The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
preview of the Weld County special review USR process.
REQUIREMENTS:
WCR 27 is designed on the Transportation Plan Map as an arterial status road, which requires 100 feet of right-of-
way at full build out. There is presently 60 feet of right-of-way. This road is maintained by Weld County. Pursuant
to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89( as amended, the required
setback is measured from the future right-of-way line.
WCR 26 is designated as a local gravel road.
Utilize the existing agricultural, oil and gas, and ditch road that are necessary for your agricultural operation. No
additional accesses shall be granted.
Pursuant to Ordinance 169A, if noxious weeds exist on the property or become established as a result of the
proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds.

Environmental Protection Services has reviewed this proposal. The application materials
indicate the existing residence and proposed possible future building site is not within this USR.
The following conditions are recommended to be part of any approval:
1) All liquid and solid waste shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination.
2) No permanent disposal of waste shall be permitted at this site.
3) Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.
4) Fugitive dust shall be controlled on this site.
5) The maximum permissible noise level shall not exceed the residential limit of 55 db (A), as
measured according to 25-12-102, Colorado Revised Statutes.
6) The site shall comply with all requirements of the Federal Aviation Administration.

PLANNING COMMISSION FUNCTION:
Review the proposal and determine compliance with the City of Greeley
Comprehensive Plan and make a recommendation to the Weld County Planning
Commission.
PROJECT OVERVIEW AND BACKGROUND:
Mr. Willcutts lives on the site in an existing residence. The request is for a private
airstrip to be used only by the applicants. The applicants own a single-engine aircraft
which is currently stored, fueled, and maintained at the Fort Collins-Loveland Airport.
At this site, the airstrip runway will be 75 feet wide and 1,500 feet long and will be
maintained as grass pasture land. The applicants anticipate approximately three to
four trips per month in daylight only. The applicants have indicated that there will not
he any additional structures required for this use.
The site is located outside the City's Long-Range Expected Growth Area (LREGA)
and Mid-Range Expected Service Area (MRESA) but within the three-mile area of
influence for the City of Greeley. The property is north of Weld County Road 66 and
is within the Town of Windsor's Long-Range Growth Boundaries. By virtue of
Section 19-7 of the City Charter and the Weld County Policy of referring land-use
proposals for review and comment to appropriate jurisdictions, the proposal is within
the purview of the Greeley Comprehensive Plan.
It is the practice of the City of Greeley Planning Commission to review Weld County
requests principally for conformance with the City's Comprehensive Plan polices.

Specific design issues are addressed only to the degree necessary to ensure consistency
with the City's Comprehensive Plan and Development Code.
Under the Greeley Development Code, the private airstrip would fall under "airports
and heliports" and would be required to operate as a use by special review in an I-M
(Industrial-Medium Intensity), or I-H (Industrial-High Intensity) zone. In the City, the
proposed use would require landscape buffering and paved parking.

ANALYSIS:
The applicable City Comprehensive Plan policies which address the use proposed for
this site include:

All development is encouraged to be designed to promote compatibility among
neighboring land uses of differing intensity and character. These efforts, where

practical and appropriate, should include complementary landscaping, building
massing, material selection, and site design.
Staff Comment: The area is predominantly farmland and large-lot
rural acreage. The applicants have indicated the
airstrip is for personal use only. Given the frequency
of use and the fact that the storage and maintenance
of the aircraft is offsite, it is the staffs opinion that
this proposed use would be compatible with the
neighboring land uses as long as the airstrip is for
personal use only and not for business or for
commercial use and that no increase in the number of
trips be allowed.
ADMINISTRATIVE REVIEW TEAM COMMENTS:
The Administrative Review Team informally reviewed this proposal at its meeting on
January 13, 1999, and had no objections.
PLANNING STAFF RECOMMENDATION:
The Planning staff recommends that the City of Greeley Planning Commission find
that the proposed use, as presented, is compatible with the surrounding uses and is
consistent with the Comprehensive Plan. 'Therefore, recommend to the Weld County
Planning Commission that the use by special review permit for a private airstrip be
approved with the condition that it shall be limited to private use only and limited to
no more than four trips per month.

Dear Scott,
I received and reviewed the above referenced pat concerning a special use permit for a private airstrip.
From my years of patrol in the area, I am familiar with the property in question. In this letter you will find
the Division of Wildlife comments concerning the proposal.
The parcel drains from the north to the south. Most of the property is planted and used as irrigated hay
meadow. A small wetland complex(approximately five acres)is situated on the south edge of the parcel,
adjacent to Weld Road 66. The wetland trends to the northwest and reaches road 27 approximately 100
yards north of the intersection. The wetland can be delineated by the presence of a cattail sedge reed
complex with surrounding wet meadow grasses.
Isolated wetlands like these are important for a survival of plains amphibians,and as nesting cover and
shelter for a variety of songbirds and many other wildlife species. In an effort to maintain species diversity
it is crucial to preserve these isolated pockets of rich habitat.
The Division of Wildlife finds no conflict with the proposed use if the use will not alter the character or
nature of the wetland on site. The plot plan included in the packet by the applicants indicates the runway
will not extend into the wetland area. Additionally the runway will be maintained in grass. The Division
would encourage the operator of the site to use minimum amounts of fertilizer and other agricultural
chemicals necessary to maintain a healthy stand of grass. We are concerned that excess chemicals may
wash into the wetland, adversely impacting the plant community or resident species.
The applicants indicate that lot A is to be reserved as a future building site. Since lot Ms in close
proximity to the wetland,the Division would request the opportunity to comment on proposed future
development on this site.

