RESOLUTION
RE: APPROVE RESUBDIVISION, S #387, OF LOT 21, INDIAN HILLS SUBDIVISION -
CARLSON AND AMELING
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 15th day of
November, 1995, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing
the application of Jane Carlson, 7191 49th Street, Greeley, Colorado 80634, Duane H. and
Kimberly K. Ameling, 4221 54th Street Road, Greeley, Colorado 80634, for a Resubdivision on the
following described real estate, to -wit:
Lot 21, Indian Hills Subdivision, located in the NWY
of Section 35, Township 5 North, Range 66 West of
the 6th P.M., Weld County, Colorado
WHEREAS, Tom Francis, son of Jane Carlson, represented said applicants, and
WHEREAS, Section 8.3 of the Weld County Subdivision Ordinance provides standards for
review of said Resubdivision, and
WHEREAS, the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented in this matter and, having
been fully informed, finds that this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 8.3 of the Weld County Subdivision Ordinance.
2. It is the opinion of the Board of County Commissioners that the applicant has shown
compliance with Section 8.3 of the Weld County Subdivision Ordinance including
specifically:
a. The Resubdivision will not adversely influence the adopted rules,
regulations, and ordinances currently enforced upon and affecting this
subdivision.
b. The Resubdivision will not adversely influence surrounding property owners
and conforms with the Weld County Comprehensive Plan.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of Jane Carlson and Duane H. and Kimberly K. Ameling for
a Resubdivision on the hereinabove described parcel of land be, and hereby is, granted subject
to the following conditions:
1. Within 30 days from the date of approval by the Board of County Commissioners,
the applicants shall submit a mylar plat prepared in accordance with Section 7.2.6
of the Weld County Subdivision Ordinance. The plat shall be recorded with the
Office of the Weld County Clerk and Recorder, and the applicant shall be
responsible for all recording fees.
2. Prior to recording the plat:
A 15 -foot utility easement shall be shown around the new northern portion
of Lot 21, as approved by the Weld County Utility Advisory Committee.
b. A standard utility provider sign -off list shall be signed by each utility provider
for the vacation of the existing 10 -foot utility easement along the northern
border of Lot 21 and recorded with the plat, as approved by the Weld
County Utility Advisory Committee.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 15th day of November, A.D., 1995.

The attached application and submitted materials are concerning a request made by Jane Carlson and
Duane and Kimberly Ameling. The request is to adjust the northern lot line of Lot 21 and vacate the
existing 10 -foot utility easement along the northern lot line of Lot 21, Indian Hills Subdivision. The
property is located south and adjacent to 49th Street; north and adjacent to 54th Street.
Based upon the submitted application materials and other relevant information regarding this request, the
Department of Planning Service's staff recommends conditional approval of this request.
This determination was based on the following:
1. The submitted materials are in compliance with the application requirements of Section 8.3 of the
Weld County Subdivision Ordinance.
2. It is the opinion of the Department of Planning Services' staff that the applicant has shown
compliance with Section 8.3 of the Weld County Subdivision Ordinance including specifically:
a. The Resubdivision will not adversely influence the adopted rules, regulations, and ordinances
currently enforced upon and affecting this subdivision.
b. The Resubdivision will not adversely influence surrounding property owners, and conforms with
the Weld County Comprehensive Plan.

Conditions of Approval

Dear Sir:
The purpose of this letter is to discuss the drainage for the subject resub-
division.
The purpose of the resubdivision is to add 2.0 acres of undeveloped land to Lot
21 (1.7 acres) of Indian Hills Subdivision creating a new Lot 21 of 3.7 acres.
Current drainage is from north to south on highly absorptive ground to the
county road.
The change in lot size will not create any change in drainage pattern nor is it
expected that any increase in flow would occur since any development would be
restricted to residential outbuildings.
This letter is submitted in lieu of a drainage report. If you have any ques-

It was determined the Board would require two conditions upon approval of this application 1) a 15 foot utility
easement around the perimeter of the new resulting lot lines of Lot 21, Indian Hills Subdivision through the
resubdivision; 2) to allow the vacation of the existing 10 foot utility easement located on the existing northern
boundary of Lot 21 if the utility providers sign off on the plat.
Cody Wooldridge motioned for approval. Motion seconded by Sue Skaley. Motion carried unanimously.
