The specific issue is the agreement between Owens Brothers and Mr. and Mrs. Joe Timko concerning Owens' willingness to control their tenant's operations in such a way as not to direct any excess irrigation waters across the Timko property. As you may recall from testimony during the public hearings, irrigation waters from the Owens property enter a borrow ditch on the south side of Weld County Road 261. The water in the borrow ditch then flows through a county-installed culvert under the road and onto the Timko property. The water then enters a ditch on the Timko property, which tends to fill up due to an undersized culvert on the Timko driveway. The ditch water then seeps or flows towards the Timko residence (the former St. Vrain School). To alleviate this situation, Owens Brothers is planning on constructing an interceptor ditch at the northern (downgradient) end of the field. This ditch would divert water away from the Timko property. The interception ditch would discharge into another culvert, pass under County Road 261, and enter a ditch on the Gilbert Acord property. We are at this time seeking permission form Mr. Acord for this plan. It should be pointed out that the Timko residence is in the floodplain of St. Vrain Creek in an area where the water table is perhaps 6 or 7 feet below ground surface. The St. Vrain School (i.e. Timko residence) has a history for decades of basement flooding. Owens Brothers will comply with their agreement concerning irrigation waters, but other factors may continue to affect the basement flooding problem.
