the establishment of such a
precinct would be to the best interests and convenience of the voters therein.
NOW THEREFORE, it is unanimously ordered that a Voting Precinct to be known as
Columbine, Jrecinct # 65, be and hereby is established composed of Sections 25, 26, 27, 26,

Be'it resolved that the Board of County Commissioners respectfully request the State
Highway Department to apply $1400 to cover the deficit on Federal Aid Project 146 and to
appropriate the balance, amounting to $12,600, to surfacing and bridging State Road
Number 24, from the Lari per County line through Greeley to the Morgan County line.

COUNTY AGRICULTURAL AGENT.
The following resolution was unanimously adopted:
ESTABLISHMENT OF AGRICULTURAL ADVISORY COUNCIL FOR 'TLD COUNTY.
Wo, the Board of County Commissioners of Weld County, do hereby establish an organiza-
tion which shall be known as the Weld County Agricultural Advisory Council, and which
shall be for the purpose of aiding in carrying the work of Agricultural Extension and the
rural development of the County, and further, in order that all parts of the County and all
classes of business interested in Agriculture may be represented in one body whose aim will
be to outline a systematic , long-time program of agricultural development that will best
serve all of the people and meet the needs of the entire County:
Each member of this Council represents his respective community and organization at
meetings of the Council, at which time definite projects of work will be chosen and plans
made for carrying them out . The membership of this Counoil (which is recognized as an
honorary County institution) is by appointment by us, the Board of County Commissioners. and
in accordance with the following rules:
• Membership:
This Council shall be made up by appointment by the Board of County Commissioners, of
representatives from the following organizations:
-Each active Community or Distriot Agricultural Association, 1 representative.
Each active Town Commercial Association, 1 representative.Each active County Wide Agricultural or Commercial Association, 2 representatives.
Each unorganised Community or District , 1 representative.
Eligible Organizations.
The Bof4ed of County Commissioners shall have the right to declare what organizations
are eligible to representation. No organization that is not considered active will be
-eligible.
• . Appointments.
•
Appointments will be made, and a membership card issued to the representative, upon
recommendation of the local organization.
Term of Appointment.
'Each member shall be appointed for a three-year period. On the stert of organization,
lots shall 'oe drawn designating one third of the members for one-year term, one third for
two-year term, and one third for three-year term. Following this plan, one third of the
Council membsrlhip, will be appointed each succeeding year to serve for three-year period.
Vacancies sfrair by filled in the regular manner prescribed for appointing new members.

Representatives from Unorganized Communities.

One member Shall be appointed to the Council from such un rganiaed communities,
which in the opinion of the Board of County Commissioners, are entitled to representation.
This Council is an honorary body, members reali,ing there is neither pay nor mileage
allowed for tre work. It is a County Organization, serving as an advisory council to
the Board of County Commissioners, and to the Representatives of the Extension Service , on
matters relating to the Agricultural development of the County.
