We feel that this PUD violates the intent of the Weld County Long Range Development Plan by putting another PUD in an area already being saturated with recorded exemptions and other PUDs. We already have a PUD of eleven homes on a 140 acre site just across WCR 50 to the north of our home. The Burman PUD will add 5 homes on the opposite side of my property. These two PUDs will only be separated by a one half mile buffer which is our farm and home. This is in addition to the 13 homes which have been built on recorded exemptions in the last 6 years that we can see from our back porch. We realize that Weld County is growing but feel that growth such as this PUD is a detriment to our neighborhood. My farming neighbors feel the same way. Twelve of us presented the Planning Department a petition expressing our objection to the Burman PUD a year ago. This petition was not even mentioned by the Planning Department at the Planning Commission Meeting in October. We are also very concerned that our basic infrastructure, particularly water and roads, is becoming saturated and cannot handle additional housing such as this PUD. We are afraid that the Burman's have fallen into a common trap. They paid an inflated price for farmland, discovered that farming is not a high paying adventure, and now want to grow houses to make their payments. They already have put two homes on the 80 acre property and now want to add five more. Farming next to one PUD is difficult enough. The county Right to Farm Act is very commendable but in practice very difficult to enforce. Within the past year we have had trespassing problems, fences run over, complaints about irrigation pump noise, and our dog was poisoned and died. Obscene jesters while driving on WCR 50 and 53 with farm machinery are now common place. Because of work we will be unable to attend the December 9th Commissioners meeting to express our opposition. Water Division 1, Water District 1 Dear Mr. Jerman: We have received additional information for the above referenced proposal to subdivide 79.3 acres into 5 residential lots. The proposed water source is Central Weld County Water District (District) and a letter of commitment has been submitted. The "Water Supply Information Summary" form which was submitted indicates that the use of water will be household use only, however, the quantity of water used per house is not clear. This office estimates that at 80 gallons per capita per day, with a household of 3.5 persons, the water requirement would be 280 gallons per day or 0.314 acre-foot per year. The total development would require1.57 acre-feet per year. Information submitted by the District shows that the District has approximately 5,787.3 acre-feet of secure water supplies. Currently, approximately 5,373.1 acre-feet have been committed. Pursuant to Section 30-28-136(1)(h)(II), C.R.S., the State Engineer's Office offers the opinion that the proposed water supply will not cause material injury to existing water rights, and with the Central Weld County Water District serving the proposal, the supply is expected to be adequate. Patina Oil & Gas Corporation ("Patina") owns oil and gas leasehold rights in the E'/2SE''A and operates the Reistad #1 well (the"Well") located in the SE%SE'%. Patina is very concerned about the impact the change of zoning will have on Patina's development, completion, production and maintenance operations associated with the Well and the lands. The Preliminary Plat indicates that the Well is located in Outlot A and that the production facilities for the Well are located in Lot 3 adjacent to Weld County Road 53. The Preliminary Plat does not locate the flowline that connects the Well to the production facilities. The location of the flowline must be included on the Preliminary Plat so that future surface development does not encroach on the flowline. Patina requests assurance from Weld County and the Applicant that the change of zone will not block access or preclude Patina from drilling, operating and maintaining the Well. Patina wishes to be sure that the change of zone will not prevent further operations on the Well including, but not limited to, workovers, recompletions, deepening or redrilling. Additionally, from time to time, it will be necessary to bring drilling rigs and other industrial equipment to the Well to perform various operations. Patina is opposed to the change of zoning unless its approval provides for adequate setbacks from the Well, production facilities and flowlines and provides access to the Well, production facility and flowlines that is satisfactory to Patina.
