Approved with Conditions The Department of Planning Services has determined through the review,that the standards of Section 11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the policies of the County. 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. Prior to recording the plat,the applicant shall: A. Due to the prime soils located on Lot B the applicant shall submit a proposed building envelope for review and approval by the Department of Planning Services. Upon approval,the building envelope shall be placed on the plat. 1998-2693 B. The following notes shall be placed on the plat: 1. All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located, 2. Any future structures on site must obtain the appropriate zoning and building permits. C. All approved access shall be clearly shown on the plat. 3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of approval by the Department of Planning Services. The applicant shall be responsible for paying the recording fees. A letter from Central Weld County Water District is herewith enclosed concerning water availability. Lot A is serviced by an existing domestic well. 2, Lot A is serviced by an existing septic system. Any new construction on the larger parcel would require a new septic system to be installed in accordance with Weld County Health Department regulations. 3. The subject property is located approx. 2 mi. south of LaSalle on Hwy. 85, 3 mi. west on Weld Co. Rd. 46, and 1/2 mi. south on Weld Co. Rd. 29(east side). The smaller parcel is currently being used as a rural residence, and will consist of approx. 3 acres of nonprime farmland. The larger parcel of approx. 77 acs. is being used as an irrigated farm. Improvements on the smaller parcel consist of a principal residence, a nice shop-garage and second garage. 4. There will be no change in use after the exemption is granted. The smaller parcel will remain as a rural residence and the larger parcel will remain as an irrigated farm. The owners of Lot A need some additional acreage and the two acres being added to their parcel is located at the tail end of Weber's field, and is not considered prime agricultural land. No new lot and no new accesses will be created. 5. This proposal is consistent with the current Weld County Zoning Ordinace. There is no change to the property as it now exists except the change of boundaries. This proposal will definitely not interfere with any future municpal plan.
