KEVIN MACURDY A public hearing was conducted on September 22, 1999, at 10:00 a.m., with the following present: Commissioner Dale K. Hall, Chair Commissioner Barbara J. Kirkmeyer, Pro-Tern Commissioner George E. Baxter Commissioner M. J. Geile Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Carol A. Harding Assistant County Attorney, Lee Morrison Planning Department representative, Anne Best Johnson Health Department representative, Sheble McConnellogue Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated September 8, 1999, and duly published September 11, 1999, in the Fort Lupton Press, a public hearing was conducted to consider the request of T. Kevin Macurdy for a Home Business (masonry construction company) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Anne Best Johnson, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Johnson stated the site is 2.97 acres, the access is from Weld County Road 10, and the application includes the expansion of one building. She also stated a violation currently exists; however, approval of the Use by Special Review Permit will clear the violation. Ms. Johnson stated the application is in compliance with the Weld County Zoning Ordinance and the Weld County Comprehensive Plan. Responding to Commissioner Geile, Ms. Johnson stated the geological hazard area is from undermining, for which the applicant does have a permit; and the two underground storage tanks will be removed. Kevin Macurdy, applicant, stated the underground fuel tanks were disposed of two days ago at Western Metals in Denver. Responding to Chair Hall, he said he does concur with the Conditions of Approval and Development Standards. Responding to Commissioner Geile regarding Development Standard #4, Sheble McConnellogue, Weld County Department of Public Health and Environment, stated it was added because he will be doing some cutting and soldering. 992351 PL1239 HEARING CERTIFICATION - T. KEVIN MACURDY (USR #USR #1239) PAGE 2 Commissioner Kirkmeyer explained to the applicant that he cannot conduct Special Review activity on the site until the violation is closed, which will require recording the plat. No public testimony was offered concerning this matter. Commissioner Geile moved to approve the request of T. Kevin Macurdy for a Site Specific Development Plan and Special Review Permit#USR #1239 for a Home Business (masonry construction company), in the A (Agricultural) Zone District based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Vaad, and it carried unanimously. This Certification was approved on the 27th day of September, 1999.
