This project falls primarily under the preview of the Weld County special review USR process. REQUIREMENTS: WCR 27 is designed on the Transportation Plan Map as an arterial status road, which requires 100 feet of right-of- way at full build out. There is presently 60 feet of right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89( as amended, the required setback is measured from the future right-of-way line. WCR 26 is designated as a local gravel road. Utilize the existing agricultural, oil and gas, and ditch road that are necessary for your agricultural operation. No additional accesses shall be granted. PROJECT OVERVIEW AND BACKGROUND: Mr. Willcutts lives on the site in an existing residence. The request is for a private airstrip to be used only by the applicants. The applicants own a single-engine aircraft which is currently stored, fueled, and maintained at the Fort Collins-Loveland Airport. At this site, the airstrip runway will be 75 feet wide and 1,500 feet long and will be maintained as grass pasture land. The applicants anticipate approximately three to four trips per month in daylight only. The applicants have indicated that there will not he any additional structures required for this use. The site is located outside the City's Long-Range Expected Growth Area (LREGA) and Mid-Range Expected Service Area (MRESA) but within the three-mile area of influence for the City of Greeley. The property is north of Weld County Road 66 and is within the Town of Windsor's Long-Range Growth Boundaries. By virtue of Section 19-7 of the City Charter and the Weld County Policy of referring land-use proposals for review and comment to appropriate jurisdictions, the proposal is within the purview of the Greeley Comprehensive Plan. Staff Comment: The area is predominantly farmland and large-lot rural acreage. The applicants have indicated the airstrip is for personal use only. Given the frequency of use and the fact that the storage and maintenance of the aircraft is offsite, it is the staffs opinion that this proposed use would be compatible with the neighboring land uses as long as the airstrip is for personal use only and not for business or for commercial use and that no increase in the number of trips be allowed. ADMINISTRATIVE REVIEW TEAM COMMENTS: The Administrative Review Team informally reviewed this proposal at its meeting on January 13, 1999, and had no objections. PLANNING STAFF RECOMMENDATION: The Planning staff recommends that the City of Greeley Planning Commission find that the proposed use, as presented, is compatible with the surrounding uses and is consistent with the Comprehensive Plan. 'Therefore, recommend to the Weld County Planning Commission that the use by special review permit for a private airstrip be approved with the condition that it shall be limited to private use only and limited to no more than four trips per month. From my years of patrol in the area, I am familiar with the property in question. In this letter you will find the Division of Wildlife comments concerning the proposal. The parcel drains from the north to the south. Most of the property is planted and used as irrigated hay meadow. A small wetland complex(approximately five acres)is situated on the south edge of the parcel, adjacent to Weld Road 66. The wetland trends to the northwest and reaches road 27 approximately 100 yards north of the intersection. The wetland can be delineated by the presence of a cattail sedge reed complex with surrounding wet meadow grasses. Isolated wetlands like these are important for a survival of plains amphibians,and as nesting cover and shelter for a variety of songbirds and many other wildlife species. In an effort to maintain species diversity it is crucial to preserve these isolated pockets of rich habitat. The Division of Wildlife finds no conflict with the proposed use if the use will not alter the character or nature of the wetland on site. The plot plan included in the packet by the applicants indicates the runway will not extend into the wetland area. Additionally the runway will be maintained in grass. The Division would encourage the operator of the site to use minimum amounts of fertilizer and other agricultural chemicals necessary to maintain a healthy stand of grass. We are concerned that excess chemicals may wash into the wetland, adversely impacting the plant community or resident species. The applicants indicate that lot A is to be reserved as a future building site. Since lot Ms in close proximity to the wetland,the Division would request the opportunity to comment on proposed future development on this site. Based on this study, the Federal Aviation Administration (FAA) has no objection. We do recommend, however that clear 20:1 approaches, and a safety area 120 wide and extending 240' off both runway ends be established and maintained. Also,be aware that the FAA recommended runway length for the class of small general aviation aircraft is greater than the Highline Farm Airport runway length, and density altitude should be evaluated in all operations. Please check the performance capabilities of the aircraft you intend to operate at your airport to ensure you have adequate runway length. This determination does not mean FAA approval or disapproval of the physical development involved in the proposal. It is a determination with respect to the safe and efficient use of airspace by aircraft and with respect to the safety of persons and property on the ground. This determination does not relieve the proponent of responsibility for compliance with any local law, ordinance or regulations, or state or other Federal regulations. In making this determination, the FAA has considered matters such as the effect the proposal would have on the existing or planned traffic patterns of neighboring airports, the effects it would have on the existing airspace structure and projected program of the FAA, the effects it would have on the safety or persons and property on the ground, and the effects that existing or proposed man-made objects (on file with the FAA) and known natural objects within the affected area would have on the proposal. The FAA cannot prevent the construction of structures near an airport. The airport environs can only be protected through such means as local zoning ordinances or acquisition of property rights. No evaluation of the environmental aspects of the proposal was made in reaching this determination. Therefore, this determination is not to be construed as approval of the proposal from an environmental standpoint under Public Law 91-190 (National Environmental Policy Act of 1969). In order to avoid placing any unfair restrictions on users of the navigable airspace, if your airport does not become operational within 12 months of the date of this letter, this determination will expire unless you request a time extension. 2 When the airport becomes operational, please complete and return the enclosed FAA Form 5010-5, Airport Master Record. The Airport Master Record notifies the FAA that your facility has been activated. If the form has not been returned or an extension has not been requested,your facility may be considered unactivated and your airspace determination void. If in the future you wish to open the airport to public use, a new airspace determination will be required. In addition, if the facility changes names, changes ownership, if there is a change in the owner's address or other substantial changes, please notify the FAA,NFDC on Form 5010-5. The FAA might solicit information updates on your airport, and if the solicitation is not responded to,your airport could be considered an inactive facility.
