RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION #1733 - BUDERUS/MCCAULEY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1733, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #1733 was submitted by Theodore and
Daniel Buderus and C. W. and Juanita McCauley, 26246 Weld County Road 45, Greeley, Colorado
80631, for property which is known as Lot B of Amended Recorded Exemption #708, which is
located in part of the NE% of Section 6, Township 4 North, Range 63 West of the 6th P.M., Weld
County, Colorado, being more particularly described in the plat which shall be provided by the
applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to be approximately
150 acres and 8.5 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1733 submitted by
Theodore and Daniel Buderus and C. W. and Juanita McCauley be, and hereby is, approved
conditional upon the following:
1. A Weld County septic permit is required for any proposed home septic system. It
shall be installed according to the Weld County Individual Sewage Disposal System
(ISDS) regulations.
2. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.

for the use shown using the language set forth in Section 11.7.12.5 of the Weld

Dear Commissioners:
This request for a recorded exemption in the A (Agricultural) Zone District is submitted by
Theodore and Daniel Buderus and C.W. and Juanita McCauley. The parcel of land under
consideration is described as Lot B of RE -708, being in the NE4 of Section 6, T4N, R63W
of the 6th P.M., Weld County, Colorado. The property is located south of and adjacent to
Weld County Road 50 and west of and adjacent to Weld County Road 63. This request
is to further subdivide Lot B of RE -708, into two parcels of 150 acres and 8.5 acres more
or less. The applicants are separating 8 acres in the northeast corner, which was created
by a center pivot sprinkler system, for a rural residence and hobby farm. The remaining
150 acres will continued to be farmed.
The parcel under consideration was created in 1984 by Recorded Exemption 708,
therefore this proposal is the further subdivision of the property utilizing the recorded
exemption process. Access to the property is existing from Weld County Road 50.
Central Weld Water District is proposed as the water source, and septic systems are
proposed for sewage disposal on both lots.
The Department of Planning Services' staff has concerns that the proposed division is
inconsistent with the Agricultural Goals and Policies as stated in the Weld County
Comprehensive Plan. This request, if approved, would allow for a residence on both
proposed lots thus reducing agricultural farm ground making farming practices difficult on

both parcels as well as introducing the possibility for additional residences into this area
which causes conflict between urban and rural uses. There are six existing residences
within this one mile section. The addition of two residences will add to conflicts between
urban and rural disparity.
The Department of Planning Services' staff has concerns that the proposed division will
promote urban uses in a rural environment which leads to sprawl row type development.
Staff is also concerned with the level of development in the area and reduction of farm
ground. The Department of Planning Services' staff requests that the Board of County
Commissioners consider this proposal and determine if the standards of Sections 11.5.1
through 11.5.7 of the Weld County Subdivision Ordinance have been me.

2. As mentioned above, United Title Company's Certificate of
Conveyance form and related deeds are included in this
application.
3. Enclosed is a check in the amount of $990 payable to the
Department of Planning Services for the required non-refundable
application fee. The recording fee will be submitted after
approval with the Recorded Exemption Plat. Said plat shall be
prepared according to Section 11-7 of the Subdivision Ordinance.
4. It appears to us that this application would not be
necessary if the Amended Recorded Exemption process would not
include the 8.5 acre partial in either Lot A or Lot B. We are
therefore confused as to what Lot name or number should beused
to describe this requested 8.5 acre partial. Any and all advise
or suggestions would be appreciated.

RECORDED EXEMPTION QUESTIONNAIRE
1. Explain the reason for the proposed recorded exemption and
how each proposed lot will be used.
The reason for the proposed recorded exemption is to sell
the corner created by the center pivot sprinkler which is
owned by the applicants. This corner shall be in the NE
corner of Section 6, Township 4 North, Range 63 West. This
created corner is best suited as a rural residence and hobby
farm. The remainder of the applicants' land shall be used
as farmland irrigated by the existing center pivot. The
split and resulting sale will provide funds for the
Buderuses to reduce debt. This process will increase the
efficiency of the Buderuses' farming operation by
elimination of the irregularly shaped 7 acre field. They
will not have the difficulty of using their large equipment
on this small field.
2. Describe the location, size and present use of the area
where each proposed lot will be created.
Proposed Lot A of this application is approximately 1/2 mile
west of the intersection of WCR 50 and US Highway 34 and
adjacent to WCR 50 and WCR 63. It will be approximately
900 feet south and 750 feet west from the intersection of
WCR 63 and WCR 50 in a triangle shape with the hypotenuse
being a line between the above two points. The lot shall be
approximately 8.5 + acres. This land has been used as waste
and irrigated farmland from its own source of irrigation
water.
Proposed Lot B of this application shall be the remainder of
the NE 1/4 of Section 6 and shall consist of 150 + acres.
It has been used as irrigated farmland, waste, irrigation
ditches and roads.
3. Explain how the proposal is consistent with the Weld County
Comprehensive Plan and any adopted municipal plan, if
applicable.
The proposal is consistent with the Weld County
Comprehensive Plan which allows for Recorded Exemptions via
the Subdivision Ordinance 173 and as amended in Ordinance
173-A effective August 10, 1993. The original Recorded
Exemption occurred October 1986 nearly nine years ago.
(Much past the five year requirement) The land is allowed
to be split to create a lot for a single-family residential
building site. Section 11.2 explains the exemptions; this
application is in compliance with Section 11.8. Subject
land does not lie within three miles of any town. Lot A

