RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST ROSAMARIA CASTILLO FOR VIOLATION OF THE WELD COUNTY
BUILDING CODE ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Rosamaria Castillo, BCV #2187, is allegedly in violation of the Weld County
Building Code Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 20th day of June, 1995, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Rosamaria Castillo, property owner, was not present or represented at said
hearing, although all parties were notified of said hearing by Department of Planning Services staff,
and
WHEREAS, the Board deems it advisable to bring legal action against the individual as
hereinabove named to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Rosamaria Castillo to remedy the violation of the Weld County Building Code
Ordinance, and any other persons occupying the properties, any persons claiming an interest in
the properties, and any persons acting in active concert with the identified parties.

The installation of the mobile home without the appropriate permits is a violation of Section 70 of the Weld
County Building Code Ordinance. To correct the violation a mobile home building permit must be applied for
and approved or the mobile home must be removed from the property.
The Department of Planning also recommends that the County Attorney Authorize legal action against any
other persons occupying the properties, any persons claiming an interest in the properties, and any persons
acting in active concert with the identified parties.

Subject: BCV-2187 A Building Code Violation on a parcel of land described as Lot 44,
Espanola Subdivision, Weld County, Colorado.
Dear Ms. Castillo
As of June 6, 1995 the the mobile home located on the above property without the appropriate
permits remains in violation of the Weld County Building Ordinance. I have scheduled a hearing
with the Board of County Commissioners on Tuesday, June 20, 1995 at 10:00 a.m. to consider
this Building Code Violation. This hearing will take place in the County Commissioners' Hearing
Room, first floor, Weld County Centennial Center, 915 Tenth Street, Greeley, Colorado.
The property will be reinspected on June 19, 1995 to determine if the property is in compliance.
If at this time the mobile home is still located on the property without the appropriate permits than
it is recommended that you or a representative attend the hearing to answer any questions the
Board of County Commissioners may have concerning this violation. If the appropriate permits
have been applied for and issued than it will not be necessary for you to attend the hearing.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation, the
action necessary to correct the violation, and that you were given sufficient time to remedy the
violation.

County Building Code Ordinance.

It is the intention of this office to assist and cooperate with the residents of Weld County without imposing
undue hardships. Any information you have regarding this matter would be appreciated. However, if you
fail to correct this violation by June 1, 1995, we have no discretion but to refer the violation to the County
Attorneys' office for legal action.
Please call or write the Department of Planning Services' office within five days of receipt of this letter to
resolve this issue.
