HomeMy WebLinkAbout970658.tiffHEARING CERTIFICATION DOCKET NO. 97-15 RE: SITE SPECIFIC DEVELOPMENT PLAN AND PLANNED UNIT DEVELOPMENT (PUD) FINAL PLAN, S #415, FOR LITTLE THOMPSON VALLEY ESTATES - KEVIN AND DINA MCCARTY A public hearing was conducted on April 9, 1997, at 10:00 a.m., with the following present: Commissioner George E. Baxter, Chair Commissioner Constance L. Harbert, Pro-Tem Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Shani Eastin The following business was transacted: I hereby certify that pursuant to a notice dated March 3, 1997, and duly published March 6, 1997, in the South Weld Sun, a public hearing was conducted to consider the request of Kevin and Dina McCarty, Little Thompson Valley Estates, requesting a Site Specific Development Plan and Planned Unit Development (PUD) Final Plan, S #415. Lee Morrison, Assistant County Attorney, made this a matter of record. Shani Eastin, Department of Planning Services representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Kris Pickett, Pickett Engineering, represented the applicant and stated the 2.5 -acre lots will be for sale, with the owners to live on and raise crops on the larger parcel. He confirmed all Conditions of Approval are agreeable. Responding to questions from the Board, Mr. Pickett confirmed all requirements of the fire district have been met including the space requirement of the culdesac with two fire hydrants. He also stated the owners will maintain the larger lot, with possible grazing rights to be available for the other residents. Mr. Pickett clarified the owners will grow grass and alfalfa and live on the larger lot. Kevin McCarty, applicant, explained 50 acres are planted in grass and 15 acres will be planted in alfalfa, with 17 acres to be fenced for possible leasing to the lot owners. He clarified no grazing will be allowed on the individual lots, but they are considering leasing the pasture to the home -owners association. Responding to further questions from the Board, Mr. McCarty stated they are approaching the plantings as dryland and are making no commitments to the lot owners to have pasture available. He noted, however, they do have water which will be pumped to the proposed pond. He stated 970658 PL1041 RE: HEARING CERTIFICATION - LITTLE THOMPSON VALLEY ESTATES / MCCARTY (S #415) PAGE 2 grazing will not be allowed until the grass is established and, responding to Commissioner Harbert's concern, explained the reason for the 50' X 50' maximum size on the corrals was to not allow large areas without cover. Mr. McCarty stated they will have two additional twelve -acre pastures; however, he reiterated he cannot guarantee pasture. He conceded the corrals may be allowed to extend onto their land. Discussion ensued regarding the covenants, and Mr. McCarty clarified the lot owners must have a lease in place before they are allowed to have a horse, as detailed in the covenants. No public testimony was offered concerning this matter. Commissioner Hall moved to approve the request of Kevin and Dina McCarty, Little Thompson Valley Estates, requesting a Site Specific Development Plan and Planned Unit Development (PUD) Final Plan, S #415, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Webster. Responding to a question from Commissioner Kirkmeyer, Mr. Morrison explained the covenants may be changed prior to final review and recording, as long as the change is not considered substantial. Commissioner Kirkmeyer confirmed it is the intent of the Board to allow flexibility for enlarging the corrals to a maximum of 100' X 100' prior to finalizing the covenants. Mr. Morrison clarified that flexibility will be considered during final review of the covenants since the Board determined it is not a major change. The motion then carried unanimously.
