Wallace 20261 WCR 53 Kersey, CO 80644 RE: Your Letter Dated March 2, 1999 Dear Mr. Wallace: The Kersey Fire Department is a special district established under the name of Platte Valley Fire Protection District (FPD)by the vote of the electors under supervision of the Weld District Court in District Court Case CV #12665 in 1954. Special Districts are quasi- municipal entities recognized and authorized by the Colorado Constitution and by statute, now found at C.R.S. Title 32, Article 1, and are governed by an elected Board of Directors. Copies of the Statute are available in the Weld Library District and at http://web.intellinetusa.com/stat98/ if you have web access. You may also be able to obtain information regarding the workings of Special Districts by contacting the Department of Local Affairs, Division of Local Government, (303) 866 2156. At the time of the District's creation, the statutes did not provide for any role for the county to play in the creation of special districts. Were this district to be created today, a service plan would have to be reviewed and approved by the Board of County Commissioners of Weld County before a vote of the electorate could be authorized by the Court. The County does not oversee the operation of the District and, even under the current statute, the County's role would be limited to requesting reports or considering amendments to the service plan. State law regarding emergency medical services is found at C.R.S. Title 25, Article 3.5. and in the Colorado Regulations at 6 CCR 1015-3 and 3 CCR 713-6. Weld County has adopted ambulance regulations in Ordinance 77-D. Those rules,particularly 3-CCR-713-6 §3.3 and § 4.1, provide that emergency medical treatment may only be conducted under the supervision of a physician advisor and that physician must have confidence that the Emergency personnel under his supervision will follow all protocols and his or her direction. The County is not in a position to respond as to why the FPD has not been able to retain a physician advisor's services as that is between the physician and the FPD. It is our understanding that Dr. Campain has recently agreed to act as physician adviser. The state regulations are enforced by the State board of medical examiners, in the Department of Regulatory Affairs (303) 894-7690, and that Board is advised by the State Trauma Advisory Board in the Colorado Department of Health and the Environment (303) 692-2980. Hall, Chair Attachments: CCR and Court Order M:\WPFILES\LET\WALLACE.WPD Rules Pertaining to Emergency Medical Services 6 CCR 1015-3 Section 1 - Purpose and Authority for Establishing Rules 1.1 The purpose of these rules is to replace the existing rules pertaining to emergency medical services with rules that will more adequately address: 1) current changes in pre-hospital emergency medical care, 2) the department recognition process for pre-hospital emergency medical care Training Centers and groups to assure standardized training, 3) the certification process for all levels of emergency medical technician, 4) disciplinary procedures for denial, revocation, limitation, or suspension of an individual's emergency medical technician certificate, 5) the collection of essential data related to the performance and needs of the emergency medical care system in Colorado, and 6) the minimum equipment required to be carried on each ambulance. 1.2 General Authority for the promulgation of these rules is set forth in C.R.S. 25-3.5-105. 1.3 These rules apply to and are controlling for: 1) qualified applicants that desire to be state recognized as a Training Center or Training Group for the purpose of conducting established training courses (25-3.5-201), 2) certification requirements for all persons who desire to be state certified as an emergency medical technician (25-3.5-203), 3) disciplinary procedures for denial, revocation, limitation, or suspension of an individual's emergency medical technician certificate, and 4) ambulance services, as defined i.n 25-3.5-103 (3), shall be governed by these rules for the provisions and maintenance of essential data and reporting requirements (25-3.5- 501), and minimum essential equipment to be carried on ambulances (25-3.5-301(2)(a)). Section 2 - Definitions 2.1 All definitions which appear in C.R.S. 25-3.5-103 shall apply to these rules. 2.2 "Advanced Cardiac Life Support (ACLS) - A course of instruction sponsored by the American Heart Association designed to prepare students in the practice of advanced emergency cardiac care. 2.3 "Ambulance Transport Agency" - Any public agency, volunteer organization or commercial enterprise licensed as an ambulance service by the Board of County Commissioners of any Colorado county. 2.4 "Board of Medical Examiners Rules" - Rules adopted by the Board of Medical Examiners which establish responsibilities of physician advisors and all authorized acts of emergency medical technicians. 2.5 "Council" - State Advisory Council on Emergency Medical Services. 6 CCR 1015-3 Colorado EMS Rules 9/98 2.6 "Division" -Emergency Medical Services Division of the Colorado Department of Health. 2.7 "Emergency call" - A real or self-perceived event where the EMS system is accessed by the 9- 1-1 emergency access number or its local equivalent, or an interfacility transfer where the patient's health or well-being could be compromised if the patient is held at the originating facility indefinitely. 2.8 "EMD Training Group" - A public safety communications center, public safety agency, or EMS provider agency that has been formally recognized by the Division to conduct Emergency Medical Dispatcher Training curricula established by the Division in accordance with C.R.S. 25-3.5-201. 2.9 "Emergency Medical Technician-Basic (EMT-B)" - An individual who holds a current and valid Emergency Medical Technician-Basic certificate issued by the Division. 2.10 "Emergency Medical Technician-Basic-IV(EMT-IV)" -Any individual, holding a current and valid Emergency Medical Technician-Basic certificate, and, who has successfully completed a Division recognized training course in Intravenous therapy, and, in accordance with Board of Medical Examiners rules, is registered by the Division. 2.11 "Emergency Medical Technician-Basic-Defibrillator(EMT-D)" - Any individual, holding a current and valid Emergency Medical Technician-Basic certificate, and, who has successfully completed a Division recognized training course in automated external defibrillation, and, in accordance with Board of Medical Examiners rules, is registered by the Division. 2.12 "Emergency Medical Technician-Intermediate (EMT-I)" - Any individual who holds a current and valid Emergency Medical Technician-Intermediate certificate issued by the Division. 2.13 "Emergency Medical Technician-Paramedic (EMT-P)" - An individual who holds a current and valid Emergency Medical Technician-Paramedic certificate issued by the Division. 2.14 "Graduate EMT-Intermediate" - an individual who has successfully completed a Division recognized Emergency Medical Technician-Intermediate training course but has not yet successfully completed the certification requirements set forth in these rules. 2.15 "Graduate EMT-Paramedic" - An individual who has successfully completed a Division recognized EMT-Paramedic training course but has not yet successfully completed the certification requirements set forth in these rules. 2.16 "Medical Director" - A Colorado licensed physician who is specifically designated and has accepted responsibility for directing the conduct of pre-hospital training courses conducted by a Division recognized Training Center or Training Group, and for evaluating the performance of students in such training courses. 2.17 "Physician Advisor" - A Colorado licensed physician who establishes protocols and standing orders for medical acts performed by EMT-Basics, EMT-Intermediates, or EMT-Paramedics of a prehospital emergency medical care service agency and who is specifically identified as being responsible to assure the competency of the performance of those acts by such EMT- 6 CCR 1015-3 Colorado EMS Rules 9/98 Basics, EMT-Intermediates, or EMT-Paramedics. 2.18 "Refresher/Continuing Education" - A course of instruction designed to provide training to persons for the purpose of preparing them for renewal of certification. A course of instruction condensed over a short period of time is classified as a refresher course. The same course, or a self directed program, extended over a period of three years which meets the educational requirements for renewal of certification is classified as Continuing Education. 