Dear Commissioners:
Enclosed, please find information pertaining to a petition for annexation which is located
north of 10th Street, and west of 59th Avenue. This 1.219 acre annexation will be
considered by the City of Greeley Planning Commission on October 27, 1998, and the
City Council on November 15, 1998, where the ordinance will be introduced and the
public hearing will be on December 1, 1998. The applicants have indicated the existing
commercial retail use will be retained and continued on-site.

INTENDED/PROPOSED USES Mr. Danford has stated the intention of
maintaining the existing commercial retail
establishment.
COMPREHENSIVE PLAN The site lies within the City's Mid-Range
Expected Service Area, within the boundaries of
the Long-Range Expected Growth Area, and
adjacent to the Municipal Services Suitability
Area.
Generally speaking, the existing land uses are
compatible with existing surrounding land uses
both within City limits and in unincorporated
Weld County.
Under the Land Compatibility section of the
Comprehensive Plan, the site has slopes
between 3% - 15%.
Access to the site is currently possible from two
access points onto 59th Avenue. As part of the
proposed annexation agreement, the applicants
have indicated a willingness to close off the
northern access point with landscaping and a
berm. 59th Avenue is designated as a major
arterial street.

ANALYSIS The site consists of 1.219 acres, and is located
north of 10th Street, and west of 59th Avenue
east of existing city limits.
The site is fully within the City's Long-Range
Expected Growth Area and Mid-Range
Expected Service Area, and immediately
adjacent to the City's Municipal Services
Suitability Area.
Within City limits immediately to the east of
this site is a vacant parcel which is zoned C-H
(Commercial High Intensity). To the south is
existing retail establishments in the County
which are victims of the highway expansion.
Two single-family residential lots within the
County exist to the north.
The land use envisioned by the applicant for this
site is the continuation of the existing
commercial retail establishment, which appears
to be consistent with City of Greeley
Comprehensive Plan policies, since the site is
near the intersection of two arterial streets.
The annexation of this site into the city would
be consistent with present growth patterns and
Comprehensive Plan policies. There is clear
evidence that this site shares a common interest
with the City's future. The requirements of
State statutes and City of Greeley guidelines for
annexation appear to have been met by this
requested annexation.

6. There are no residents of the territory proposed for annexation who are not land owners.
7. Description of intended use and Development of Property Proposed for Annexation
The property proposed for annexation has been developed within Weld County for
commercial retail usage. The present uses on the property include a retail golf and tennis store
and a wholesale flooring company. The size of the retail golf and tennis store is approximately
3,000 square feet. The size of the wholesale flooring store is approximately 6,000 square feet.
The site is immediately west of 59th Avenue. There is one entrance off of 59th Avenue to the
site. Onsite detention has been designed to meet City standards for storm water detention. It is
the applicant's belief no school students will be generated by the site and there are no dwelling
units located on the site. The site will be served by City water and sewer. All other utilities have
been provided to the site. It is the applicants belief the 30 parking spaces provided will
accommodate the intended use of the site. Upon installation of a water line to the site, the
applicant will complete landscaping of the site as agreed with Staff. Because of the time of year,
it may not be possible for landscaping to be completed in the Fall of 1998 but the applicant would
complete the landscaping by May of 1999.
10. Except as otherwise provided, no part of the territory sought to be annexed is more
than three miles from a point on the municipal boundary, as such was established
more than one year before this annexation will become effective.
11. As an expressed condition of annexation, land owner(s) consent(s) to inclusion into
the Northern Colorado Water Conservancy District and the municipal subdistrict
pursuant to Section 37-45-136 (3.6) C.R.S. Land owne (s) acknowledge(s) that,
upon inclusion into the district and subdistrict, land owner's(s') property will be
subject to the same mill levies and special assessments as are levied or will be
levied on other similarly situated property in the district and subdistrict at the time
of inclusion of land owner's(s) lands. Land owner(s) agree(s) to waive any right
to an election which may exist to require an election pursuant to Article X, Section
20, of the Colorado Constitution before the district and subdistrict can impose such
mill levies and special assessments as it has the authority to impose. Land owner(s)
also agree(s) to waive, upon inclusion, any right which may exist to a refund
pursuant to Article X, Section 20, of the Colorado Constitution.
THEREFORE, the undersigned respectfully petition(s) the City Council of the City of
Greeley, to annex the territory described and referred to in Exhibit A to the City of
Greeley in accordance with and pursuant to the statutes of the State of Colorado.
