New AGREEiENT Made and entered into this 15th day of June , 1928 , by and between the CHICAGO , BURLINGTON & gUINCY RAILROAD COMPANY , a corporation created under the laws of the' state of illinois , hereinafter called the " first party" , and the COUNTY OF WELD , COLORADO , By F . L. Powars , Dan C . Straight and Wm. A . Carlson , Board of Commissioners n of said County , hereinafter called the ' second party" . \ V A? `N I T N E S S E T H : ( 1 ) THAT , for and in consideration of the sum of One Dollar ( $1 . 00 ) , receipt whereof is hereby acknowledged , and upon the conditions hereinafter set forth , the first party herein grants unto the second party license to construct , maintain and use a public highway upon the premises of the first party near Keenesburg , Weld County , Colorado , described as follows , to-wit : A wedge shaped piece of right of way located in the SW4 Sec . 26 , T 2 N , R 64 W , near Keenesburg and located on the south side main line track , said strip being twenty-five ( 25 ) feet in width at the west line of said Sec . 26 opposite Sta . 2755 of the railroad and extending east in said right of way line to a point opposite Sta . 2745 of the railroad , as shown in red on plat No . 1317 -23 hereto attached , identified by the signature of F . T . Darrow and made a part hereof . ( 2 ) The Railroad Company reserves unto itself at all times during the term of this license , the right to use said premises , or to license the use of said premises , for sewers , water mains , conduits , and other underground construction ( except culverts or 425 bridges to be constructed theron as a part of said highway ) , and also for telephone , telegraph , and power and light transmission wires , and all other purposes , including the use of the surface of said premises , not inconsistent with the maintenance and use by the second party of said public roadway thereover . ( 3 ) The said highway shall be constructed and maintained by the second party at its sole cost and expense , and the second party shall be charged with all duty and obligation as to the due and proper construction , maintenance and use of said highways ; it being understood and agreed that the first party does not warrant its „, premises to be in a suitable condition for the use herein granted ; and that the second party shall release and protect , indemnify and save harmless the first party from all claims , demands , suits , judgments , costs and expenses for loss , damage or injury to the person or property of any person or persons whomsoever , in any mannder arising from, or growing out of , the construction , maintenance , existence or use of said highway on the said premises of the first party , due to whatsoever cause . ( 4 ) The license hereby granted shall remain in force and effect for a period of one ( 1 ) year from the date hereof , and thereafter until terminated by either party giv- ing to the other six months ' notice in writing of its intention to terminate the same , and upon the expiration of the period fixed by such notice of termination all the rights and privileges herein granted to the second party shall cease and determine . ( 5 ) This license shall be binding upon the successors or assigns of the parties hereto , provided the second party shall not assign this license or any right or privilege granted hereunder , without the consent in writing of the first party . Mann , that at a sale of real estate held by the Treasurer of Weld County on December 17 , 1921 for the delinquent taxes of 1920 , Weld County became the purchaser of said tax sale of the Si- Si- 35-8-65 , and the County Treasurer of said County issued to him a certificate of purchase therefor , which certificate was numbered 498 ; That it was originally issued to the Plains Loan , Reality & Investment Company , a corporation. That said certificate of purchase has since been lost , and his affiant after diligent search has been and still is unable to find the same , and that Herbert E. Gordon and and Wayne McNeal , then presented the petition for the organization of the proposed drainage district called by the petitioners "The Box Elder Drainage District , " and the published notice of said petition. On motion duly made and seconded , the original petition for the organization of the proposed drainage district was ordered spread upon the minutes of the meeting , the same being in words and figures as follows , to-wit : TO THE HONORABLE BOARD OF COUNTY COIIU I SS I ON RS OF THE COUNTY OF WELD , IN THE STATE OF COLORADO : Vie , the undersigned persons whose names are signed to this petition , respect- fully petition your Honorable body to establish a drainage district under the provisions of the laws of the State of Colorado and to that end we respectfully represent : FIRST : That the general description of the boundaries of our said proposed drainage district is as follows : Commencing at the Northeast Corner (NE) of Section Two ( 2 ) , Township Four ( 4 ) North , of Range Sixty- four ( 64 ) West of the 6th P. SECOND : That your petitioners severally own and control the respective described tracts of land and number of acres thereof set opposite their respective signatures hereto , and all of which are situated within said boundaries of said proposed drainage district . THIRD : That your petitioners whose names are signed hereto constitute , and they are a majority of the owners of the acreage of lands , both as to numbers and total acres situate and included within said proposed drainage district . FOURTH: That the lands within the boundaries of said proposed drainage district during several years last past have become , and are now saturated with waste , seepage and spring water to such an extent, that said lands are not at present cultivatable , or fully so , for the raising of agricultural crops thereon; that the lands situate in said district can be made , to a great extent , more productive and useful as a result of the construction