2.19 "Training Center" - A university, college, vocational educational institution, or licensed hospital that has been formally recognized to conduct training courses for the purpose of preparing individuals for state certification or course completion certificates issued by the Division. Training Centers are eligible to apply for any or all of the specialized training courses specified in section 3.1. • 2.20 "Training Course" - A series of lectures and other training activity that has been developed from curricula designed and developed by the Division in consultation with the Council and the Board of Medical Examiners. 2.21 "Training Course Policies" - Policies and procedures developed by the Division and the Council that provide the basis for proper instruction of specialized curricula to be conducted by the Training Center or Training Group. 2.22 "Training Group" - An EMS provider agency or organization that has been formally recognized by the Division to conduct training courses for the purpose of preparing individuals for renewal of certification as emergency medical technicians. A Training Group is eligible for recognition to conduct training curricula for Emergency Medical Technician Refresher/Continuing Education Classes, Emergency Medical Technician - Basic -Intravenous Therapy, and Emergency Medical Technician-Basic-Defibrillator. Section 3 - Recognition of Training Centers and Training Groups for the Purpose of Establishing Eligibility to Conduct Training Courses Which Prepare Individuals for State Certification. 3.1 Specialized Training Curricula The Department, in accordance with 25-3.5-201, has established the following training curricula. 3.1.1 Emergency Medical Dispatcher-Provider (Initial and Refresher/Continuing Education 3.1.2 Emergency Medical Dispatcher-Instructor/Coordinator 3.1.3 Emergency Medical Technician-Basic (Initial and.Refresher/Continuing Education) 3.1.4 Emergency Medical Technician-Basic-Intravenous Therapy (IV) 3.1.5 Emergency Medical Technician-Basic-Defibrillator 6 CCR 1015-3 Co1ora3c -IRIS Rules 9/98 3 3.1.6 Emergency Medical Technician-Intermediate (Initial and Continuing Education) 3.1.7 Emergency Medical Technician-Paramedic (Initial and Refresher/Continuing Education) 3.1.8 Emergency Medical Service-Instructor 3.2 Application for Recognition as a Training Center or Training Group. To qualify the applicant must submit documentation containing the following: 3.2.1 An application form provided by the Division containing information deemed appropriate by the Division. 3.2.2 A narrative description for each level or levels of EMT training course or courses which the applicant is applying for recognition, the area to be served by the Training Center or Training Group,justification that the training course is needed within the area of service, and the approximate number of courses that will be conducted over the three year recognition period. 3.2.3 An agreement acknowledging the role of the Division in the recognition process and attesting to the fact that the applicant will conduct training courses that will be overseen by the Training Center or Training Group Medical Director and in conformance with training course policies established by the Division and Council. 3.2.4 A personnel roster, to include a curriculum vitae for the course coordinator and medical director and the names of the instructional staff. 3.2.5 A description of the facilities to be used for course didactic and clinical instruction and a listing of all training aids, and medical equipment necessary for the course. 3.2.6 Course policies and procedures, which at a minimum shall include: a) admission requirements, b) attendance requirements, c) course schedule which details a breakdown of the didactic, clinical, skills evaluations and testing criteria of the training course, d) discipline/counseling of students, e) grievance procedures, f) successful course completion requirements, g) testing policies, h) tuition policy statement, 6 CCR 1015-3 Colorado EMS Rules 9/99 i) infection control plan, j) description of insurance coverage for students, k) state practical examination policies, if applicable, and 1) continuous quality improvement plan. 3.3 Application Procedures for Recognition as an EMD Training Group. To qualify for recognition, the agency must submit the following: 3.3.1 An application form provided by the Division containing information deemed appropriate by the Division. 3.3.2 An agreement acknowledging the role of the Division in the recognition process and attesting to the fact that the applicant will conduct the programs in conformance with training course policies adopted by the Division and Council. 3.3.3 Name and qualifications of the instructor. 3.3.4 Course policies and procedures, that at a minimum shall include: a) admission requirements, b) attendance requirements, c) course schedule which details a breakdown of the didactic, clinical, and testing criteria, d) discipline/counseling of students, e) grievance procedures, f) successful course completion requirements, g) testing policies, h) tuition policy statement, and i) continuous quality improvement plan 3.4 Emergency Medical Service Instructor Course. 3.4.1 The Division provides Emergency Medical Service Instructor training courses to prepare individuals as an Emergency Medical Services Instructor. Any educational institution or hospital may submit an application containing information deemed appropriate by the Division to conduct an Emergency Medical Services Instructor Course. Upon acceptance of the requirements specified in training course policies 6 CCR 1015-3 Colorado 11143 Ruses 9/96 adopted by the Division and the Council, the applicant may conduct the instructor training course. 3.5 Procedure for Training Center, Training Group, and EMD Training Group Recognition. The Division will notify the applicant regarding the status of the application. This notification will either specify official recognition, indicate that a site visit is required, or identify deficiencies with the application. 3.5.1 If the notification specifies a site visit, the applicant should be prepared to introduce staff, faculty, medical director, and show all documentation, equipment, supplies and facilities. 3.5.2 Applications determined to be incomplete shall be returned to the applicant with a list specifying elements to be completed. 3.5.3 Official recognition shall be in written form from the Director of the Division, and shall be based upon proof that the applicant has met all application requirements, has demonstrated the ability to conduct training courses in compliance with training course policies, has the necessary professional staff, equipment and supplies to provide the training, and has justified the need for training within the area of service. 3.5.4 Denial of recognition will be in accordance with Section 4 of these rules. 3.5.5 Training Center recognition shall be valid for a period of three (3)years from the date of the final recognition letter. Renewal of recognition shall be based upon satisfactory past performance and submission of an application form containing information as specified in Section 3.2. The Division may require an additional site visit in conjunction with the renewal application. 3.6 Minimum Course Coordinator Requirements for Currently recognized Training Centers or Groups. By no later than January 1, 1995, currently recognized Training Centers and Training Groups must utilize a course coordinator that has successfully completed a state Emergency Medical Services Instructor course or its equivalent as established by the Division. 3.7 Recognition Procedures for Currently Recognized Training Centers and Training Groups. 3.7.1 By no later than 1 year from enactment of these rules, all Training Centers and Training Groups recognized by the Division prior to the enactment of these rules shall be required to submit all information as specified in Section 3.2 of these rules. 3.7.2 Currently recognized Training Centers or Training Groups complying with the provisions stated in 3.7.1 shall receive official recognition which shall be valid for a period of three (3) years from the date of issue. 3.7.3 Currently recognized Training Centers which fail to comply with the provision of 3.7.1 will no longer be recognized as a Training Center. 6 CCR 1015-3 Colorado EMS Rules 9/99 6 3.8 By no later than 1 year from enactment of these rules, currently recognized EMT-Paramedic Training Centers must obtain accreditation by the American Medical Association Committee on Allied Health Education (soon to be the Committee on Accreditation of Allied Health Educational Programs) upon the recommendation of the Joint Review Committee on Educational Programs for the Emergency Medical Technician-Paramedic. 