Notice of Landing Area Proposal
Enclosed is the FAA Form 7480-1, Notice of Landing Area Proposal, which should be
completed and returned to this office (address above) in order for an airspace analysis to be
conducted on a proposed landing area. The airspace analysis will determine the effect the
proposed landing area will have on the safe and efficient use of airspace by aircraft, and the
safety of persons and property on the ground.
Please attach an accurate location map, preferably a USGS Quad map, designating the location of
the proposed landing area. Any other sketches or maps showing the proposed location and the
proposed layout of the landing area would be very helpful. Please indicate the type(s) of
aircraft/helicopter that will be used. Under"obstructions" and "other considerations," include
homes, buildings, towers, hangars, roads, fences, trees, high terrain, power lines, light poles, etc.
in the area of your facility. Please be sure the form is completely filled out, signed, and all
required attachments are included, incomplete submissions may have to be returned to
you for resubmittal.
Please specify whether the latitude and longitude given for the proposed facility is in North
American Datum (NAD) 27 or 83 (if known).

Any Landing or Takeoff Area such as Airport,Heliport,Helistop,Vertiport,Gliderport,Seaplane Base,UHralight Flightpark,or Balloonport
Federal Aviation Regulations Part 157 requires all persons to notify the FM at least 90 days before any construction, alteration, activation, deactivation, or change to the status or
use of a civil or joint-use (cMVmilitary)airport.Notice is not required for the establishment of a temporary airport at which operations will be conducted under visual flight rules(VFR)
and will be used for less than 30 days with no more than 10 operations per day. Notice also is not required for the intermittent use of a site that is not an established airport which
is used for less than one year and at which flight operations will be conducted only under VFR. Intermittent use means the use of the site for no more than 3 days in any one week
and for no more than 10 operations per day.
Required notice shall be submitted on this form from each person who intends to do any of the following:
1. Construct or otherwise establish a new airport or activate an airport.
2. Construct realign,alter,or activate any runway,or other aircraft landing or takeoff area of an airport.
3. Construct,realign,alter,or activate a taxiway associated with a landing or takeoff area on a public-use airport.
4. Deactivate,discontinue using,or abandon an airport or any landing or takeoff area of an airport for a period of one year or more.
5. Deactivate,abandon,or discontinue using a taxiway associated with a landing or takeoff area on a public-use airport.
6. Change the status of an airport from private use (use by the owner or use by the owner and other persons authorized by the owner) to an airport open to the public or from
public-use to another status.
7. Change status from IFR to VFR or VFR to FR.
8. Establish or change any traffic pattern or traffic pattern altitude or direction.
The notice required shall be made by submitting this form to the nearest Federal Aviation Administration Regional Office or Airports District Office. However. in an emergency involving
essential public service or when the delay arising from the 90-day advance notice requirement would result in an unreasonable hardship, you may provide notice to the appropriate
FM Airports District/Field Office by telephone in lieu of submitting this form.The FAA may require the subsequent submission of this form when necessary for safety or other reasons.
Section 901 of the Federal Aviation Act of 1958, as amended, provides that any person who violates a rule, regulation or order issued under Title III of this Act shall be subject to
a civil penalty not to exceed$1,000 for each violation.

Notification to the FAA does not waive the requirements of any other government agency.

Airspace Case No. 98-DEN-207-NRA
An airspace analysis of the proposed private use Highline Farm Airport been completed. Based on this
study, the Federal Aviation Administration (FAA) has no objection.
We do recommend, however that clear 20:1 approaches, and a safety area 120 wide and extending 240'
off both runway ends be established and maintained. Also,be aware that the FAA recommended
runway length for the class of small general aviation aircraft is greater than the Highline Farm Airport
runway length, and density altitude should be evaluated in all operations. Please check the performance
capabilities of the aircraft you intend to operate at your airport to ensure you have adequate runway
length.
This determination does not mean FAA approval or disapproval of the physical development involved in
the proposal. It is a determination with respect to the safe and efficient use of airspace by aircraft and
with respect to the safety of persons and property on the ground. This determination does not relieve the
proponent of responsibility for compliance with any local law, ordinance or regulations, or state or other
Federal regulations.
In making this determination, the FAA has considered matters such as the effect the proposal would have
on the existing or planned traffic patterns of neighboring airports, the effects it would have on the
existing airspace structure and projected program of the FAA, the effects it would have on the safety or
persons and property on the ground, and the effects that existing or proposed man-made objects (on file
with the FAA) and known natural objects within the affected area would have on the proposal.
The FAA cannot prevent the construction of structures near an airport. The airport environs can only be
protected through such means as local zoning ordinances or acquisition of property rights.
No evaluation of the environmental aspects of the proposal was made in reaching this determination.
Therefore, this determination is not to be construed as approval of the proposal from an environmental
standpoint under Public Law 91-190 (National Environmental Policy Act of 1969).
In order to avoid placing any unfair restrictions on users of the navigable airspace, if your airport does
not become operational within 12 months of the date of this letter, this determination will expire unless
you request a time extension.

When the airport becomes operational, please complete and return the enclosed FAA Form 5010-5,
Airport Master Record. The Airport Master Record notifies the FAA that your facility has been activated.
If the form has not been returned or an extension has not been requested,your facility may be
considered unactivated and your airspace determination void.
If in the future you wish to open the airport to public use, a new airspace determination will be required.
In addition, if the facility changes names, changes ownership, if there is a change in the owner's address
or other substantial changes, please notify the FAA,NFDC on Form 5010-5. The FAA might solicit
information updates on your airport, and if the solicitation is not responded to,your airport could be
considered an inactive facility.
