RESOLUTION RE: APPROVE BYLAWS FOR THE WELD COUNTY FAMILIES, YOUTH AND CHILDREN (FYC) COMMISSION AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with proposed Bylaws for the Weld County Families, Youth and Children (FYC) Commission, on behalf of the Department of Social Services, and WHEREAS, after review, the Board deems it advisable to approve said bylaws, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, ex-officio Board of Social Services, that the proposed Bylaws for the Weld County Families, Youth and Children (FYC) Commission be, and hereby are, approved. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 11th day of May, A.D., 1998. RE: Bylaws of the Weld County Families, Youth and Children (1{ (FYC) Commission under the Weld County Department of Social Services Enclosed for Board approval are the Bylaws of the Weld County Families, Youth and Children (FYC) Commission under the Weld County Department of Social Services. The Weld County Attorney reviewed these Bylaws for Board approval. The FYC Commission will replace the Weld County Placement Alternatives Commission. If you have any questions, please telephone me at extension 6200. 980802 BYLAWS WELD COUNTY FAMILIES. YOUTH AND CHILDREN(FYC) COMMISSION Article I -Name of Commission The Conunission shall be called the"Weld County Families, Youth and Children Commission" (hereinafter referred to as "the FYC"). Article II - Functions of the FYC The functions and duties of the FYC are to: Function as the "placement alternatives commission" for Weld County, as referred to in C.R.S. § 19-1-116 (2)(a), and prepare the plans required by C.R.S. § 19-1-116 (2)(b). Review and advise the Board of County Commissioners of Weld County regarding the following: 1) The local plan for Expedited Permanency Planning between Weld County and the 19th Judicial District. 2) Weld County's compliance with the Child Welfare Settlement Agreement between the Colorado Department of Human Services and the Colorado Lawyers Committee. 3) Weld County's compliance with the out-of-home placement allocations and associated requirements of C.R.S. §§ 26-5-101, et. seq. 4) Weld County's Family Preservation Program with Core Services and Family Support Program. 5) The effectiveness of programs within Weld County designed to prevent or reduce placement. Function as the"family preservation commission" for Weld County, as referred to in C.R.S. § 26-5.5-106 (1), and comply with the review and reporting requirements of C.R.S. § 26-5.5-106 (2). Page 1 of 5 Pages ��S1fSGc? Article III -Membership of FYC A. Membership-The FYC shall consist of sixteen(16)members. The membership shall include: (1) A physician or licensed health professional. (2) An attorney. (3) A representative of a local law enforcement agency. (4) A representative of the probation department. (5) A representative of the Juvenile Court or District Court of the 19th Judicial District. (6) A representative from a local mental health clinic. (7) A representative of a local school district specializing in special education. (8) A foster parent. (9) A representative specializing in occupational training or employment programs. (10) A representative of a local substance abuse program. (11) A representative from the "SB-94 Committee" for Weld County. (12) A representative from the "Child Protection Team" for Weld County. (13) An accountant from the lay community. (14) A parent from the lay community. (15) A clinic nurse from the lay community. (16) A representative from a local foundation. No members may be employed by or otherwise associated with a provider of out-of-home placement services. The membership may include one or more representatives of the lay community. At least fifty percent of the FYC members shall represent the private sector. B. Appointment of Members - The members of the FYC shall be appointed by the Board of County Commissioners of Weld County, according to the following procedure: Page 2 of 5 Pages (-1 vsoa (1) Persons interested in serving on the FYC shall submit an application that will provide biographical information. (2) A Nominating Committee,consisting of the FYC Executive Committee members and the Board of County Commissioners' Coordinator for the Weld County Department of Social Services, shall review each application and establish a list of nominee(s) for vacancies and reappointments for consideration by the FYC. (3) The FYC shall review and consider the list for recommendation to the Board of County Commissioners. (4) The Board of County Commissioners shall review the list of nominee(s) and may interview such nominee(s) according to the Board's desires. The Board, in its sole discretion,may appoint members to fill vacancies or reappoint members for additional terms. C. Terms of Members - Regular membership terms of the FYC shall be for three (3) years. No member may serve for more than two (2) consecutive terms. New FYC members may be assigned first terms of less than three (3) years to assure appropriate staggering of members' terms. D. PAC Membership on Date of Approval of Bylaws - Members of the former Weld County Placement Alternatives Commission ("PAC") as of the date of the approval of these Bylaws shall automatically become members of the FYC for the length of their current terms on the PAC and shall be subject to the two (2) term limit set forth in Section III., C., above. Members of the former PAC, who are considered to be "Providers," as that term is defined in Section III., A., above, shall not be eligible for a second term once their current term has ended. Article IV - Officers A. The FYC shall elect from its own members a Chair and Vice-Chair. Term of office shall be for one year. B. In the absence of the Chair, the Vice-Chair will act in that capacity. C. In the absence of the Chair and the Vice-Chair,a temporary Chair will be selected by the FYC. D. A secretary shall be appointed by the FYC Chair. Page 3 of 5 Pages Article V -Nomination and Election of Officers The nomination and election of annual officers shall be held during the first regular meeting of each calendar year. Each nomination shall be seconded to be placed on the ballot, and elections shall be written ballot unless there is no contest for the office. Article VI - Meetings A. Regular meetings of the FYC will be conducted quarterly on days agreeable to the membership, provided there is business to conduct. B. Written notice of all regular meetings shall be mailed to each member at least seven (7) days prior to each regular meeting date. C. Special meetings may be called when deemed necessary by the Chair. D. A quorum shall consist of not less than nine (9) members of the FYC. A quorum shall be necessary at any meeting in order to conduct business. E. The concurring vote of a majority of those present shall be required to pass any motion made. F. Robert's Rules of Order shall prevail to the extent they are not in conflict with specific provisions of these Bylaws. Article VII - Duties of Chair It shall be the responsibility of the Chair to call all special meetings, preside at all meetings, and carry out general Chair responsibilities. Article VIII -Duties of Vice-Chair It shall be the responsibility of the Vice-Chair to assume the duties of the Chair in his absence. Also, he shall perform other duties assigned by the Chair. Article IX - Duties of Secretary It shall be the responsibility of the secretary to send members notices of all meetings of the FYC and to keep minutes, or to arrange for the keeping of minutes, of all meetings. Page 4 of 5 Pages Article X - Standing Committees There shall exist at least five (5) standing committees of the FYC, including the Executive, Nominating,Program Effectiveness and Outcomes,Family Support,and Collaboration and Innovation Committees. The Nominations Committee shall have the membership, duties and responsibilities listed in Sebtion III., B., (2), above. The remaining Committees shall have the membership, duties and responsibilities which are listed on the attached Exhibits "A-D." The Chair of the FYC may appoint such other committees as are deemed necessary. Article VI -Amendment of Bylaws These Bylaws may be amended according to the following procedure: 1. The proposed amendments to the Bylaws may be presented at any meeting of the FYC at which a quorum is present, provided seven(7) days notice has been given to each member. 2. For passage, such proposed amendments must receive the vote of the majority of the entire membership of the FYC. Article VII - Disputes Disputes between Social Services and the FYC shall be resolved as expeditiously as possible either by concurrence between the two entities or by intervention by the Governing Board of County Commissioners. Article VIII - Confidentiality Members of the FYC may, by virtue of such membership, inspect or be privy to records and other materials containing personally identifying information maintained by the Weld County Department Social Services. Members shall protect the confidentiality of such records and other materials. Except as provided by law, no information in possession of a member of the FYC about any individual client shall be disclosed in a form including identifying information.