3.9 To maintain recognition as an EMT-P Training Center, Training Centers receiving recognition after the date of enactment of these rules must receive accreditation within one year after completion of the first training course. Section 4 - Denial, Revocation, Suspension, or Limitations of Training Center or Training Group Recognition 4.1 The Department, in accordance with the administrative procedures act, 24-4-101, et seq., may initiate action to deny recognition if any of the following conditions apply. 4.1.1 The applicant does not possess the necessary qualifications to conduct an adequate training course in conformance with established training course policies. 4.1.2 The applicant is not capable of providing the necessary clinical experience that will enable the student to gain practical skills in the performance of patient care. 4.1.3 The applicant has not demonstrated that a need exists within the area to conduct the training course. 4.1.4 The applicant has committed fraud, misrepresentation, or deception in applying for recognition. 4.1.5 The applicant fails to meet the application requirements specified in Section 3 of these rules. 4.2 Any currently recognized Training Center or Training Group may have their recognition suspended, revoked, limited, or placed on probation by the Department in accordance with the provision of the Administrative Procedures Act as defined in C.R.S. 24-4-101, et seq, for the following reasons: 4.2.1 Failure to conduct the training courses in compliance with training course policies. 4.2.2 Students are not receiving a course of instruction which meets generally accepted standards. 4.2.3 Failure to notify the Division of changes in the medical director or course coordinator. 4.2.4 Providing false information to the Division with regard to successful completion of training or successful completion of the state practical examination on behalf of students. 4.2.5 Failure to comply with the provisions specified in Section 3.8 or 3.9. 6CCR1015-3 Colorado EMS Rules 9/98 Section 5 - Initial EMT-Basic, EMT-Intermediate, EMT-Paramedic Certification 5.1 General Requirements 5.1.1 No person shall hold themself out as an Emergency Medical Technician or offer, whether or not for compensation, any services included in these rules or authorized acts permitted by the Board of Medical Examiners Rules, unless that person is currently state certified as an Emergency Medical Technician under these regulations, or is working under the provisions of the Board of Medical Examiners Rules pertaining to Graduate EMT-I or Graduate EMT-P, or otherwise authorized by law. 5.1.2 Certificates issued by the Division shall be for the highest level of training attained by the individual, and multiple certification within the levels of EMT will not be permitted. Certification at a higher level indicates that the holder of the certificate may also provide medical care at a lower level of certification provided the certification has not been revoked, modified, suspended, or expired. 5.1.3 All applicants must complete certification requirements within six (6) months from successful completion of the training course. Successful completion of training shall be the date specified on the course completion certificate issued by the Training Center or Training Group. If an individual does not successfully complete certification requirements within six months from successful completion of training, that individual may still receive initial certification by complying with the re-entry requirements specified in Section 7. 5.1.4 Any individual holding current and valid EMT state certification may request a lower level of certification upon written request to the Division. The Division will issue a certificate for the appropriate level. Such certificate will be valid for the remaining time allotted on the higher level certificate. 5.1.5 Any individual dropping in levels of certification will not be permitted to elevate to a higher level of certification until such time as that individual either successfully completes an initial training course or, if eligible, complies with the re-entry requirements as specified in Section 7 of these rules, and successfully completes state certification requirements. 5.2 The Division shall issue an initial EMT-B or EMT-I certificate to any applicant who: 5.2.1 is at least 18 years of age at the time of application; and 5.2.2 submits an application form containing such information as deemed appropriate by the Division; 5.2.3 provides the following reports: a) a current report, obtained from the Colorado Bureau of Investigation, local law enforcement agency, or the applicant's employer, that provides information as to whether the applicant does or does not have 6 CCR 1015-3 Colorado EMS Rules 9/38 8 a past history of criminal activity, and b) a current report, obtained from the State Motor Vehicle Division, local law enforcement agency, or the applicant's employer, that provides information as to whether the applicant does or does not have a past history of motor vehicle traffic violations. c) for purposes of this section, a current report is defined as a report obtained no earlier than 3 months prior to submitting application. 5.2.4 successfully completes an initial EMT-B or EMT-I training course from a Division recognized training center, or has received Division approval for transfer of out of state certification; 5.2.5 possesses current professional level Basic Cardiac Life Support (CPR) certification issued by a national or local organization recognized by the Division as providing training in cardiopulmonary resuscitation at the time of application; 5.2.6 successfully completes the state practical examination requirements conducted by a recognized training center; and 5.2.7 successfully completes the state written examinations requirements. 5.2.8 The requirement specified in 5.2.6 must be completed prior to taking the written examination. 5.3 The Division shall issue initial EMT-P certificates to any applicant who: 5.3.1 is at least eighteen (18) years of age at the time of application, and 5.3.2 submits an application form containing such information as deemed appropriate by the Division; 5.3.3 provides the following reports: a) a current report, obtained from the Colorado Bureau of Investigation, local law enforcement agency, or the applicant's employer, that provides information as to whether the applicant does or does not have a past history of criminal activity, and b) a current report, obtained from the State Motor Vehicle Division, local law enforcement agency, or the applicant's employer, that provides information as to whether the applicant does or does not have a past history of motor vehicle traffic violations. c) for purposes of this section, a current report is defined as a report obtained no earlier than 3 months prior to submitting application. 6 CCR 1015-3 Colorado EMS Rules 3/98 9 5.3.4 successfully completes an initial EMT-P training course from a Division recognized Training Center, or has received Division approval for transfer of out of state certification; 5.3.5 possesses current ACLS certification by a Division recognized organization at the time of application; 5.3.6 successfully completes the state practical examination requirements conducted by a Division recognized Training Center; and 5.3.7 successfully completes a state written examination. 5.3.8 The requirements specified in Section 5.3.6 must be completed prior to taking the written examination. 5.4. All certificates issued by the Division shall be valid for three years from the date of issue. Date of Issue for initial certification is defined as the date the applicant has successfully completed the written examination. Section 6 - Renewal of EMT Basic, EMT-Intermediate, EMT-Paramedic Certificates 6.1 General Requirements 6.1.1 Any individual who holds an expired EMT certificate is not classified as a state certified EMT and shall not hold themselves out as such or provide medical care in the capacity of a state certified emergency medical technician. 6.1.2 All persons who have permitted their certification to expire for a period not to exceed 6 months from the expiration date may renew their certification by complying with the provisions of this Section 6. Any person permitting their certification to expire for a period greater than 6 months from the expiration date will not be eligible for renewal of certification and, if desiring to become re-certified, will be subject to compliance with the re-entry program requirements specified in Section 7 of these rules. 