A public hearing was conducted on November 24, 1997, at 10:00 a.m., with the following present: Commissioner George E. Baxter, Chair Commissioner Constance L. Harbert, Pro-Tem Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer - ABSTAINED Commissioner W. H. Webster Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Todd Hodges Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated October 17, 1997, duly published October 23, 1997, in the South Weld Sun, a public hearing was conducted to consider the request of Western Dairymen Cooperative, Inc. for a 19 -lot subdivision in a PUD C-3 and I-1 Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Commissioner Kirkmeyer stated she is abstaining because she and her family still own units in the Cooperative, which presents a conflict of interest. Todd Hodges, Department of Planning Services representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Hodges stated the Planning staff and CDOT also recommend approval. The plan consists of a 55 -acre site in the Mixed Use Development (MUD) area. Mr. Hodges also stated each of the 19 lots will require a site plan review prior to development under the MUD Ordinance. Kris Pickett, Pickett Engineering Company, represented the applicant and stated they have received all of the information and agree with the recommendations and conditions set forth by the Planning Commission. Sharon Hopper, surrounding property owner to the south, asked what the plan involves. Commissioner Harbert explained the Change of Zone was approved in February of 1997. Mr. Hodges explained there will be 19 lots, 1 or 2 acres in size, with a larger lot on the western portion of the property. Mr. Hodges added Weld County Road 7.5 is proposed to be constructed as a two- lane road to the end of the development for access to the property. In response to Ms. Hopper, Mr. Pickett stated the road will extend to the end of the applicant's property for access and will not 972477 PL1071 HEARING CERTIFICATION - WESTERN DAIRYMEN COOPERATIVE (S #431) PAGE 2 affect her property, which is about 80 acres to the south. The type of buildings in the PUD will consist of offices and other types of businesses which benefit from the Highway access. In response to Chair Baxter, Mr. Pickett explained further development of Road 7.5 will be determined by development of the property to the south. In response to Mr. Morrison, Mr. Pickett stated the plan provides for a Landowners Association in which each landowner will participate in maintaining the open areas of the development. Commissioner Hall moved to approve the request of Western Dairymen Cooperative for a Site Specific Development Plan and Planned Unit Development Final Plan for a 19 -lot Subdivision in a PUD C-3 and I-1 Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Webster, and it carried unanimously. This Certification was approved on the 26th day of November, 1997.
