HomeMy WebLinkAbout982378.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST PATRICK AND SHELLY CRAIG FOR VIOLATION OF THE WELD COUNTY ZONING ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Patrick and Shelly Craig, VI #9800197, are allegedly in violation of the Weld County Zoning Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 8th day of December, 1998, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Patrick and Shelly Craig, property owners, were present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until December 8, 1999, to allow adequate time for the property owners to bring the subject property into compliance. PARCEL NUMBER: 1475 28 000007 CASE SUMMARY The complaint file set up for this case occurred when the applicant applied for a Zoning Permit for a Mobile Home (ZPMH-2110) and a Recorded Exemption (RE-2344), and it was discovered that a Use by Special Review was not on file in the Department of Planning Services for the keeping, raising and boarding of exotic animals. Mr. Craig submitted a letter to Monica Daniels-Mika stating they planned to comply with the request for a Use by Special Review, but requested the Department of Planning Services not follow up for a period of 12 months. The Board of County Commissioners voted to schedule a work session to make this determination. The decision to schedule Mr. and Mrs. Craig before the Board of County Commissioners at the violation hearings set for December 8, 1998, was made. On November 25, 1998, Sharyn Frazer, Code Compliance Officer sent a letter to Mr. and Mrs. Craig thanking them for agreeing to meet with the Board on December 8, 1998, and also agreeing to meet with Sheri Lockman, Planner, and Sharyn Frazer on-site on December 2, 1998. Operated by Pat and Shelley Craig, the center is fully licensed by the Colorado Division of Wildlife and The United States Department of Agriculture as a zoo. The center has been in operation for 18 years, 6 in Weld County. Recently the Craigs applied for a Recorded Exemption and a Zoning Permit for a Mobile Home to house an on site zoo keeper. At that time it was discovered that the site does not have a Use by Special Review Permit for the keeping, raising, and boarding of exotic animals. The Rocky Mountain Wildlife Conservation Center is a non-profit and non-government funded organization. I stated my surprise as to Weld ( tint-, n,,t having any regulations pertaining to exotic animals given the count- y hi,storc with the Hawkins animal abuse case in Plattville. 1 was assured there rsas no current zoning regulations pertaining to exotics, but given the history previously stated, the planner stated the county would probably pursue some form ofzoning revision in the future- As a result of that conversation, we saw no problem with relocating the center to Weld County and subsequently purchased the 80 acre parcel the center is located on. We then made extensive improvements to it - in order to accommodate the wildlife center. For the last 5 years we have been under the impression that the center was in compliance with Weld County zoning regulations. Upon recent inquiry into obtaining a Recorded Exemption for insurance reasons, we were informed by planning officials that the center was not in compliance. The Planning Department then made it a requirement of our Recorded Exemption that we complete a Use by Special Review. DIRECTION- With the Planning Department's current view of the Wildlife Center, our obligation lies in pursuing a Use by Special Review I am writing this letter, in part, to explain the burden this obligation has placed on the Wildlife Center, and to recognize the same. Being non-profit and non-government funded, the Wildlife Center is constantly challenged to provide for the animals in their care heeding an average of 3,000 pounds of meat a week, and hundreds of pounds of select feed, results in a cost to the center of more than $ 40,000.00 dollars per year Procuring the additional funds needed for completing a Use by Special Review, such as County Filing Fees, and Engineering Fees, is definitely a burden to the Center The costs incurred in obtaining the Recorded Exemption has already strapped the Center's food budget, and diverting more funds at this time could be devastating As such, the Center is asking for time to secure funding to cover the costs of the USR. At this time, it would be difficult to give an exact date as to when the Center could complete the USR, but I would estimate the Center could make application within 12 months. In March of 1995 we placed a modular on this property.Before moving the modular to this property,we had several conversations with Pat Craig who own the property just west of our parcel. We were aware that the Craig's had a compound on their property,housing many wild animals. The Craig's have taken every precaution at the compound,to assure the safety of the community and the safety of the animals he had saved from uncertin fate.These animals have been a delight to family and friends and very educational for the children. Pat and Shelly Craig are very knowledgeable when it comes to the health and well being of the animals they house at their compound.We applaud their efforts,this is a great expense and they take this commitment very seriously. WE WOULD LIKE TO VOICE OUR OPINIONS ON THE CENTER. WE HAVE LIVED JUST 1/2 MILE EAST OF THE CENTER FOR APPROXIMATELY 18 MONTHS, AND HAVE KNOWN THE CRAIG' S FOR AROUND 4 YEARS. WE HAVE THREE DAUGHTERS, AGES 14, 12 AND 9. WE ARE VERY CAUTIOUS PARENTS. WE HAVE VISITED AND EXAMINED THE ANIMAL COMPOUND SEVERAL TIMES, BEFORE ALLOWING ANY OF OUR CHILDREN TO SPENT ANY TIME THERE WITHOUT OUR SUPERVISION. WE FEEL THAT OUR KIDS ARE IN NO DANGER FROM ANY OF THE ANIMALS. THEY WERE TOLD THE RULES AND FOLLOW THEM COMPLETELY. WE HAVE ALWAYS FOUND THE CENTER TO BE CLEAN AND THE ANIMALS ARE VERY WELL CARED FOR AND LOVED. WE HAVE NEVER FELT UNSAFE WHILE VISITING THERE.