6.1.3 All certificates renewed by the Division shall be valid for three years from the date of issue. a) Date of issue is established as follows: 1) for applicants successfully completing the renewal of certification requirements and written examination earlier than six months from the expiration date listed on their current certificate, the date of issue will be the date of successful completion of the written examination. 2) for applicants successfully completing the renewal of certification requirements and written examination during the last six months prior to their current certificate expiration date, the date of issue will be the expiration date of the current valid 6 CCR 1015-3 Colorado EMS Rules 9/98 10 certificate being renewed. 3) for applicants successfully completing the renewal of certification requirements after the expiration date of their certificate, the date of issue will be the date of successful completion of the written examination. 6.2 The Division shall renew a current and valid EMT-B, EMT-I, or EMT-P certificate or one not more than six (6) months expired for persons who: 6.2.1 submit an application form containing such information as deemed appropriate by the Division; 6.2.2 provide the following reports: a) a current report, obtained from the Colorado Bureau of Investigation, local law enforcement agency, or the applicant's employer, that provides information as to whether the applicant does or does not have a past history of criminal activity, and b) a current report, obtained from the State Motor Vehicle Division, local law enforcement agency, or the applicant's employer, that provides information as to whether the applicant does or does not have a past history of motor vehicle traffic violations. c) for purposes of this section, a current report is defined as a report obtained no earlier than 12 months prior to submitting application. 6.2.3 successfully completes the appropriate level refresher/continuing education training course conducted by a Division recognized Training Center or Training Group; 6.2.4 successfully completes the appropriate level state practical skill evaluation conducted by a Division recognized Training Center or Training Group no earlier than twelve (12) months prior to the expiration of the current certification; and 6.2.5 successfully completes a state written examination. 6.2.6 In addition to 6.2.1 through 6.2.5, the following shall apply: a) Persons renewing an EMT-Basic or EMT-Intermediate certificate shall possess current Basic Cardiac Life Support (CPR) certification issued by a national or local organization recognized by the Division as providing training in cardiopulmonary resuscitation at the time of application. b) A person renewing an EMT-Paramedic certificate must possess current ACLS certification at the time of application. 6.2.7 All requirements specified in 6.2.1 through 6.2.4 and 6.2.6 must be completed prior to 6CCR 1015-3 Colorado ?MS Rules 9/9P yy taking the state written certification examinations. Section 7 - Re-entry Process for Persons That Have Permitted Their Certification to Expire for a Period Greater than 6 Months but Not Greater than 36 Months 7.1 General Requirements. 7.1.1 Any person permitting their certification to expire for a period greater than six (6) months, or any person who has not successfully completed initial certification requirements within six (6) months from the date of course completion, or any person who has voluntarily dropped in level of certification may become certified by complying with Section 7 of these rules provided a) The certificate has not been expired for more than thirty-six (36) months, or b) Successful completion of the initial training course has not exceeded thirty-six (36) months. 7.1.2 Any person who, being certified at a higher level of certification, has requested and received a lower level certification will be eligible to return to their previous level of certification by meeting the provisions of this Section 7 provided their current lower level certificate is current and valid at the time of application. 7.1.3 Any person with an expired certificate greater than 36 months from the date of expiration, or any person who has not been initially certified within 36 months from the date of successful completion of an initial training course shall not be eligible for certification until such time as the person successfully completes an initial training course conducted by a recognized Training Center. 7.2 Persons meeting the criteria specified in 7.1.1 or 7.1.2 may obtain certification for EMT-B, EMT-I, or EMT-P by fulfilling the following requirements: 7.2.1 Submit an application form containing such information as deemed appropriate by the Division. 7.2.2 Provide the following reports: a) a current report, obtained from the Colorado Bureau of Investigation, local law enforcement agency, or the applicant's employer, that provides information as to whether the applicant does or does not have a past history of criminal activity, and b) a current report, obtained from the State Motor Vehicle Division, local law enforcement agency, or the applicant's employer, that provides information as to whether the applicant does or does not have a past history of motor vehicle traffic violations. c) for purposes of this section, a current report is defined as a report 6 CCR 1015-3 Col o-aao EMS Rules 9/98 12 obtained no earlier than 3 months prior to submitting application. 7.2.3 Complete the refresher training course for the appropriate level of certification. 7.2.4 Complete the initial clinical and field training requirements specified in training course policies for the appropriate level of certification. 7.2.5 Successfully complete the state practical examination as identified in training course policies for initial certification for the appropriate level of certification. 7.2.6 Possess current professional level Basic Cardiac Life Support (CPR) certification issued by a national or local organization recognized by the Division as providing training in cardiopulmonary resuscitation. 7.2.7 Successfully complete the state written examination, in accordance with the provisions of Section 9.2 of these rules. 7.2.8 In addition to 7.2.1 through 7.2.7, a person wanting to obtain certification as an EMT- Paramedic shall possess current Advanced Cardiac Life Support certification. 7.2.9 All requirements specified in paragraphs 7.2.1 through 7.2.6 and 7.2.8 must be completed prior to taking the state written examination. Section 8 - Legal Recognition for Persons Possessing out of State EMT Certification 8.1 The Division may issue an EMT-B, EMT-I, or EMT-P certificate to an applicant possessing a substantially equivalent or higher level EMT certificate from another state, United States territory, Canadian Province, or National Registry provided that: 8.1.1 the Division determines that training received by the applicant is at least equivalent to the training requirements for Colorado EMT-Certification, and provided the following requirements are met. a) the individual is eighteen (18) years of age or older and submits an application form containing such information as deemed appropriate by the Division. b) the applicant provides the Division with the following reports: 1) a current report, obtained from the state or local law enforcement agency in which the applicant is currently certified or, in the case of National Registry certification, the place of last residence prior to any Colorado residency, that provides information as to whether the applicant does or does not have a past history of criminal activity; and 2) a current report, obtained from the State Motor Vehicle Division or local law enforcement agency in which the applicant 6 CCR 1015-3 Colorado EMS Rules 9/9B 13 is currently certified, or, in the case of National Registry Certification, the place of last residence prior to any Colorado residency, that provides information as to whether the applicant does or does not have a past history of motor vehicle traffic violations. 