Harbert, Chair Commissioner W. H. Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer- EXCUSED Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Todd Hodges Health Department representative, Sheble McConnellogue Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated March 26, 1998, and duly published April 8, 1998, in the Platteville Herald, a public hearing was conducted to consider the request of Ivan and Joanne Gilbaugh for a Third replat of Gilbaugh's Appaloosa Acres, Lot 15, into two additional lots. Lee Morrison, Assistant County Attorney, made this a matter of record. Todd Hodges, Department of Planning Services representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Hodges explained there are 17 existing lots with access from Weld County Road 41. The replat involves splitting a portion of Lot 15 into two smaller lots. The applicant will be responsible for the construction of the road to these two lots which will have a 25-foot right-of-way. Gerald McRae, applicant's representative, stated these two lots will access a private road and the utilities are already in place. In response to Mr. Morrison, Mr. McRae stated under the proposed covenants, the owner of the large lot will be responsible for the maintenance of the road, which is consistent with the rest of the subdivision lots. In response to Chair Harbert, Mr. McRae stated the applicant has reviewed and is in agreement with the Conditions of Approval and Development Standards. No public testimony was offered concerning this matter. Commissioner Webster moved to approve the request of Ivan and Joanne Gilbaugh for a Third replat of Gilbaugh's Appaloosa Acres, Lot 15, into two additional lots, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record.
