Department of Planning Services staff reviewed your letters, USR- 809 file, and the Weld County Zoning Ordinance. Staff determined that the proposed land split and selling of 26 acres to Western mobile would be considered a material deviation from the approved plans of USR 809. To complete the land split as proposed the following would need to be completed. 1. A Recorded Exemption application for the proposed land split would need to be submitted, reviewed, and approved. 2. A Special review permit application to amended the existing Special Review permit would need to be submitted, reviewed, and approved. 3. A new Special Review permit would need to be submitted, reviewed and approved for the 26 acre parcel created. Please call me if you have any questions or need additional information. TODD HODGES WELD COUNTY PLANNING 1400 N. 17th Ave. Greeley, Colorado 80631 Dear Todd, I am writing about a partial of 160 acres owned by JCK Gravel, Inc. located SE 1/4, Sec. 4, T2N, RI68W, this partial is West of WCR 7 and North of State Highway 119. In February 1988 a gravel mining permit #M-87-176 was issued to Frontier Sand and Gravel, the Weld County USR #809-87-35 was issued at the same time. Subsequent to that date Frontier Sand and Gravel sold to Western Mobile all of their operations. Western Mobile has been mining the area for sand and gravel for about 5 years. Western Mobile is interested in purchasing and JCK Gravel, Inc. is willing to sell 26 acres in the SE corner of the quarter section. We do not want to effect the mining permit, because Western-Mobile will continue to mine for the next 10 years or so. Western Mobile does not intend to build anything on this 26 acres except what is necessary for their sand and gravel mining operations. After mining and land reclamation is complete most of the acreage will be water, however there might be some small building sites available for some use. The reclamation plan shows these sites. My question is, can JCK Gravel, Inc. sell this 26 acres to Western Mobile without a use by special review? We, Western Mobile and Gravel, Inc., would appreciate your early response to the question so we can proceed as we both desire.