3) for purposes of this section, a current report is defined as a report obtained no earlier than 3 months prior to submitting application. c) the applicant's non-Colorado certification is current and valid at the time of application. d) the applicant possesses current professional level basic cardiac life support certification (CPR) issued by a national or local organization recognized by the Division as providing training in cardiopulmonary resuscitation. e) the Division receives written verification from the non-Colorado certifying authority that the applicant's non-Colorado certification is current, valid and in good standing; and f) within 6 months from the date of notification of eligibility by the Division, successfully completes the state skills evaluation and state written examination as specified in section 9 of these rules. g) In addition, persons wanting to obtain certification as an EMT- Paramedic must possess current Advanced Cardiac Life Support certification. 8.1.3 Any certificate issued under these provisions will be classified as a transfer of the out- of-state certification and will be valid for 36 months from the date of successful completion of the state written examination. 8.2 The department may enter into agreements with other states that may allow a direct transfer of certification provided that: 8.2.1 the applicant submits an application form containing such information as deemed appropriate by the Division; and 8.2.2 the Division determines that the training received by the applicant and the certification and recertification requirements performed by the certifying agency are at least equivalent to the requirements for Colorado EMT-Certification; and 8.2.3 the applicant must be at least 18 years of age at the time of application. 8.2.4 the certificate issued by the Division will be valid for a period not to exceed thirty six (36) months or the expiration date on the out-of-state certificate, whichever comes sooner. 6 CCR1015-3 Colorado EMS Fobs 9/98 14 Section 9 - State Examinations and State Practical Skills Evaluations 9.1 State Practical Skills Evaluation Requirements. The State practical skills evaluation, provided in training course policies, will be conducted by recognized training centers or training groups after successful completion of the training course. 9.2 State Written Certification Examinations Requirements. The Division shall prepare and administer the state written certification examination. The written examination will only be administered to individuals who have successfully completed all training requirements and the State Practical Skills Evaluation Examination, if applicable, for the appropriate level of certification. Successful completion requires a minimum score of 70%. 9.2.1 Applicants will be allowed two (2) attempts to successfully complete the written examination. Applicants failing the first attempt shall have six (6) months from the date of the first examination to complete the second examination. Applicants not successfully completing the written examination after two (2) attempts will not be eligible for certification until such time as they complete the requirements specified in Section 5 of these rules. Section 10 - Denial, Suspension, Revocation, Modification, or Limitation of Certification 10.1 Denial of Certification The Department, in accordance with the Administrative Procedures Act, CRS 24-4- 101, et seq., as amended, may deny any certificate or refuse to renew a certificate to any applicant for, but not limited to, the following reasons: 10.1.1 Failure to meet requirements specified in Sections 5 or 6 of these rules pertaining to the Issuance of Certificates and the renewal of certification. 10.1.2 Any conduct as described in Section 10.2.2 pertaining to good cause for disciplinary action. 10.1.3 Any conduct by a Graduate EMT-I or Graduate EMT-P as described in Section 10.2.2 pertaining to good cause for disciplinary action. 10.1.4 Fraud, misrepresentation, or deception in applying for or securing certification, or in taking any written or practical certification examination. 10.1.5 Aiding and abetting another person in procuring EMT certification for any person who is not eligible for certification. 10.1.6 Creating a disturbance during a state practical skills evaluation or a state written 6 CCR 1015-3 Colorado EMS Rules 9/98 15 examination, or conducting themselves in a manner that disrupts other persons taking the examination or prevents the examination proctor from conducting the examination. 10.2 Revocation, Suspension, or Limitation of EMT Certification 10.2.1 Any certification issued by the Division may be suspended, summarily suspended, revoked, or limited for good cause in accordance with the Administrative Procedures Act, CRS 24-4-101 et seq., as amended. 10.2.2 Good cause for disciplinary sanctions listed in this section shall include, but not be limited to: a) Unlawful use, possessing, dispensing, administering, or distributing controlled substances. b) Conviction of, or a plea of no contest to, a felony or misdemeanor under state or federal law. c) Driving an emergency vehicle in a reckless manner, or while under the influence of alcohol or other performance altering drugs. d) Responding to or providing patient care while under the influence of alcohol or other performance altering drugs. e) Demonstrating a pattern of alcohol or other substance abuse. f) Obtaining certification or recertification by fraud, misrepresentation, deception, or subterfuge. g) Materially altering any Division certificate, or using and/or possessing any such altered certificate. h) Having a certificate or license suspended or revoked in another state while holding a Colorado EMT certificate. i) Unlawfully discriminating in the provisions of services based upon national origin, race, color, creed, religion, sex, age, physical or mental disability, sexual preference, infectious disease, or economic status. j) Representing qualifications at any level other than the person's current certification level. k) Failing to follow accepted standards of care in the management of a patient, or in response to a medical emergency. 1) Failing to administer medications or treatment in a responsible manner in accordance with the physician advisor's orders or protocols. 6 CCR 1015-3 Colorado EMS Rules 9/90 16 m) Failing to maintain confidentiality of patient information. n) Failing to provide the Division with the current place of residence, or change of name, or fails to register with the Division as an EMT-Basic with IV or EMT-Basic with Defibrillation. o) A pattern of behavior that demonstrates routine response to medical emergencies without being under the policies and procedures of the designated emergency medical response agency and providing medical care without medical direction or supervision of a physician advisor. p) Performing medical acts not authorized by the Board of Medical Examiners as defined in CCR 3-713-6. q) Failing to provide care, or discontinuing care when a duty to provide care has been established. r) Appropriating or possessing without authorization medications, supplies, equipment or personal items of a patient or employer. s) Falsifying entries or failing to make essential entries in a patient's run report or medical record. t) Falsifying entries made on the state pre-hospital care reporting form. u) Violating any state or federal rule or regulation that would jeopardize the health or safety of a patient or the public. v) Unprofessional conduct at the scene of an emergency which hinders, delays, eliminates, or deters the provisions of medical care to the patient or endangers the safety of the public. 10.3 Complaints in writing relating to the conduct of any EMT certified in this state may be made by any person or may be initiated by the Division. Upon receipt of a complaint from a person, the Division may make inquiry as to the validity of such complaint prior to initiating an investigation. If the Division determines that the complaint warrants a more extensive review, an investigation may be initiated. If the complaint does not warrant further review or the inquiry determines that the complaint is not within the regulatory jurisdiction of the Division, the Division will notify the complainant of the results of the inquiry. 10.4 In accordance with CRS 24-4-104(4), the Department may summarily suspend a certificate when the Department has reasonable grounds to believe and finds that the holder of the certificate has been guilty of deliberate and willful violations or that the public health, safety or welfare imperatively required such emergency action by the Department. Section 11 - Data and Information Collection and Record Keeping 6 CCR 1015-3 Colorado EMS Rules 9/98 17 11.1 State Prehospital Care Reporting Requirements All ambulance transport agencies shall provide the department with such data and information required to evaluate, coordinate and plan for the continued development of the emergency medical care system in the State. Such data and information shall be provided on forms supplied by the Department, or on alternate media in a form acceptable to the Department. 