will become a rural residence on the waste land and the
remainder will remain irrigated farmland and is larger than
1 acre. Lot B will remain irrigated farmland (agriculture)
which is consistent with the Comprehensive Plan Exemptions
as described in Section 11.2, 11.2.1, 11.8 in its entirety.
There is not an applicable adopted municipal plan which
pertains to subject lands, and subject land is not within
any city or town limits. Lot A's irrigation water will be
from 7/106ths interest in the irrigation well adjacent to
Lot A on Lot B. This is the same percentage ownership as
has always been used to irrigate the field on Lot A and the
farmland north across WCR 50. Lot B is irrigated from the
Latham Ditch on the south end of Lot B.
4. Explain how the uses permitted will be compatible with
existing uses surrounding the proposed recorded exemption.
The neighborhood is primarily irrigated farmland with
farmsteads. The property to the north is an irrigated farm
with a residence. The land to the east is irrigated
farmland, ranchland and residence; to the south is irrigated
farmland and residences; and to the west is irrigated
farmland and a residence.
5. Explain how the proposal is consistent with the intent of
the zoning district it is located within.
Proposed Lot A and Lot B are in the agricultural district
which allows lot sizes greater than one (1) acre and this
application complies. Historic and proposed uses are the
same (agriculture). A zoning change is not applicable nor
desirable at this time. There is other agricultural -zoned
land between subject land and the Town of Kersey eight miles
to the northwest.
6. Explain how the proposal is consistent with efficient and
orderly development.
The proposed Recorded Exemption is part of an approved
Recorded Exemption Number 1051 -06 -1 -RE 708 approved October
2, 1986 and recorded October 2, 1986 in Book 1130 at
Reception No. 2071808. This request is the Lot B of the
simultaneously submitted Amended Recorded Exemption to
reduce Lot B from 358 acres to the NE 1/4 (less old Lot A).
The proposed is not part of an approved subdivision, or
recorded subdivision plat, or unincorporated community, and
does not evade the requirements and statement of purposes as
set forth in Section 1.3 of the Weld County subdivision
Ordinance.

7. Explain how adequate provision for the protection of the
health, safety, and welfare of the inhabitants of the
neighborhood and the County will be accomplished.
The domestic water supply for proposed Lot A and Lot B will
be Central Weld County Water District water (see letter
included in this application package). Its quality,
quantity and dependability is proven. A domestic well for
Lot B is also an option since it is greater than 35 acres.
Neither water source is desired at this time.
Lot A and Lot B shall comply with the Weld County Health
Department Individual Sewage Disposal System (ISDS) permit
requirements.
A 30 -foot access and easement will be the same as
historically used along the east and west sides of the
subject property (Lot A -see Plot Plan Map). The irrigation
water historically used on Lot A and Lot B will remain with
the respective lots.
This proposed Recorded Exemption application complies with
the Weld County Zoning Ordinances Section 50 Overlay
District Regulations. It is not in the airport location,
approach, transitional, horizontal or conical zones.
Geologic hazard layers do not appear present nor in an
overlay. Neither Lot A nor Lot B are in a flood plain.
Sufficient drainage is available to handle irrigation and
rainwater through normal ditches and percolation present on
the subject property. No Planned Unit Development District
exists for subject property.
Existing rights of way are present for existing county roads
servicing said properties. If wider reservations are
reserved, they will be noted on the mylar plot which will be
recorded. Utility rights of ways are also present along
subject property for electricity, water and telephone.
The economic welfare of the community will be enhanced by
owner -occupied buildings to be constructed, through more tax
revenue, and better farming practices allowed by a hobby
farmer handling the small field, which is not economically
feasible with the modern large equipment of the Buderus
brothers.
