Baxter, Chair Commissioner Constance L. Harbert, Pro-Tem Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer - EXCUSED Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Kerri Keithley The following business was transacted: I hereby certify that pursuant to a notice dated June 4, 1997, and duly published June 12, 1997, in the South Weld Sun, a public hearing was conducted to consider the request of Russ and Bonnie Heppner for a Site Specific Development Plan and Special Review Permit #1145 for a private airstrip in the A (Agricultural) Zone District. Chair Baxter stated only four Commissioners are present and explained, in the event of a tie vote, Commissioner Kirkmeyer will review the record and cast the deciding vote. Lee Morrison, Assistant County Attorney, made this a matter of record. Kerri Keithley, Department of Planning Services representative, presented a brief summary of the proposal and stated the airstrip is proposed to be 50 -feet wide by 1500 -feet long and will be 20 feet from the right-of-way of Weld County Road 53. She explained the FAA (Federal Aviation Administration) was unaware of the close proximity to the right-of-way until after the Planning Commission hearing and has since recommended by letter dated May 29, 1997, included in Exhibit B, a safety area of 60 feet and an object -free area of 125 feet, either side of the runway centerline. Ms. Keithley then entered the favorable recommendation of the Planning Commission into the record as written, including a modification, as detailed in the Administrative Review marked as Exhibit C, to Condition of Approval #2.A. concerning said recommendation of the FAA. Russ Heppner, applicant, was present and stated he lives on site and he understands the FAA's recommendation; however, moving the runway will take more alfalfa out of production, noting Weld County Road 53 is rarely used and ends at a "T". He explained the aircraft which will be used is similar to an ultra light and requested the runway be allowed closer to Road 53 than the FAA recommended. Responding to questions from the Board, Mr. Heppner stated irrigation will be interrupted if he plants between the road and the airstrip. Don Carroll, Public Works Department, stated traffic count on Road 53 ranges from 117 to 182 in a five -mile stretch. He confirmed, however, the traffic is heavier at the south end than the north. Mr. Heppner stated during his 971204 PL1097 RE: HEARING CERTIFICATION - HEPPNER (USR #1145) PAGE 2 conversation with the FAA he was told it can make only recommendations, because the airstrip is private. He also noted the strip runs parallel to the road and is for a hobby, with no more than twelve flights per month. Commissioner Hall stated his opinion is that separation is needed between the road and airstrip, because the future cannot be predicted. Commissioner Harbert agreed, and Mr. Morrison clarified the FM considers the road an object; therefore, the amount of traffic is not the issue, the road itself is considered for the safety setback. Mr. Heppner confirmed he owns the ground to the north and the airstrip is 100 feet from the south property line, which adjoins a farmed field. He suggested the runway be shortened to 1400 feet to increase the distance from the south property line and, after further discussion, agreed to decrease the runway to 1360 feet in compliance with the FAA's recommendation. He noted he only needs 500 to 600 feet of runway for the type of aircraft he uses. Mr. Heppner and Ms. Keithley confirmed there have been no complaints or objections from neighbors. Commissioner Hall suggested adding Condition of Approval #2.A.iii., requiring a safety area of 240 feet on each end of the runway located on the property. Mr. Heppner agreed to said addition and all other Conditions of Approval and Development Standards. Further discussion ensued, and Mr. Heppner clarified his driveway is at the north end of the runway. No public testimony was offered concerning this matter. Commissioner Hall moved to approve the request of Russ and Bonnie Heppner for a Site Specific Development Plan and Special Review Permit #1145 for a private airstrip in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record, including the modification to Condition of Approval #2.A. as suggested by staff and the addition of Condition of Approval #2.A.iii. The motion was seconded by Commissioner Harbert, and it carried unanimously. This Certification was approved on the 30th day of June, 1997.