11.1.1 In accordance with C.R.S. 25-3.5-501, the following information is necessary to evaluate, coordinate and plan for the continued development of the emergency medical care system and shall be reported to the Division by all ambulance services as defined in CRS 25-3.5-103(3) for each emergency call. a) Agency identification as assigned by the Division. b) Date call was dispatched. c) Time, in military format, to include: 1) Time call was dispatched. 2) Time ambulance went en route to the incident scene, if applicable. 3) Time ambulance arrived at the incident scene, if applicable. 4) Time ambulance departed the incident scene, if applicable. 5) Time ambulance arrived at the receiving facility or patient care was transferred to another EMS agency, if applicable. 6) Time ambulance was available to respond to another call. d) County in which incident occurred. e) Incident location categorized by classifications specified by the Council. f) Mode of response (emergent or non-emergent) to and from the incident scene, if applicable. g) Classification of the call as "trauma" or "medical" in nature. h) If the call is designated as "trauma", the primary mechanism of injury categorized by classifications specified by the Council and the patient's initial Revised Trauma Score. In addition, if the trauma is the result of an incident involving a bicycle, motorcycle, motor vehicle or recreational vehicle, an indication, if known, of the protective equipment worn or utilized by the patient, and an indication, if known, whether the patient was the operator or passenger of the vehicle. 6 CCR 1015-3 Colorado EMS Rules 9/98 _8 i) If the call is designated as "medical", the signs, symptoms, illness or emergency categorized by classifications as specified by the Division. j) Patient age and sex. k) Number of miles patient was transported from the incident scene to the receiving facility or point of transfer to another EMS agency. 1) Receiving facility or agency identification number assigned by the Division. m) Any special codes assigned by the division to identify the classes of patients or specific procedures performed in the field. n) Five-digit ZIP code of the patient's residence, if known. Patients residing outside the United States, or others without a residence will be designated by a five-digit code assigned by the Division. o) The outcome of the call categorized by classifications specified by the Council. p) An indication of the highest level of training, certification or licensure of the medical personnel providing care from the reporting agency. 11.1.2 All ambulance transport agencies providing this information on data-collection forms supplied by the state shall deliver a copy of the form to the receiving facility with the patient, or include the state-assigned ambulance trip report number from the data- collection form on the patient encounter record delivered with the patient. Ambulance transport agencies providing this information on alternate media shall deliver a copy of the patient encounter record including the state-assigned ambulance trip report number, or its equivalent, to the receiving facility. 11.1.3 A licensed ambulance service must provide the information specified in Section 11.1.1 for that agency to be eligible for State monies distributed through the EMS Provider Grant Program pursuant to the provisions of C.R.S. 25-3.5-601, as amended. Section 12 - Minimum Equipment to Be Carried on an Ambulance In accordance with 25-3.5-301, the Council, in consultation with the Department, has developed the following list of minimum equipment required to be carried on a licensed ambulance. 12.1 Basic Life Support Ambulance 12.1.1 Ventilation and airway equipment a) Portable suction unit with wide bore tubing, rigid pharyngeal curved suction tip, and soft catheter suction tip to include pediatric sizes 5 Fr. through 14 Fr. 6 CCR1015-3 Colorado EMS Rules 9/98 19 b) Bulb syringe. c) Portable and fixed oxygen equipment to include; house oxygen, oxygen bottles with variable flow regulators. d) Oxygen masks and cannula capable of delivering high and low flow O2 to adults and infants. e) Hand Operated Bag-Valve masks with reservoirs to include the following sizes: 1) 500 cc bag with newborn, infant and child masks. 2) 1000 cc bag with adult mask. All mask attachments must be 15 ml. f) Nasopharyngeal airways in adult and pediatric sizes. g) Oropharyngeal airways in adult and pediatric sizes 1 through 9. h) Bite sticks or equivalent. 12.1.2 Circulatory Support Equipment. a) Blood pressure cuffs to include large adult, regular and pediatric sizes. b) Stethoscope. 12.1.3 Splinting Equipment. a) Lower extremity traction splint. b) Upper and lower extremity splints. c) Long board, scoop, vacuum mattress or equivalent with appropriate accessories to immobilize patient from head to heels. d) Short board, K.E.D or equivalent, with ability to immobilize patient from head to pelvis. e) Pediatric spine board or adult spine board that can be adapted for pediatric use. f) Adult and pediatric head immobilization equipment. g) Adult and pediatric cervical spine immobilization equipment per physician advisor protocol. 6 COR 1015-3 Colorado EMS Rules 9/98 20 12.1.4 Dressing Materials. a) Bandages - Various types and sizes per agency needs and physician advisor protocol. b) Dressings, various sizes per agency requirements and needs. c) Burn sheets. d) Adhesive tape per agency requirements and needs. 12.1.5 Obstetrical supplies. a) Sterile OB Kit to include: Towels, 4x4 dressing, umbilical tape or cord clamps, scissors, bulb syringe, sterile gloves, and blanket. b) Silver Swadler and Stocking cap or equivalent. 12.1.6 Miscellaneous Equipment. a) Heavy bandage scissors, shears or equivalent capable of cutting clothing, belts, boots, etc. b) Flashlight, either rechargeable or with spare batteries and bulb. c) Space and/or thermal absorbent blankets and appropriate heat source for ambulance compartment. d) Non-sterile disposable gloves. e) Protective eye wear. f) Non-sterile surgical masks. g) Safety protection gear for extrication per agency requirements and needs. h) Warning reflectors. i) Two (2) 2.5 lb. ABC fire extinguishers, one accessible from inside the patient compartment, one accessible from the vehicle cab or exterior. 12.1.7 Radio Equipment - Two-way radio communications that will enable the ambulance personnel to communicate with the dispatch agency, medical control facility or physician, and receiving facility. 12.1.8 Extrication equipment - Each ambulance should carry extrication equipment appropriate for the level of extrication the service agency provides and in accordance 6 CCR 1015-3 Colorado EMS Rules 9/98 31 with requirements established by the county in which the ambulance is licensed. 12.2 Basic Life Support with Intravenous (IV) capability. 12.2.1 All equipment listed in 12.1. 12.2.2 Adult and pediatric intravenous solutions and equipment per physician advisor protocol. 12.2.3 Arm boards for pediatric IV use. 12.3 Advanced Life Support - Intermediate 12.3.1 All equipment listed in 12.1 and 12.2. 12.3.2 Adult and pediatric endotracheal intubation equipment per physician protocol. Pediatric sizes for endotracheal tubes uncuffed range from 2.5 - 5.5, and cuffed range from 5.0 - 8.0. Laryngoscope blades, straight and/or curved, of sizes 0 - 3. 12.3.3 Monitor/defibrillator with tape write out and adult EKG electrodes and paddles. For a manual model monitor/defibrillator you must have pediatric EKG electrodes and paddles or paddle adapters within one (1)year from the date of enactment of these rules., and the capability to dial down to appropriate watt/seconds for pediatrics within five (5) years from enactment of these rules. 12.3.4 Pharmacologic agents per physician advisor protocol. 12.3.5 Pediatric equipment and drug dosage tape or age/weight chart. 12.4 Advanced Life Support- Paramedic 12.4.1 All equipment listed in 12.1, 12.2 and 12.3 and other equipment and pharmacologic agents per physician advisor protocols. 6 CCR 1015-3 Colorado EMS Rules 9/98 22 Rules Defining the Duties and Responsibilities of Emergency Medical Services Physician Advisors and The Authorized Medical Acts of Emergency Medical Technicians 3-CCR-713-6 Section 1 - Purpose And Authority For Establishing Rules 1.1 The purpose of these rules is to define the duties and responsibilities of physician advisors to emergency medical care service agencies and to define the authorized medical acts of Initial Responders (IRS) and Emergency Medical Technicians (EMTs). 