HomeMy WebLinkAbout982441.tiff HEARING CERTIFICATION DOCKET NO. 98-71 RE: APPROVE CHANGE OF ZONE#517 FROM A(AGRICULTURAL) TO E (ESTATE) FOR A FOUR (4) LOT MINOR SUBDIVISION, REMINGTON PLACE - LESLIE AND JEANNE GELVIN A public hearing was conducted on December 16, 1998, at 10:00 a.m., with the following present: Commissioner Constance L. Harbert, Chair Commissioner W. H. Webster, Pro-Tern - EXCUSED Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Ben Patton Health Department representative, Trevor Jiricek Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated November 20, 1998, and duly published November 25, 1998, in the Fort Lupton Press, a public hearing was conducted to consider the request of Leslie and Jeanne Gelvin for Change of Zone#517 from A (Agricultural) to E (Estate) for a four (4) lot Minor Subdivision. Lee Morrison, Assistant County Attorney, made this a matter of record. Ben Patton, Department of Planning Services representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Patton gave a brief description of the location of the site, and stated each lot has a designated building envelope. He stated the two-lane internal road is paved and drained, and the cul-de-sac will be maintained by the Homeowners Association. He further stated Condition of Approval #3.a addresses easements, cul-de-sac construction and radius, maintenance of the cul-de-sac and open-space, and method for crossing the existing irrigation ditch. Mr. Patton explained the Right To Farm Covenant will be placed on the plat, and water and sewer service are available. North Weld County Water District will supply water and the Department of Public Works has approved the access to the subdivision. Leslie Gelvin, applicant, stated he intends to own and build his home on one of the lots, and reiterated there is water available to the lots. In response to Chair Harbert, Mr. Gelvin stated the cul-de-sac is large enough for a bus pull-out area; however, the school district is requesting the kids be picked up on Weld County Road 15 rather than entering the subdivision. Responding to Commissioner Kirkmeyer, Mr. Gelvin stated there are two accesses; however, the access to the north will be closed. He further stated there is a water line along Weld County Road 51, as well as the ditch which runs along the west side of the property. In response to Chair Harbert, Mr. Gelvin stated he agrees with the Conditions of Approval. Responding to Commissioner Kirkmeyer, Mr. Gelvin explained building a bridge across the irrigation ditch will not be a problem. The motion was seconded by Commissioner Hall, and it carried unanimously. This Certification was approved on the 21st day of December, 1998.
