Hall, Chairman Commissioner Barbara J. Kirkmeyer, Pro -Tern Commissioner George E. Baxter Commissioner Constance L. Harbert Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Todd Hodges The following business was transacted: I hereby certify that pursuant to a notice dated October 16, 1995, and duly published October 19, 1995, in the North Weld Herald, a public hearing was conducted to consider the request of Sharon Parrill for a Site Specific Development Plan and Special Review Permit for a gift shop and Colorado Lottery ticket sales in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Todd Hodges, Planning Department representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He responded to questions from Commissioner Baxter indicating the site is in the Nunn Fire Protection District, which did not return a referral response. He also stated a mutual agreement with the District would have to be arranged between the District and Cheyenne's fire protection service. Sharon Parrill, applicant, was present and stated she has not been able to contact the Nunn Fire Protection District; however, Cheyenne's fire station is approximately eight miles away from her property. She also confirmed for the record the current owners of the property are aware of this proposal. Responding to questions from the Board, Ms. Parrill stated the building on the Colorado side is approximately 2,000 square feet, and she has had no complaints from neighbors in twenty years. Gail and Steve Ault, surrounding property owners, questioned why this property is not being rezoned since this Permit is for a commercial use. Mr. Morrison explained the Zoning Ordinance was amended eight to ten years ago to allow this Permit process, which is specific to certain uses, rather than requiring a full rezoning process. Mr. Hodges also stated this case would be considered spot zoning and land -locked, which would cause future problems, and the zone would be changed only on the Colorado side. Mr. Morrison answered further questions concerning the differences in uses in the various zone districts. Ms. Ault explained they were once refused by the County the right to retain the existing use on their property when they bought it. Mr. Morrison and Mr. Hodges clarified they cannot respond without specifics and questioned the relevance to this hearing. Mr. Ault noted one or two residences constitute a lower use and less traffic than this proposed commercial business. He clarified they are not objecting to this proposal; however, he reiterated they were refused the right to continue an existing use, which was negotiated with the Board in 1981. Ms. Ault noted the Cheyenne fire protection responded to a fire started on their property by a cigarette butt from the adjacent bar. Commissioner Baxter reiterated this proposal is for a Special Use Permit, which is a lengthy and costly process. No further public comment was offered. Commissioner Harbert moved to approve the request of Sharon Parrill for a Site Specific Development Plan and Special Review Permit for a gift shop and Colorado Lottery ticket sales in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record.
