RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST STEVEN LANCE FOR VIOLATION OF THE WELD
COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Steven Lance, VI #9600101, is allegedly in violation of the Weld County
Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of October, 1997, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Steven Lance, subject property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until December 15, 1997, to allow adequate time for the property
owner to bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Steven Lance to remedy the violation of the Weld
County Zoning Ordinance, and any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for delay of action upon such referral until December 15,
1997, to allow adequate time for the property owner to bring the subject property into
compliance.

Shani Eastin, Current Planner spoke to Steve Lance regarding the
issues of meeting the conditions of approval and recording the plat
for USR-1131.
Thirty -day Zoning Violation Notice sent to the property owner.
Field check meeting with Shani Eastin and Steve Lance.
Progress inspection of the property. The property is still operating
as a roping arena without a valid Special Review permit.
September 18, 1997 Letter sent to the property owner indicating that the violation case was
scheduled before the Board of County Commissioners.
The Roping Arena is still located on the property without a valid Special Review Permit; therefore,
is a violation of Sections 26, 31.2, 31.3, and 31.4 of the Weld County Zoning Ordinance. To bring
the property into compliance all conditions of approval for USR-1131 must be met and the plat must
be recorded or the commercial roping arena and all structures associated with the commercial use
may be removed from the property. A Flood Hazard Development Permit may still be required for
any structures remaining on the property.
The Department of Planning Services also recommends that the County Attorney authorize legal
action against any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties.

The uses on the above described property are being considered as a zoning violation of Section 26, 31.2,
31.3, and 31.4 of the Weld County Zoning Ordinance.
The violation can be corrected by completing all conditions of approval for the Special Review Permit
(USR-1131), obtaining a Flood Hazard Development Permit, obtaining any required building permits
and recording the plat map. Another alternative would be to remove the commercial roping arena and all
structures associated with the commercial use. A Flood Hazard Development Permit may still be
required for any structures not removed from the site.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have 30 (Thirty)
days from August 6, 1997 to correct this zoning violation. Failure to do so will result in this office
scheduling the violation before the Board of County Commissioners to consider whether to refer the
violation to the County Attorney's office for legal action.
Any information you have that may help to resolve this matter will be helpful. This office is ready to be
of any assistance in clarifying or answering questions concerning this matter. Please call or write the
Department of Planning Services' office.

I spoke with Mr. Lance today, July 22, 1997, regarding the status of completing his USR. More specifically meeting
all C/A. He indicated that he may be selling his property to a sand and gravel operation. I indicated that he would
need to send a letter to our office explaining why he is unable to complete the C/A. I also informed him that he is still
in a Zoning Violation on his property. He stated he understood this and that he was not really operating the facility
like he was last summer. I once again stated that he would need to submit information to our office and that until he
finalized the USR he was in violation.
