RE: APPROVE AMENDMENT TO AGREEMENT TO PROVIDE ELECTRICAL
INSPECTIONS AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Amendment to the Agreement to
Provide Electrical Inspections between the County of Weld, State of Colorado, by and through
the Board of County Commissioners of Weld County, on behalf of the Building Inspection
Department, and the Town of New Raymer, with terms and conditions being as stated in said
amendment, and
WHEREAS, after review, the Board deems it advisable to approve said amendment, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Amendment to Agreement to Provide Electrical Inspections
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Building Inspection Department, and the Town
of New Raymer be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said amendment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 22nd day of December, A.D., 1997.

AMENDMENT TO AGREEMENT TO PROVIDE ELECTRICAT,rINSPECTIONS

THIS AMENDMENT TO AGREEMENT is made this f day ofA�� 4` <, 1997,
by and between the TOWN OF NEW RAYMER, hereinafter referred to llfeE1SAi" -and the
COUNTY OF WELD, a political subdivision of the State of Colorado, hereinafter referred to as the
"County".
WHEREAS, on March 13, 1983, the Town and the County entered into an Agreement to
Provide Electrical Inspections, and
WHEREAS, paragraph 12. of said Agreement states the following:
"12. This Agreement may be renewed annually by written notice from one party to the
other of an intent to renew. The failure of the other party to disaffirm the renewal in writing within
30 days shall be deemed consent to the renewal for an additional one year period.", and
WHEREAS, the parties now desire to amend said paragraph 12. of the Agreement to state
that the Agreement is renewed annually, unless notice of intent not to renew is delivered to the other
party thirty (30) days prior to the expiration date.
NOW, THEREFORE, in consideration of the recitals, promises and covenants herein set
forth, and other good and valuable consideration herein receipted for, the parties agree to amend their
Agreement to Provide Electrical Inspections, dated March 13, 1983, as follows:
Delete all of paragraph 12., and add the following:
12. This Agreement shall be renewed annually unless either party by written notice,
delivered thirty (30) days prior to expiration date, expresses an intent not to renew
the agreement. If such termination does occur, all structures that have had
inspections made but are not completed at the time of termination may be completed
through final inspection at the agreed fee rate if the Town so requests and if the
County agrees to do so. The Town shall also pay all outstanding fees owed to the
County within thirty (30) days of receiving the notice of termination.
All remaining provisions of said Agreement shall remain unchanged and in full force and
IN WITNESS WHEREOF, the Town, by resolution duly adopted by its governing body,
caused this Amendment to Agreement to be signed by its mayor and attested by its clerk, and the
County Board of Commissioners has caused these presents to be subscribed by the Chairperson of
said board and the seal of said board to be affixed thereto and attested by the clerk of said board, all
on the day and year first above written.
