The City of Greeley Planning Commission reviewed this proposal at their regularly scheduled February 10, 1998 meeting. The Commission unanimously recommended denial for the proposed subdivision for several reasons, including: 1. Density - This proposal is located approximately one mile north of our Long- Range Expected Growth Area (LREGA), and, from the City's perspective, should continue to have a rural density. Greeley's Planning Commission has determined that residential density outside of our LREGA should not exceed 1 unit for every 20 acres. The current proposal, combined with the two previous recorded exemptions and the subdivision exemption would create a total of 8 lots and a density of 1 unit for every 8 acres on this site. 2. Regional Plan - The recently adopted Northern Colorado Regional Planning Study identifies this area as a community separator, which should be maintained as open space. This allows for communities to maintain a sense of place and provides a clear line of demarcation between communities. The Study also discusses the importance of regional corridors which go through the region, such as the Poudre River Trail and the Greeley #2 Ditch. The subject property and the area around it combine the community separator and the regional corridor to form a critical regional linkage (See Attached). Regional linkages offer the opportunity to maximize the benefits of the separators and corridors. Service Area - The location of a subdivision in an area far removed from public services which does not conform to City Standards, such as the one proposed, is not appropriate. County developments such as these are hard to incorporate into the framework of a municipality in the future. Service issues, particularly relating to police and fire service are difficult when annexation is proposed. 4. Right to Farm Covenant - This site is approximately 3/4 miles from a proposed significant dairy expansion at the intersection of WCR 66 and WCR 27. The dairy was recently approved to expand. Land use conflicts will likely arise when residences are approved in the vicinity. Encroaching residential uses, such as the proposed, are likely to be negatively impacted by the dairy. The right-to-farm covenant suggests this use should not be approved in this location as well, since, according to the covenant, this use is an, "intrusion of urban users into a rural area." 5. Oil and Gas Develonment - The proposed site plan shows a 100-foot setback from the wellhead, but no setback is proposed from the tank battery and beater treater. To keep people and their possessions safe, a 350-foot setback from all appurtenances to habitable structures should be in place. This setback would still afford ample room to construct a single-family residence on all proposed lots. In addition, adding fencing around the appurtenances would be useful as well. • Eased on the above comments, the City of Greeley recommends the 5-lot subdivision be denied. If, however, the County decides to approve this subdivision, the following conditions should be employed: 1. A 350-foot setback from the wellhead, tank battery, and heater treater shall be retained for the safety of residents in the subdivision. 2. The developer shall be responsible for fencing the oil and gas appurtenances. 3. The applicant has submitted a drainage report by McRae and Short. This has been stamped and signed by a professional engineer. The additional emergency access road from the cul-de-sac to WCR 23.75 has been designated and placed on the plat as per the Windsor/Severance Fire Protection District request. REQUIREMENTS: The applicant is requesting that the minor subdivision internal road system, (Hillcrest Drive) 1120 feet long, be accepted for full maintenance by Weld County as it will be built to county standards. This section of road will have a gravel surface with a width of 18 feet and four inches of Class 6 road base with adequate drainage on both sides. The off road access to this hydrant will be designed to meet Fire District requirements. Although this agreement does not meet the initial requirements of the Fire District it is understood that the availability of water in this area is limited by the resources of the Water District.
