The Department of Planning Services has determined through the review,that the standards of Section 11.4.2.1 through
11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the
following conditions in accordance with information submitted in the application and the policies of the County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according
to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:
A. Due to the prime agricultural soils on Lot B,the applicant shall submit a proposed building envelope to the
Department of Planning Services for review. Upon approval by the Department of Planning Services,the
building envelope shall be delineated on the plat.

B. All approved accesses shall be clearly shown on the plat. Lot A has an existing access onto WCR 44, no
additional access will be granted. Lot B has existing access points to the property. The applicant should
utilize these agricultural access points, no additional accesses will be granted. Weld County Road 44 is
designated on the Transportation Plan Map as a Collector Status Road which requires 80 feet of future right-
of-way,there is presently 60 feet The applicant should reserve an additional 10 feet of right-of-way through
their property for future expansion,which should be delineated on the plat.
C. The following notes shall be placed on the plat:
1) All proposed or existing'structures will or do meet the minimum setback and offset requirements for
the zone district in which the property is located.
2) Any future structures on site must obtain the appropriate zoning and building permits.
3) Prior to the release of building permits on Lot B, the applicant shall submit evidence to the
Department of Planning Services that the lot has an adequate water supply of sufficient quality,
quantity and dependability.
3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the
Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7
of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of
approval by the Department of Planting Services. The applicant shall be responsible for paying the recording fees.

The Weld County Public Works Department has reviewed this proposal; the following requirements are
recommended to be a part of any approval:
COMMENTS:
WCR 44 is designated on the Transportation Plan Map as a Collector Status Road which requires 80 feet of future
right-of-way, there is presently 60 feet. This section of road is maintained by Weld County.
REQUIREMENTS:
The applicant should reserve an additional 10 feet of right-of-way through their property for future expansion.
Lot A,the 7.3-acre residential parcel, has an existing access onto WCR 44, no additional accesses will be granted.
Lot B,the 73-acre agricultural parcel, has existing access points to the property. The applicant should utilize these
agricultural access points, no additional accesses will be granted.

$293,000.00 in hand paid, has granted, bargained, sold and
conveyed, and by these presents does grant, bargain, sell, convey
and confirm unto BOOTH LAND AND LIVESTOCK whose address is c/o
Frank Booth, Box 72, Lucerne, Colorado 80646 ("Grantee") its
successors and assigns forever, all the real property, together
with the improvements, if any, situate, lying and being in the
County of Weld, State of Colorado, (the "Property"), and as
described on Exhibit A attached hereto and incorporated herein.
TOGETHER WITH all and singular the hereditaments and
appurtenances thereunto belonging, or in anywise appertaining, and
the reversion and reversions, remainder and remainders, rents,
issues and profits thereof; and all of the estate, right, title,
interest, claim and demand whatsoever of the Grantor, either in law
or equity, of, in and to the Property.
EXCEPT, specifically excluded from this conveyance are any and
DF all mineral rights and interests of the Grantor which shall be
$29.30 reserved by the said Grantor.

described with the appurtenances, unto the Grantee, its successors

WHEREAS, District has been organized as a legal body and is known as the Central Weld County Water
District, and
WHEREAS, Customers are taxpaying electors within said District, or desiring to join said District, oanr
WHEREAS, Customers are desirous of acquiring one water tap of 5/8" inches in diameter from the
said District,
NOW, THEREFORE, in consideration of the premises and the terms of this agreement, it is mutually
agreed as follows:
1 . Customer agrees to pay the tap fee of$ 4,200.00 Dollars.

2. In the event it is not economically feasible to extend the water to the property line of Customer, which
matter is in the entire discretion of District, then all sums paid hereunder shall be returned to Customer and the
