To: Weld County Planning Dept.
I am responding to the request for a Special Review Permit by Jim and Sharon Strunk of
Hereford. The case number is USR-1117. First I want to wish the Strunks the best with their
new endeavor. But since I own an irrigation storage reservoir, conversion dam to divert water
out of Crow Creek and other waterways which are located on their property I do have some
concerns if these water structures are included in their plans for recreation for the dude ranch.
We currently do not have any agreement to the effect that they may use the surface of this lake for
any recreation. And because of the potential liabilty I will not allow any boating, fishing,
swimming or other recreational activities. Included in my water rights are the rights to ingress
and egress their property to maintain and repair any waterways, reservoir, dams or other
structures necessary to maintain my water right. Therefore I request that I receive some
assurance as to how my liability will not be increased from any potential dangers afforded by the
marshy ground, occasional high water to flood water from Crow Creek, and irrigation structures
that I own on their property.