1.2 The general authority for the promulgation of these rules is set forth in Section 12-36-104 and Section 25-3.5-203, C.R.S. 1.3 These rules apply to and are controlling for any physician functioning as a physician advisor to an emergency medical services organization and who authorizes and directs the performance of medical acts by IRs and EMTs at all levels of certification in the State of Colorado. Section 2 - Definitions 2.1 All definitions which appear in Section 25-3.5-103, C.R.S., shall apply to these rules. 2.2 "Automated external defibrillation(AED)" - use of an automatic or semi-automatic external defibrillator that has an ECG rhythm analysis system and is capable of recording both ECG and voice. 2.3 "Board" - The Colorado State Board of Medical Examiners. 2.4 "Division" - The Emergency Medical Services and prevention Division of the Colorado Department of Public Health and Environment. 2.5 "Emergency Medical Technician-Basic (EMT-Basic)" - an individual who has a current EMT-Basic certificate issued by the Division in accordance with the Rules Pertaining to Emergency Medical Services, 5-CCR-1004 (referred to herein as the "State EMS Rules"), and is authorized to provide basic emergency medical care in accordance with these rules of the Colorado State Board of Medical Examiners. 2.6 "Emergency Medical Technician-Intermediate (EMT-Intermediate)" - an individual who has a current EMT-Intermediate certificate issued by the Division in accordance with the 3-CCR-713-6 BME Rules-"Acts Allowed)9/98 State EMS Rules and is authorized to provide limited acts of advanced emergency medical care in accordance with these rules of the Colorado State Board of Medical Examiners. 2.7 "Emergency Medical Technician-Paramedic (EMT-Paramedic)" - an individual who has a current EMT-Paramedic certificate issued by the Division in accordance with the State EMS Rules and is authorized to provide advanced emergency medical care in accordance with the rules of the Colorado State Board of Medical Examiners. 2.8 "Graduate-EMT-Intermediate" - an individual who has successfully completed a Division-approved EMT-Intermediate training course but has not yet successfully completed the certification requirements set forth in the State EMS Rules. 2.9 "Graduate EMT-Paramedic" - an individual who has successfully completed a Division-approved EMT-Paramedic training course but has not yet successfully completed the certification requirements set forth in the State EMS Rules. 2.10. "Initial Responder" - an individual who as part of their duty responds to medical emergencies and has minimum training in adult basic cardiac life support. 2.11. "Medical Base Station" -the source of direct medical communications with and supervision of the immediate field emergency care performance by IRs EMT-Basics, EMT-Intermediates, or EMT-Paramedics. 2.12. "Physician Advisor" - a physician who establishes protocols and standing orders for medical acts performed by IRs, EMT-Basics, EMT-Intermediates or EMT-Paramedics of a pre hospital emergency medical care service agency and who is specifically identified as being responsible to assure the competency of the performance of those acts by such IRs, EMT-Basics, EMT-Intermediates or EMT-Paramedics. 2.13. "Protocol"- written standards for patient medical assessment and management. 2.14 "Service Agency" - any organized agency including but not limited to a "rescue unit" as defined in Section 25-3.5-103(11), C.R.S., using IRs, EMT-Basics, EMT-Intermediates or EMT-Paramedics to render initial emergency medical care to a patient prior to or during transport to a hospital or emergency care clinic. 2.15. "Standing Order" - written authorization by a physician advisor for the performance of specific medical acts by IRs, EMT-Basics, EMT-Intermediates or EMT-Paramedics prior to their establishing communications with the supervising medical base station, or in the event of communications malfunctions with the medical base station. Section 3 - Qualifications and Responsibilities of Physician Advisors 3-CCR-713-6 BME Rules-"Acts Allowed)9/98 2 3.1 A physician advisor shall possess the following minimum qualifications: a) be a physician currently licensed to practice medicine in the State of Colorado; b) be actively involved in the provision of emergency medical services in the community served by the service agency being advised; c) be actively involved on a regular basis with the service agency being advised. d) be trained in Advanced Cardiac Life Support according to the standards of the American Heart Association. 3.2 The responsibilities of a physician advisor shall include: a) Notifying the Board of the service agencies for which medical control functions are being provided and notifying the Division of the individuals being supervised. b) Establishing a medical quality control program for each service agency being advised which assures the continuing competency of the performance of that agency's IRs, EMT-Basics, EMT-Intermediates or EMT-Paramedics. This quality control program shall include, but not necessarily be limited to, appropriate protocols and standing orders, and provision for medical care audits, observation, critiques, continuing medical education and direct supervisory communications. c) Submitting to the Division the medical quality control program for a service agency's IRs, EMT-Basics, EMT-Intermediates or EMT-Paramedics. The Division shall evaluate the medical quality control program and forward it, along with a written evaluation, to the Board for final approval. 3.3 The physician advisor shall provide monitoring and supervision of the medical field performance of each advised service agency's IRs, EMT-Basics, EMT-Intermediates or EMT-Paramedics. This responsibility may be delegated to other physicians or other qualified health care professionals designated by the physician advisor. However, the physician advisor shall retain ultimate authority and responsibility for the monitoring and supervision, for establishing protocols and standing orders and for the competency of the performance of authorized medical acts. 3.4 The physician advisor shall ensure that each verbal order, written standing order or protocol is appropriate for the certification and skill level of each of the individuals to whom the performance of medical acts is delegated and authorized. The physician advisor shall be familiar with the training, knowledge and competence of each of the individuals to whom the performance of such procedures is delegated. 3.5 The physician advisor shall be accountable to the Board for all actions in the authorization 3-CCR-713-6 BME Rules-"Acts Allowed)9/98 3 and delegation of medical acts, procedures, medical quality control program or use of standing orders and established protocols which fail to meet generally accepted standards of medical care. 3.6 The responsibilities of the physician advisor in the authorization, direction, monitoring and supervision of IRs and EMT-Basics who perform automated external defibrillation (AED) shall include the following: a) The physician advisor of any IR and EMT-Basics who perform AED shall be able to demonstrate the use of the AED device for said IRs and EMT-Basics. b) The physician advisor shall authorize IRs and EMT-Basics to perform AED only after the IRs and EMT-Basics have successfully completed an AED training course approved by the Division and the IRs and EMT-Basics have demonstrated for the physician advisor proficiency and skill in the performance of AED. c) The physician advisor authorizing IRs and EMT-Basics to perform AED shall authorize only the use of automated external defibrillators that are equipped with voice and ECG recording capabilities and accessories in order to assure adequate direction and supervision of IRs and EMT-Basics in the use of the AED device and compliance with the medical quality control program required by these rules. d) No less than sixty days prior to authorizing any IR or EMT-Basics to perform AED, the physician advisor shall submit to the Division the following: i) a form approved by the Board for registration of an AED program; and ii) a medical quality control program, to be approved by the Board, which shall include, but not necessarily be limited to: provision for mandatory audit of each use of the AED device, within ninety days of said use, by the physician advisor or his designee with the IRs or EMT-Basics involved in said use; provision for identification and correction of deficiencies in the performance of AED by the IRs and EMT-Basics; and provision for ensuring through standing orders and protocols that the IRs and EMT-Basics authorized to perform AED maintain proficiency and skills in the performance of AED and basic life support by continuing education and practice no less than thirty days following initial training and ninety days thereafter. e) Within ninety days of each use of the AED device by an IR or EMT-Basic, the physician advisor or his designee shall submit to the Division the following records, which may have the patient name deleted ad identified by a numbered code, to be retained by the custodian of he records: 3-CCR-713-6 BME Rules-"Acts Allowed)9/98 4 i) a copy of the EMS Division AED Reporting Form completed by the IR(s) or EMT-Basic(s) who performed AED and signed by the physician advisor; ii) a copy of the pre-hospital care encounter form for the patient contact and use of the AED device; and iii) a copy of any electronic media recorded by the AED device for the patient contact. 