RE: ACTION OF BOARD AT SHOW CAUSE HEARING CONCERNING SPECIAL REVIEW
PERMIT #820 - HUSKER DAIRY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on November 5, a Show Cause Hearing was conducted to consider
revocation of Special Review Permit #820 for a Livestock Confinement Operation (2,500 -head
dairy) in the A (Agricultural) Zone District, currently held by Husker Dairy, % Gene Hoyer,
owner, P.O. Box 69, Broken Bow, Nebraska 68822, and
WHEREAS, Gene Hoyer is the owner of the facility located on property described as Lot
B of Recorded Exemption #655, being further described as part of the SW% of Section 15,
Township 6 North, Range 64 West of the 6th P.M., Weld County, Colorado, and
WHEREAS, at said hearing of November 5, 1997, Planning and Health Department
staffs recommended continuation of said Show Cause Hearing to May 6, 1998, with three
conditions, as listed below, and
WHEREAS, having heard all of the testimony presented, the Board deems it advisable
to continue said Show Cause Hearing to May 6, 1998 at 10:00 A.M., conditional upon the
following:
1. The facility take every reasonable attempt to control any discharge from the
facility except those allowed by the Confined Animal Feeding Operation Control
Regulations.
2. The facility submit a post -construction report demonstrating that the containment
pond was constructed in accordance with the Confined Animal Feeding
Operation Control Regulations. The report shall be submitted to the Health and
Planning Departments. The staff is authorized, upon ten (10) days notice, to
schedule a show cause hearing in the event the report is not submitted by
March 1, 1998.
3. The facility submit a final project report following the construction of all
components of the manure and waste water management plan. The report shall
be submitted five (5) business days prior to the scheduled continuance.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Show Cause Hearing concerning revocation of Special Review
Permit #820, issued to Husker Dairy °/0 Gene Hoyer, owner, P.O. Box 69, Broken Bow,
Nebraska 68822, be, and hereby is, continued to May 6, 1998 at 10:00 a.m., with three
conditions as mentioned above, and the deletion of issue #6 as specified on the notice for said
hearing dated November 3, 1997.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 5th day of November, A.D., 1997.
