Longmont CO 80504 t May 4. 1996 Board of Weld County Commissioners._ _CL P.O.Box 756 Greeley CO 80632 Subject: Improvements to State Highway 119 Ladies And Gentlemen: Currently Highway 119 is being improved by extending existing deceleration and turn lanes, and by repaving between Longmont and Del Camino in Weld County. At the intersection of Highway 119 and Weld County Road 3-1/2, on the northwest corner, is the McStain development. This development will buid out ultimately to 401 houses as now planned. With the MUD plan in effect in all probability there will be additional development along Rd. 3-1/2 in the future. There is no provision for a left turn lane from Hwy 119 eastbound onto Rd. 3-1/2, north bound to the Mc stain development, nor is there an acceleration lane for traffic making a left turn from Rd. 3-1/2 onto Hwy 119 eastbound. With the traffic created by this development this will certainly create a serious hazard given the volume of high speed traffic on Hwy. 119. Public safety is an aspect of"Smart Growth". It would appear that there has been a breakdown in communication and planning between County and State authorities to correct what will obviously be a dangerous intersection, when the opportunity to do so is at hand. "There is always time and money to do something over,but never to do it right in the first place";unfortunately in this case at danger to life, limb and property. If some technicality prevents the funding of new turn lanes this would be a poor excuse for permitting the hazard at this intersection to remain. From Subject: McStain--Longview PUD Letter of Credit& 2 On-Site Improvements: I am comparing the original Road Maintenance and Improvement Agreement dated December 20, 1995, with the recently proposed Phase 2 agreement provided by the applicant. All the items on the Phase 2 agreement appear to be the same. In the street section, all the items appear to be adequate cost wise to construct the street section. Off-site Improvements: In the original Road Maintenance and Improvement Agreement,under Exhibit C, Improvements and Phasing Summary, the applicant has indicated that in Phase 2 the improvements will be done including the second emergency access and the WCR 3.5 improvements from the main entrance to the emergency access. I am not finding Exhibit C or accompanying documents for off-site improvements to WCR 3.5. This area has been identified in Phase 2. Please submit the documents that should accompany and quantities for this section. .tc. WITHNE. TH WHEREAS, Developer has applied to the County for approval of a final plan for Planned Unit Development, also known a LongView, Case Number for a mobile home park on land in the East Half of the Southwest Quarter, Section 5, Township 2 North, Range 68 West of the 6th Pricipal Meridian, Weld County, Colorado, and WHEREAS, the Planned Unit Development will generate additional traffic on the access road and other nearby roads, and WHEREAS, the existing County roads which provide access to the Planned Unit Development will require improvements to adequately serve traffic, the approximate costs of which are attached hereto as Exhibit No. 1, and WHEREAS, Developer has offered to accept certain road improvement actions. NOW, THEREFORE, in consideration of the mutual covenants and conditions set forth herein, the County and the Developer mutually agree as follows: 1. Primary access to the Planned Unit Development shall be via Weld County Road 3 1/2, approximately 400 feet north of its intersection with Colorado State Highway 119. 2. All construction and materials under this agreement shall be in accordance with the Standard Specifications for Road and Bridge Construction of the Colorado Department of Highways, with reference to the edition current at the time the project is initiated. Phase I A. As improvements for Phase 1 of the PUD, Developer agreesII to pave three lanes of Weld County Road 3 1/2 from the 00 Planned Unit Development's southern access to State Highway p0 119. r B. Developer agrees to initiate the Phase I improvements i0 after recording of the final plat of the PUD and at such time as construction of homes begins and to complete the Phase I improvements prior to occupancy of homes in said Phasel of the Improvements Agreement. C. If, prior to or within ten years after the completion of the construction of Phase I of the off-site road improvements, Weld County issues zoning or other approval for any other residential, commercial, or industrial development, or any expansion of any agri-business, that will be using as access, or which is located adjacent to any of the portion of Weld County Road 3 1/2 or State Highway 119 paved at the expense of the Developer as identified as Phase I, the County, to the extent permitted by law, agrees to seek contributions to the cost of the road, pro rata as the projected use of the road compares to the Developer's projected use of the road. 4. Phase II A. As improvements for Phase 2 of the PUD, Developer agrees to pave two lanes of the portion of Weld County Road 3 1/2 extending south from emergency access of the PUD to the improvements at the south access mentioned in'" h' 1. A paved westbound acceleration lane will be provided on State highway 119 to the west of this intersection, and a paved westbound deceleration lane on State Highway 119 shall be provided to the east of this intersection. B. Developer agrees to complete Colorado State Hwy. 119 improvements to include west bound acceleration and deceleration lanes and an east bound deceleration lane for access to Weld County Road 3 1/2 north of State Hwy. 119. These improvements will be completed in conjunction with Colorado Department of Transportation improvements to State Hwy. 119 which are scheduled for the Spring of 1996 and shall be completed no later than Nov. 1996, r gardless of CDOT's progress with improvements to Highway 119. B. If, prior to or within ten years after the completion of the construction of the off-site road improvements, Weld County issues zoning or other approval for any other residential, commercial, or industrial development, or any expansion of any agri-businesses, that will be using as access, or which is located adjacent to, any of the portions of State Hwy. 119 paved at the expense of the Developer, the County, to the extent permitted by law, agrees to seek contributions to the cost of the roads, pro rata as the projected use of the roads compare to the Developer's projected use of the road. 7. It is the intent of the parties that this Agreement remain in full force and effect until it terminates according to its own terms and that it be binding upon. the Developer and its successors, and assigns, and on this Board and future Boards to the fullest extent permitted by law. Should this Agreement, or any portion thereof, be found to be void or voidable for the reason that it binds the Board of County Commissioners for more than a one year period of time, this contract shall be construed as a one year contract with automatic annual renewals. 8. It is the intent of the parties that a separate agreement regarding collateral for construction for each phase of the off- site improvements will be proposed by the Developer prior to filing of the final plat. 9.