3.7 The physician advisor shall notify the Board and the Division within fourteen days of his or her termination as physician advisor pursuant to these rules. 3.8 The physician advisor shall notify the Division within fourteen days of his or her termination of the supervision of an EMT-Basic, EMT-Intermediate, or EMT-Paramedic that may constitute good cause for disciplinary sanctions pursuant to Section 8.1 of the EMS Rules. Such notification shall be in writing and shall include a statement of the actions or omissions resulting in termination of supervision and copies of all pertinent records. Section 4 - Medical Acts Allowed 4.1 An Emergency Medical Technician-Basic may perform non-invasive emergency medical acts consistent with the course of training approved by the Division for EMT Basic certification. Effective April 1, 1992, an EMT-Basic who is a member or employee of a service agency and who performs said emergency medical acts must have the authorization of a physician advisor to perform said emergency medical acts. 4.2 An EMT-Basic may, in addition to the acts allowed in Section 4.1, inflate pneumatic anti-shock (MAST) trousers, establish an intravenous line to keep the vein open for fluid volume replacement or for dextrose administration, and use an automated external defibrillator to perform cardiac defibrillation, provided that the EMT-Basic has successfully completed a Division-approved training course in these medical acts, performs these acts under authorization from a physician advisor, in accordance with the provisions of Section 3, and is registered with the Division. 4.3 In addition to the acts an EMT-Basic is allowed to perform pursuant to these rules, an EMT-Intermediate may, under the authorization of a physician advisor, perform emergency medical acts consistent with the course of training approved by the Division for EMT-Intermediate certification. 4.4 An EMT-Intermediate may, in addition to the acts allowed in Section 4.3, administer drugs specified and approved by the Division with the concurrence of the Board. Such drugs may be administered only under the direct verbal authorization of a physician including by radio, in accordance with the provisions of Section 3. The Board may, upon 3-CCR-713-6 BME Rules-"Acts Allowed)9/98 5 request of the physician advisor, grant a waiver to allow standing orders to be implemented for specific EMT-Intermediates in specific circumstances provided that on-going quality assurance of each EMT-Intermediate's use of standing orders is maintained by the physician advisor. 4.5 In addition to the acts an EMT-Basic is allowed to perform pursuant to these rules, an EMT-Paramedic may, under the authorization of a physician advisor, perform advanced emergency medical care acts consistent with the course of training approved by the Division for EMT-Paramedic certification and, with appropriate training: a) administer drugs authorized in written standing orders or protocols by the physician advisor, and b) perform other emergency life-saving invasive procedures authorized in written standing orders or protocols by the physician advisor. c) carry out a physician order for a mental health hold as set forth in Section 27-10-105(1), C.R.S. Such physician order may be verbal or by telephone, radio or any other electronic means. 4.6 An EMT-Basic may, in addition to the acts allowed in Section 4.1 and 4.2, administer activated charcoal, oral glucose, and chewable baby aspirin, and assist patients in taking their prescriptions for the Epinephrine auto-injector, Nitroglycerin and meter dosed inhalers, provided the EMT-Basic has successfully completed a Division approved training course in these medical acts, performs these acts only under the direct verbal authorization of a physician including by radio, in accordance with the provisions of Section 3. Section 5 - Graduate and Out-of-state Applicants for Certification 5.1 Physician advisors may supervise graduate EMT-Intermediates and EMT-Paramedics for a period of no more than six months following successful completion of an appropriate Division-approved training course. Graduate EMT-Intermediates and EMT-Paramedics must successfully complete certification requirements, as specified in the State EMS Rules, within six months of the successful completion of a training course to continue to function under the provisions of these rules. 5.2 A person certified as an EMT-Basic, EMT-Intermediate or EMT-Paramedic by another state may, with the authorization of a physician advisor, function as an EMT-Basic, EMT-Intermediate or EMT-Paramedic, only after approval of the EMS Division and only for a period of six months. I understand that the authorization for the establishment of the fire protection district originated with the Board of Commissioners. I am specifically in- terested in obtaining a copy of the enabling legislation that required the formation of fire protection districts statewide, the specific county "order" creating the Kersey Fire Protec- tion District, and any and all rules regarding operation of such districts (duties and respon- sibilities, liabilities, etc.) that may be in Weld County Statutes or Colorado Revised Statutes. I understand that this could potentially require some extensive research and repro- duction time, for which I would be willing to consider defraying some of the expense, if necessary. As a taxpayer, I would hope that these expenses could be kept to a minimum, and, in fact, if need be, could you possibly simply refer me to the appropriate places where I might research these items myself, to reduce the cost to the county? I have been approached about becoming a candidate for the Kersey fire Protec- tion District, and, while I am not admitting to being a candidate at this point, I do feel the need to understand as much as I can about the KFPD as possible, before I make any de- cision. That having been said, I am starting from zero in my attempt to understand any and all issues that might confront such a fire protection distrct board member. In the event that I would not become a candidate, I would hope to enrich my own understanding of our local fire department/rescue squad to be in better position to assist them, now and in the future. I think a reading of the information I am requesting would be very helpful, in that regard. I am additionally interested in why it has taken so long for KFPD to retain the serv- ices of a "supervisory physician" so as to enable their paramedic function to operate at full potential. I understand there is some reluctance in the community of physicians in our area (Greeley proper), to become associated with KFPD. I find it somewhat more than cu- rious that most, if not all, other communities in Weld County don't seem to have this prob- lem, and that virtually all parties concerned seem to be taking a "hands-off" attitude, with the exception of the Kersey volunteer fire fighters. That this situation has continued for a period of some years now, there would seem to be some failure of oversight responsibili- ties of some authority higher up than KFPD, maybe not I don't know enough about the issue currently to make an accurate analysis of it. However, as a resident of Weld County, and the KFPD area specifically, I am concerned, and interested in what could be done to facilitate a positive, expeditious, and satisfactory conclusion (to all parties concerned) to this matter. This could only serve the best interests of the community as a whole, and as such, should be accomplished sooner rather than later.
