Miller May 15, 1997 From: Monica Daniels -Mika, Directorop , Dept. of Planning Services (./-1 On May 13, 1997, Quinn Morrison called the Department of Planning Services requesting an interpretation on the radio tower located on parts of Section 7, T8N, R67W. After reviewing the file, it appears in fact that a radio tower was approved by the Planning Commission on May 6, 1974, and the Board of County Commissioners on June 10, 1974. The resolution which produced the findings was recorded on July 12, 1974. The resolution, however, does not state a height for the radio tower. Additionally, the application materials allude to the fact that a 400 foot tower will be placed on site, but there is no specific limitation on the tower via the approved CUP site. Mr. Morrison requested to expand the radio tower by an additional 250 feet. After reviewing the information, it appears that no height limitations were established on the original CUP #1. There is, however, documentation in the file concerning the case, referred to as Tape #534, which does indicate that the tower would be at a maximum 400 feet. After reviewing the above information and discussing the case with Lee D. Morrison, Mr. Morrison feels that because the resolution omits an actual height associated with the tower, the County is thereby limited on making any references to any potential future height of the tower. Mr. Morrison, however, did state that the USR area itself cannot comprise an area larger than the 7.6 acres which was originally approved; and the size of the guy radius, which was also included in this CUP, cannot exceed 278 guy radius. I informed Mr. Ken Lynn of the decision of County Attorney Lee Morrison today and Mr. Lynn said that he would be getting in touch with Mr. Quinn Morrison, applicant representative. cupl mdm tp 97a8ig PL0793 Hello
