HomeMy WebLinkAbout950694.tiffRESOLUTION RE: APPROVE CONTRACT AMENDMENT #1 WITH COLORADO DEPARTMENT OF PUBLIC SAFETY, DIVISION OF CRIMINAL JUSTICE, AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with Contract Amendment #1 between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Community Corrections Board, and the Colorado Department of Public Safety, Division of Criminal Justice, commencing upon execution, and ending June 30, 1995, with further terms and conditions being as stated in said amendment, and WHEREAS, after review, the Board deems it advisable to approve said amendment, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Contract Amendment #1 between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Community Corrections Board, and the Colorado Department of Public Safety, Division of Criminal Justice, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said amendment. Box 758, Greeley, Colorado 80632 hereinafter referred to as the contractor, FACTUAL RECITALS Authority exists in the Law and Funds have been budgeted, appropriated and otherwise made available and a sufficient unencumbered balance thereof remains available for payment in Fund Number 100 , Appropriation Code 791 , Contract Encumbrance Number ; and Required approval, clearance and coordination has been accomplished from and with appropriate agencies; and The parties entered into a contract dated July 1, 1994, more fully described below. The State is extending through January 31, 1995, the interim period of time it will continue to contract with the Weld County Community Corrections Board to provide specialized GIRT services for residential transition placements, prior to the selection of a contractor through RFP #BF -00695. The Residential Treatment Center, a subcontractor of the Weld County Community Corrections Board, was selected to deliver specialized CIRT services for residential transition placements through RFP #BF -00695, attached, marked as Exhibit "1-A" and incorporated herein by reference. This selection is effective February 1, 1995. It is the intention of the parties to amend and increase the original contract SC9584 by $561,179 to a new total of $750,294 and to extend the effective dates for reimbursable specialized CIRT services from July 1, 1994 through September 30, 1994 to July 1, 1994 through June 30, 1995. NOW THEREFORE, it is hereby agreed that 1. Consideration for this Amendment to the Original Contract, CE number SC9584 Contract Routing Number 95084 dated July 1, 1994 consists of the payments which shall be made pursuant to this Amendment and the promises and agreements herein set forth. It is expressly agreed by the parties that this Amendment is supplemental to the Original Contract Routing Number 95084 , dated July 1, 1994 , referred to as the "Original Contract," which is, by this reference, incorporated, made a part hereof and identified as Exhibit "1-B," and all terms, conditions and provisions thereof, unless specifically modified herein, are to apply to this Amendment as though they were expressly rewritten, incorporated and included herein. 3. It is agreed the Original Contract is and shall be modified, altered and changed in the following respects only: a. The maximum amount payable from the State for specialized CIRT services is increased by $561,179 to a new total of $750,294. b. Reimbursement for specialized CIRT services provided July 1, 1994 through September 30, 1994 is extended to cover the period from July 1, 1994 through June 30, 1995. The section of Paragraph 1.A.2. of the original contract SC9584 that describes the CIRT allocation shall now read: "$ 750,294 for residential transition placements for specialized services as described in Exhibit "A" at a daily rate of $45.68 per offender, for services provided July 1, 1994 through June 30, 1995." 4. The effective date of this Amendment is October 1, 1994 . 5. Except for the "Special Provisions", in the event of any conflict, inconsistency, variance or contradiction between the provisions of this Amendment and any of the provisions of the Original Contract, the provisions of this Amendment shall in all respects supersede, govern and control. The "Special Provisions" shall always be controlling over other provisions in the contract or amendments. The representations in the Special Provisions concerning the absence of bribery or corrupt influences and personal interest of State employees are presently reaffirmed. 6. FINANCIAL OBLIGATIONS OF THE STATE PAYABLE AFTER THE CURRENT FISCAL YEAR ARE CONTINGENT UPON FUNDS FOR THAT PURPOSE BEING APPROPRIATED, BUDGETED AND OTHERWISE MADE AVAILABLE. 7. THIS AMENDMENT SHALL NOT BE DEEMED VALID UNTIL IT SHALL HAVE BEEN APPROVED BY THE CONTROLLER OF THE STATE OF COLORADO OR SUCH ASSISTANT AS HE MAY DESIGNATE. An amendment to cover the period from October 1, 1994 through December 31, 1994 was written and sent to Sharon Street on November 25, 1994. Because I did not get any response from this amendment, it was re -sent to Sharon on January 9, 1995. When this amendment was not signed and returned, I decided to re -write the amendment so that it would cover the period from October 1, 1994 through June 30, 1995. This amendment was sent to Sharon on March 14, 1995. The proper Weld County officials did sign this amendment, and it was returned to me on May 17, 1995. However, in the meantime, I knew that the end of the fiscal year was quickly approaching. I decided to go ahead and process the funds, since I didn't know for sure if the amendment would be returned at all. I chose not to send the amendment downtown for State approvals at the end of May, since I knew it would run into obstacles and questions as to why I was routing an amendment that was effective October 1, 1994 over seven months late. These issues probably would not have been resolved by the end of the fiscal year, and I would not have been able to pay the additional $561,179. Street, Administrator RE: Contract Amendment DATE: April 3, 1995 Enclosed are four copies of the Amendment to the Contract between the Department of Public Safety, Division of Criminal Justice and the Weld County Community Corrections Board. This Amendment increases the CIRT allocation to $750,294 and extends the effective date for CIRT services through June 30, 1995. These changes are being made as a result of The Residential Treatment Center being chosen as a successful bidder of the RFP for CIRT services. This Amendment needs to be signed and I will then forward it to the Division of Criminal Justice for their further execution. Hello
