RE: ACTION OF THE BOARD REGARDING VIOLATION OF THE WELD COUNTY ZONING
ORDINANCE - ARNY AND LINDA KAY LONG, VI #2213
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Amy and Linda Kay Long, VI #2213, are allegedly in violation of the Weld
County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 12th day of September, 1995, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Amy Long, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners, after studying the case file and hearing
the statements and recommendations of Department of Planning Services staff in this matter,
deems it advisable to close said case.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #2213 against Amy and Linda Kay Long regarding violation of the Weld
County Zoning Ordinance be, and hereby is, closed.

or the noncommercial junkyard must be removed from the property.
The Department of Planning also recommends that the County Attorney be authorized to
proceed with legal action against any other persons occupying the properties, any person
claiming an interest in the properties, and any persons acting in active concert with the
identified parties.

The property referenced above remains in violation of the Weld County Zoning Ordinance. I
have scheduled a meeting with the Board of County Commissioners on September 12, 1995 at
10:00 a.m. to consider the Zoning Violation occurring on your property. This meeting will take
place in the County Commissioners' Hearing Room, first floor, Weld County Centennial Center,
915 Tenth Street, Greeley, Colorado. It is recommended that you or a representative be in
attendance to answer any questions the Board of County Commissioners might have about the
violation.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation, the
action necessary to correct the violation, and that you were given sufficient time to remedy the
violation. The property will be reinspected September 11, 1995.

The property was inspected to determine compliance with section 31.2, 31.3 and 31.4 of the
Weld County Zoning Ordinance. The property is not in compliance at this time. There is still a
non-commercial junkyard located on the property. The junkyard consists of trash, rags,
furniture, used fencing materials including wood and wire. I did talk to Linda Long, the
property owner. She did state that she expected to have the non-commercial junkyard cleaned up
by September 1, 1995. On August 21, 1995 I did talk to Linda Long about the tractor business
that is being run out of the property. She did tell me that it is,a full time occupation. She did also
say that the business is not run on the property, but that the equipment does leave from the
property and is used at different work sites.

The uses on the above described property are being considered as a zoning violation of Section 31.2,
31.3 and 31.4 of the Weld County Zoning Ordinance.
This is not a use allowed by right in the Agricultural zone district. The violation can be corrected by
removing the non-commercial junkyard from the property or properly screening it from all adjacent
properties and public rights of way. If the screening option is chosen, a detailed screening plan must be
submitted and approved by the Department of Planning Staff prior to installation. There is also some
concern with the type of business being operated on the property. Please call one of the current planners
at the Department of Planning for information regarding your business operations. They can explain
what exactly is allowed or not allowed in the Agricultural Zone District.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have 30 (Thirty)
days from July 18, 1995 to correct this zoning violation. Failure to do so will result in this office
scheduling the violation before the Board of County Commissioners to consider whether to refer the
violation to the County Attorney's office for legal action.
Any information you have that may help to resolve this matter will be helpful. This office is ready to be
of any assistance in clarifying or answering questions concerning this matter. Please call or write the
Department of Planning Services' office.

The property was inspected to determine compliance with section 31.2, 31.3, and 31.4 of the
Weld County Zoning Ordinance. The property is not in compliance at this time.
I spoke to Mrs. Long at the time of inspection. I asked her if there was a landscaping business
located on the property and at first she said yes, and then she said it wasn't really landscaping.
She gave me one of the business cards which says J & J Tractor Service: Mowing, Plowing,
Grading, Loading, Backfill, Hauling & More. I asked her if trucks were in and out of the
property or if there was any dumping of materials on the property and she told me no. I asked
the adjacent property owner, to the east of the Long's property, for permission to look at the back
side (east side) of the Long's property from the adjacent property. She gave me permission and I
walked back to where the properties meet. Several of the adjacent property owners indicated that
trucks were in and out of the property and had been dumping on the east end. There were several
large piles of miscellaneous junk located on the Long's property consisting of miscellaneous used
building materials, wire, appliances and other miscellaneous junk. This is not a use allowed by
right in the Agricultural Zone. There was also a complaint of a fire located in this vicinity a few
days before my inspection. The Environmental Protection Agency (EPA) and the Fire District
for the area were notified. To bring the property into compliance the non-commercial junkyard
must be removed from the property or properly screened from all adjacent properties and public
rights of way. If the screening option is chosen, a detailed screening plan must be submitted to
the Department of Planning Staff for approval prior to installation.
Five photographs were taken of the non-commercial junkyard located on the property at the time
of inspection.
