RE: SITE SPECIFIC DEVELOPMENT PLAN AND MAJOR SUBDIVISION FINAL PLAT, S #414,
FOR BUFFALO RIDGE ESTATES - MARTIN
A public hearing was conducted on January 29, 1997, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated December 18, 1996, and duly published January 16,
1997, in the South Weld Sun, a public hearing was conducted to consider the request of John T.
and James I. Martin, Martin Brothers Partnership, for a Site Specific Development Plan and Major
Subdivision Final Plat for Buffalo Ridge Estates. Lee Morrison, Assistant County Attorney, made
this a matter of record. Gloria Dunn, Department of Planning Services representative, presented
a brief summary of the proposal indicating the Subdivision is in the E (Estate) Zone District and will
consist of 52 lots, with Tract A being open space and Tract B being an easement for the Speer
Canal. She stated the Subdivision will be developed in seven phases, the wells will be
interconnected, and individual sewage disposal systems will be installed with some requiring
engineered designs. Ms. Dunn stated two accesses will be allowed from Weld County Roads 35
and 10, which will be improved, and Road 10 will be extended west to Weld County Road 37
across the Speer Canal, noting all improvements are pursuant to the Improvements Agreement.
She stated eight lots will be developed in Phase 1 and recommended the common open space plan
be readdressed by the applicant. Ms. Dunn also indicated the location of an 8 -foot pedestrian and
bridle easement and recommended the addition of Condition of Approval #5.R. concerning such.
She stated school impact fees of $500.00 per lot will be assessed and discussed the letter of
concern from the surrounding property owner regarding compatibility with the existing composting
facility. Ms. Dunn also recommended the addition of Condition of Approval #5.S. indicating the
ability of the wells to draw authorized amounts of water may be less than 100 years due to
anticipated water level declines. She also noted Condition of Approval #2.F.11. should be corrected
to reference Condition of Approval #5.J., rather than #2.B. Ms. Dunn then entered the favorable
recommendation of the Planning staff into the record as written, including the recommended
addition of Conditions of Approval #5.R. and #5.S. and the correction to #2.F.II. Responding to
questions from the Board, Ms. Dunn referenced Condition of Approval #2.E. which requires the
applicants to address a permanent water supply. Mr. Morrison clarified the water supply will
operate under covenants and will qualify as a community water supply; however, it will actually be
considered a private water supply to which monitoring requirements will apply. After discussion,

Drew Scheltinga, Engineer for the Public Works Department, confirmed all Public Works
requirements have been met and the proposed agreement has been signed and submitted. He
discussed the estimated traffic impacts and stated the applicants will pay for 73 percent of paving
of Weld County Road 35 and for 60 percent of Weld County Road 10. Mr. Scheltinga also
reviewed the phasings and improvements agreement for the internal roadways. John Martin,
applicant, was present and, referencing Condition of Approval #2.E., noted the tight control which
the State has concerning water monitoring, metering, etc. Mr. Morrison discussed the pending
legislation concerning the one -percent drawdown per year on aquifers, noting wells may no longer
be assured for 100 years; therefore, a contingency plan for the future is needed because of this
current issue at the State level. Commissioner Kirkmeyer clarified the State is requiring the plan,
but the County will also review it. After further discussion, Mr. Morrison suggested the covenants
can authorize a purpose for obtaining an alternate supply in the future; thereby, assessments would
be legal for an alternate source if the wells become inadequate. Mr. Martin agreed that safety
factor should be added to the covenants and confirmed the State Engineer is requiring water
meters. Mr. Morrison confirmed he will work with the applicant regarding said language in the
covenants. No public testimony was offered concerning this matter. Commissioner Webster
moved to approve the request of John T. and James I. Martin, Martin Brothers Partnership, for a
Site Specific Development Plan and Major Subdivision Final Plat for Buffalo Ridge Estates, based
on the recommendation of the Planning staff, with the Conditions of Approval as entered into the
record, including the addition of Conditions of Approval #5.R. and #5.S. and the correction to
Condition of Approval #2.F.lI., with the language in the covenants concerning the water supply plan
to be resolved by the applicant and County Attorney staff. The motion was seconded by
Commissioner Kirkmeyer, and it carried unanimously.
This Certification was approved on the 3rd day of February, 1997.
