RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST ROSAMARIA CASTILLO WELD COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Rosamaria Castillo, VI #2188, is allegedly in violation of the Weld County
Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 12th day of September, 1995, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Rosamaria Castillo, property owner, was not present or represented at said
hearing, although all parties were notified of said hearing by Department of Planning Services staff,
and
WHEREAS, the Board deems it advisable to bring legal action against the individual as
hereinabove named to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Rosamaria Castillo to remedy the violation of the Weld County Zoning
Ordinance, and any other persons occupying the properties, any persons claiming an interest in
the properties, and any persons acting in active concert with the identified parties.

proceed with legal action against any other persons occupying the properties, any person
claiming an interest in the properties, and any persons acting in active concert with the
identified parties.

have scheduled a meeting with the Board of County Commissioners on September 12, 1995 at
10:00 a.m. to consider the Zoning Violation occurring on your property. This meeting will take
place in the County Commissioners' Hearing Room, first floor, Weld County Centennial Center,
915 Tenth Street, Greeley, Colorado. It is recommended that you or a representative be in
attendance to answer any questions the Board of County Commissioners might have about the
violation.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation, the
action necessary to correct the violation, and that you were given sufficient time to remedy the
violation. The property will be reinspected September 11, 1995.

The uses on the above described property are being considered as a zoning violation of Section 31.2,
31.2.16, 43 of the Weld County Zoning Ordinance.
This is not a use allowed by right in the Agricultural zone district.
The violation can be corrected by removing the mobile home and accumulating trash and junk from the
property, or applying for the proper permits for the mobile home.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have 30 (Thirty)
days from June I, 1995 to correct this zoning violation. Failure to do so will result in this office
scheduling the violation before the Board of County Commissioners to consider whether to refer the
violation to the County Attorney's office for legal action.

WHEREAS, the Board of County Commissioners of Weld County,
Colorado, on the 5th day of June, 1985, considered the request of
Rosa Marie Castillo for a .mobile home to be used as a principal
dwelling, and
WHEREAS, said mobile home is to be occupied in an
A -Agricultural Zone District on a parcel of land being more
particularly - described as follows:

WHEREAS, the Board of County Commissioners, having heard the
testimony, finds that said request should be granted subject to
following conditions. 1) The applicant shall apply for a
building permit for the mobile home within thirty days from the
date of approval by the Board of County Commissioners; 2) Prior to
the issuance of a building permit, the owner shall submit evidence
that sewer and water_taps have been installed on the property and
are serving the proper; 3) The mobile home shall not be occupied
until such time that t a applicant has been issued a mobile home
building permit; and 4) The mobile home shall comply with the
required setback and offset requirements listed in the Weld County
Zoning Ordinance. Should the mobile home be too large to be
properly located on the lot, the applicant shall allow for the
proper variance to the Weld County Board of Adjustment.
NOW, THEREFORE, -BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the request of Rosa
Marie Castillo for permission to place a mobile home to be used as
a principal dwelling on the above described parcel of land, which
was found to he in compliance with Section 43 of the Weld County

The mobile home was permitted on the property from September 6, 1084 until
March 6, 1985 under ZPMh-935 for temporary storage. The mobile home has been
In violation since March 6, 1985. The applicant has indicated that she
intends to move into the mobile home in the future and use the mobile home
as a -principal dwelling. The City of Greeley has indicated that it can
provide water and sewer service to the property if the appropriate tap fees
are paid.

City ordinances prohibit more than one building being served by one
water and sewer tap. Ms. Castillo should be aware she cannot hook
her rouse up to any other dwelling. She must have her own separate taps.

of the water tap.