and maintenance of a system of drainage ditches that will drain and carry away from said lands the waste , seepage and spring waters which arise and accumulate on said land which does not now have any natural or other outlet . FIFTH : That the proposed system of drainage ditches to be constructed to drain said lands consist generally of a main drain ditch beginning at a point near the East Quarter corner of Section Two ( 2 ) , Township Four ( 4 ) North , of Range Sixty-four ( 641 West of the 6th P. M. ; thence in a Southwesterly direction across Sections Two ( 2 ) , Eleven ( 11 ) , Ten ( 10 ) , Fifteen ( 15 ) , Twenty- two ( 22 ) and Twenty- seven ( 27 ) to a point on the South line of said Section Twenty Seven ( 27 ) near the South Quarter corner of Said Section 27 . Into this main ditch the owners of lands in said district may run side drains of either tile or open ditch as may be found necessary to drain the adjacent lands within the boundaries of said proposed drainage district . The width of said main ditch will be approximately five feet on the bottom , with side slopes of 1 to 1 , and constructed upon a grade of about 17 feet per mile ; that the approximate location of said main ditch that is proposed to be constructed and the owners of each tract of land through which the same runs , and which will be drained by said system of ditches , is shown upon a map of said proposed drainage district hereto attached and made a part of this petition , and to which reference is made . 485 SIXTH: The proposed name of said drainage district is "THE BOX ELDER DRAINAGE DISTRICT . " SEVENTH : Your petitioners , for the establishment of said drainage district , res- pectfully select and designate three of your petitioners , to-wit : Charles E. Romans , Carl L. THIRD : That your petitioners whose names are signed hereto constitute , and they are a majority of the owners of the acreage of lands , both as to numbers and total acres situate and included within said proposed drainage district . FOURTH : That the lands within the boundaries of said proposed drainage district during several years last past have become , and are now saturated with waste , seepage and spring water to such an extent that said lands are not at present cultivatable , or fully so , for the raising of agricultural crops thereon ; that the lands situate in said district can be made , to a great extent , more productive and useful as a result of the construction and maintenance of a system of drainage ditches that will drain and carry away from said lands the waste , seepage and spring waters which arise and accumulate on said land which does not now have any natural or other outlet . FIFTH : That the proposed system of drainage ditches to be constructed to drain said lands consist generally of a main drain ditch beginning at a point near the East Quarter corner of Section Two ( 2 ) , Township Four ' ( 4 ) North , of Range Sixty-four ( 64 ) West of the 6th P. M. , thence in a Southwesterly direction across Sections Two ( 2 ) , Elever ( ii ) , Ten ( 10 ) , Fifteen ( 15 ) , Twenty- two ( 22 ) and Twenty- sever ( 27 ) to a point on the South line of said Section Twenty-seven ( 27 ) near the South Quarter corner of said Section 27 . Into this main ditch the owners of lands in said district may run side drains of either tile or open ditch as may be found necessary to drain the adjacent lands within the boundaries of said proposed drainage district . The width of said main ditch will be approximately five feet on the bottom , with side slopes of 1 to 1 , and constructed upon a grade of about 17 feet per mile; that the approximate location of said main ditch that is proposed to be constructed and the owners of each tract of land through which the same runs , and which will be drained by said system of ditches , is shown upon a map of said proposed drainage district hereto attached and made a part of this petition , and to which reference is made . SIXTH: The proposed name of said Drainage District is "THE BOX ELDER DRAINAGE DISTRICT . " • 488 SEVENTH : Your petitioners , for the establishment of said drainage district , respectfully select and designate three of your petitioners , to -wit : Charles E. Romans Carl L. Gordon , and Wayne McNeal as a committee to present this petition to the Honorable Board of County Commissioners of Weld County , Colorado , and who shall give notice of the time and place of the presentation of said petition to the Board of County Commissioners and that the Board , upon the hearing of said presentation , shall hear said petition and appli - cations for exclusion of lands from said district and application for the inclusion of land therein and that when the boundaries of said drainage district shall havebeen determined by the Board , that the Board then make an order allowing the prayer of said petition , defining and establishing the boundaries thereof and designating the name of the proposed drainage district , and your petitioners , upon presentation of said petition as required by law , respectfully pray that your Honorable board order an election to be held within the pro- posed drainage district for the purpose of determining whether or not said district shall be organized , and shall cause to be published a notice of said election as required by law , and that upon said election being held and canvassed by your Honorable Board as required by law , if it shall appear that a majority of the votes cast are in favor of the establishment of said drainage district , that your Honorable Board shall make an order that said drainage district is duly organized under the name heretofore designated and that the persons who receive the highest =Tiber of votes respectfully are durly elected directors of said district as provided by law , and that your Board shall cause a certified copy of said order , together with a copy of the plat of said district to be filed with the County Clerk of Weld County, Colorado .
