COMMUNICATIONS, INC., DBA INTERMOUNTAIN CABLE COMM
A public hearing was conducted on December 18, 1996, at 9:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated November 18, 1996, and duly published
November 21, 1996, in the South Weld Sun, a public hearing was conducted on December 11,
1996, at 9:00 a.m., to consider the request of Joshua Cablevision/Fanch Communications, Inc.,
dba Intermountain Cable Comm, for a cable television franchise renewal. At said hearing on
December 11, 1996, the matter was continued to December 18, 1996, at 9:00 a.m., at which time
Bruce Barker, County Attorney, made this a matter of record. Cyndy Giauque, Assistant County
Attorney, referenced her memo to the Board and explained Joshua Cablevision currently holds the
franchise, and the agreement is with Fanch Communications, Inc., dba Intermountain Cable
Comm. Said agreement is substantially the same as the franchise agreements recently approved
for TCI and Scripps Howard, with provisions added to recognize that Fanch does not currently have
certain technical capabilities available. Ms. Giauque explained this is a 15-year contract, therefore,
the agreement was structured to allow for growth of the company, and is to become effective on
January 1, 1997. Another change in the agreement is that the requirement for bonding was
reduced to a $2,000 Performance Bond. Ms. Giauque also noted the service area is set up to
include areas with a density of at least 50 dwelling units per lineal cable mile, until such time that
Fanch has a subscriber base of at least 150 in the county, at which time the service area will
include areas with a density of at least 25 dwelling units per lineal cable mile. Mike Pfeiler,
representing Joshua Cablevision/Fanch Communications, Inc., was present to answer questions
from the Board. No public testimony was offered concerning this matter. Commissioner Hall
moved to approve the franchise renewal of Joshua Cablevision/Fanch Communications, Inc., dba
Intermountain Cable Comm, and to authorize the Chair to sign the franchise agreement. The
motion was seconded by Commissioner Baxter, and it carried unanimously. Ms. Giauque asked
the Board to include the effective date in the motion. Commissioner Hall amended his motion to
include the effective date of January 1, 1997. Commissioner Baxter agreed to amend the motion,
which then carried unanimously.
