HomeMy WebLinkAbout951775.tiffBEFORE THE WELD COUNTY, COLORADO, PLANNING COMMISSION RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS Moved by Curt Moore that the following resolution be introduced for passage by the Weld County Planning Commission. Be it resolved by the Weld County Planning Commission that the application for: CASE NUMBER: Z-495 NAME: Quinlan Construction Inc. ADDRESS: 5540 Central Ave., Boulder, CO 80301 REQUEST: Change of Zone from C-3(Commercial) to PUD (Planned Unit Development) for C - (Commercial) Uses LEGAL DESCRIPTION: Lot 2 of RE -1201 in part of the W2 SW4 of Section 11, T2N, R68W of the 6t4 P.M.; Weld County, CO LOCATION: East of and adjacent to Interstate 25 Frontage Road and north of Weld County Road 22 be recommended favorably to the Board of County Commissioners for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 28.5 of the Weld County Zoning Ordinance. 2. It is the opinion of the Planning Commission that the applicant has shown compliance with Section 28.8 of the Weld County Zoning Ordinance as follows: The proposed Planned Unit Development (PUD) District is located within the 1-25 Mixed Use Development Area (I-25 M.U.D.). The uses associated with the proposed PUD District are consistent with the uses identified in the I-25 M.U.D. Conceptual Land Use Plan of the Weld County Comprehensive Plan. The uses allowed in the proposed PUD District will conform to the Performance Standards set forth in Section 35.3 of the Weld County Zoning Ordinance. The uses permitted shall be compatible with the existing or future development of the surrounding area as permitted by the existing zoning, and with the future development as projected by the Comprehensive Plan. Surrounding land uses include outside storage and a contracting business, vacant commercial ground, manufactured home sales and Interstate 25 right-of-way. Adequate water and sewer service will be made available to the property to serve the proposed uses. Central Weld County Water District and St. Vrain Sanitation District will provide water and sewer service to the site. Highway facilities providing access to the property are adequate in functional classification, width, and structural capacity to meet the traffic requirements of the proposed commercial uses. I-25 Frontage Road will provide access to the PUD, in accordance with the letter from Teresa Jones, Colorado Department of Transportation, dated May 16, 1995. No overlay districts, restrictive soil conditions, or commercial mineral deposits are known to be located on the subject site. 951775 WELD COUNTY PLANNING COMMISSION MEETING PAGE 2 This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Planning Commission's recommendation for approval is conditional upon the following: 1. The Change of Zone plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of the date of approval by the Board of County Commissioners. 2. The following notes shall be placed on the PUD District plat: a. Uses allowed within the PUD District shall comply with uses identified in the C-3 (Commercial) District as set forth in Section 33.4 of the Weld County Zoning Ordinance. b. A site plan review shall be required for all uses within the PUD, in accordance with Section 33.4.5 of the Weld Countyloning Ordinance. C. All streets within the PUD District are private and shall be built to County standards. All streets within the PUD District shall be maintained by the lot owners of the PUD District. st. Central Weld County Water District shall provide the PUD District water supply. E. St. Vrain Sanitation District shall provide sewer service to the PUD District. f. Installation of utilities shall comply with Section 10 of the Weld County Subdivision Regulations. g. Each lot within the PUD shall be developed with no less than 15 percent open space. h. Landscaping within the 1-25 Frontage road right-of-way on Lots 1 or 2 shall be maintained in such a way that it does not impair site distance at any access, does not present a safety hazard to the travelling public on the 1-25 Frontage Road, and shall be maintained by the respective lot owners. No trees shall be allowed within the 1-25 Frontage road right-of-way. 3. The PUD Plan application submittal shall contain the following information: a. Identify a location on the PUD plan plat where potential oil and gas uses will occur within the RUD District. b. Document the applicants willingness to satisfy concerns expressed by Teresa Jones, Colorado Department of Transportation, regarding future addition of auxiliary lanes to the 1-25 Frontage Road, drainage, utility permit and temporary state highway access permit, in her letter dated May 16, 1995. c. Evidence that all permits required by the Department of the Army Corps of Engineers have been obtained for this PUD development. 951775 WELD COUNTY PLANNING COMMISSION MEETING PAGE 3 Motion seconded by Jack Epple.
