APPOINTING COMMISSIONER TO CONVEY REAL PROPERTY/p9VVgy PUBLIC AUCTION HELD ON
July 10, 1958, 4/6th interest in Lot 24, Block 11, Windsor, to the Town of Windsor,
Colorado:
Commissioner WARREN offered the following resolution and moved its adoption:
WHEREAS, Weld County, Colorado, has acquired and is the owner of the following
described real property, duly recorded in the records of the County Clerk and Recorder
of the County of Weld, State of Colorado, as follows, to-wit:

and WHEREAS, said property, excepting therefrom the reservations in favor of the Union
Pacific Railroad Company; and excepting therefrom the reservations in the United States
Patent and existing reservoir sites and irrigation ditches, if any, existing rights-
of-way for public highways and roads, and any and all existing easements of rights-
of-way, however evidenced or acquired, and subject to existing leases; and excepting
therefrom all oil, gas and other minerals therein or thereunder, together with the
right to prospect for and remove the same; and all county owned structures, if any,
on said property, and all property used for county purposes; has been duly advertised
for sale at a public auction held on July 10, 1958 at the hour of
one-thirty o'clock. P.M., in the office of the Board of County Commissioners,
and WHEREAS, at said sale this Board, upon advise of the County Attorney, Robert G.
Smith, withdrew said property from the sale, since this Lot in its entirety has been
used as a public alley since the year 1902, and the other two 1/6th interest holders,
(1/6th interest interest-David Winograd and 1/6th interest-Lorenzo Earl Scott),of said
Lot have agreed to deed their said interests to the Town of Windsor if Weld County having
4/6th interest in said Lot, will dee d interest to the Town of Windsor,
and WHEREAS, this Board believes it to be to the best interests and welfare of the
public to deed 4/6th interest in Lot 24, Block 11, in the Town of Windsor, Colorado,
to the Town of Windsor, Colorado, to be used perpetually as a public alley.
NOW, BE ST RESOLVED, andit is hereby ordered that Charles 0. Bursiel , who
is the County Treasurer of Weld County, Colorado, is hereby constituted arappointod
as Commissioner for Weld County, Colorado, to convey, without covenants of warranty,
said property as aforesaid, to said Town of Windsor, Windsor, Colorado
which property is more particularly described
as follows, to-wits

IT IS FURTHER ORDERED, that to such conveyance, the said Charles 0. Bursiel
as such Commissioner to convey said property, is authorized to affix the seal of said
County and said conveyance, when executed according to this order, shall have the ef-
fect to transfer to said The Town of Windsor , Colorado,
all right, title and interest which Weld County has in
and to the above described property, except only and subject to the exceptions andres-
ervations hereinabove mentioned or referred to. Weld County does not warrant title.
The motion was seconded by Commissioner Shul z nd the resolution was
adopted by the following vote:

I am writing to you concerning the 4/6 interest in
Lot 24, Block 11, Town of • indsor, Colorado, to which you hold
a Treasurers Deed, and which you recently advertised for sale
at pu. _ lic auction.
This lot has been used as a public alley since 1902
and to my own personal knowledge it has been so used since January,
1930. The business buildings west of this lot were built facing
west from 1902 and on to about 1908. The various owners acquired a
1/6 interest each by early deeds in this lot so that it could be
used by the general puilic in connection with the businesses built
along there. Dave :Winograd and Lorenzo Earl Scott, each owner of
record of 1/6 interest each in the lot, have just deeded their
interests to the Town of '. indsor so that it will be maintained as
a pu :lic alley in same manner as it maintains other public alleys .
Inasmuch as this lot has been used by the general public
every since 1902, it is not available for sale like any privately
owned property because the right as a public alley has been established
by the long time 'usage. Therefore to keep the record straight and
in order that the Town may be free to maintain this property as a
public alley, the Town requests that the CQ.unty deed this property
to the Town. This is in accordance with the wishes of the property
owners adjacent to this lot and is to the best interests of the
public.
