Home My WebLink About980461.tiff )911 RESOLUTION RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL, LITTLE THOMPSON VALLEY ESTATES - MCCARTY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated June 18, 1997, the Board did approve an Improvements Agreement with Little Thompson Valley Estates, % Kevin and Dina McCarty, concerning property described as part of the E'/ of the SE% of Section 21, Township 4 North, Range 68 West of the 6th P.M., Weld County, Colorado, and WHEREAS, pursuant to said improvements agreement, Irrevocable Letter of Credit, #122 with the Pioneer Bank of Longmont, 1610 Hover Street, Longmont, Colorado 80501, in the amount of$62,039, was submitted to Weld County, and WHEREAS, upon recommendation of Departments of Planning Services and Engineering, the Board deems it advisable to release said collateral minus 15% retainage in the amount of $4,848 to be held for six months for repairs if needed. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Irrevocable Letter of Credit#122 with the Pioneer Bank of Longmont, 1610 Hover Street, Longmont, Colorado 80501, in the amount of$57,191, be, and hereby is, released. BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is, directed to return said collateral to the appropriate issuing party. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 23rd day of March, A.D., 1998. ' ._ SUBJECT: Release of Collateral, S-415 Little Thompson Valley Estates DATE: March 20, 1998 The Board of County Commissioners approved a resolution on April 9, 1997, for improvements agreement according to policy regarding collateral for improvements and accept collateral, for Little Thompson Valley Estates, located in part of the E2 of the SE4 of Section 21, T4N, R68W of the 6th P.M., Weld County, Colorado. The amount of collateral is $62,039.00. Staff is requesting that the Board of County Commissioners releaseall of the above collateral minus a 15% paving cost to be held for one year for repairs if needed. The amount held shall total $4,848.00. The Department of Public Works will at the request of the applicant reinspect the asphalt in October of 1998 to ensure that no pavement repairs are required and to determine if the remaining 15% collateral being retained can be released. My field verifications consisted of two days, October 17 and October 22, 1997. Please refer to Exhibit A-1 and Exhibit A-2 for verification and completion of Items which were field verified. As is typical with our Road Improvements Agreement, 15% of the asphalt item shall be held for a period of one year.
