SUBJECT: USR-1162, Spanish Assembly of God
The Weld County Public Works Department has reviewed this proposal; the following conditions are recommended
to be a part of any approval:
1. WCR 15.5: WCR 15.5 between WCR 22 and Elm Drive is not County maintained or improved. It is identified
in the Enchanted Hills Subdivision Recorded Plat, but was never developed. In the dedication, 59 feet were
dedicated as a right-of-way with one -foot identified as Out Lot A on the Enchanted Hill Subdivision plat. The
one foot strip of land was deeded to the County, making WCR 15.5 a 60 foot right-of-way.
The applicant has indicated that WCR 15.5 would be upgraded to allow two-way traffic to and from the site.
The applicant shall enter into a Road Improvements Agreement to upgrade and pave WCR 15.5. The
Agreement will require the applicant to: grade the road, provide adequate drainage, build a 4 inch aggregate
base with two foot aggregate shoulders, and a 24 feet wide paved road with two inches of asphalt.
The Agreement will also include upgrading and paving the small section of WCR 22 from the end of the
pavement to WCR 15.5. Weld County will accept WCR 15.5 for maintenance when it has been completed
to County Standards.
2. Enchanted Hills Subdivision: There are two existing roads (Elm and Maple) through the Enchanted Hills
Subdivision to WCR 15.5 that may be utilized to access the proposed church. WCR 15.5 will serve as a
primary access road to the facility when developed.
3. Parking Lot: I recommend that the proposed parking lot be paved, striped, and curbed with adequate spaces
to accommodate the membership in accordance with Weld County Zoning Ordinance Section 41, Off-street
Parking requirements.
4. Storm Water Drainage: The applicant needs to submit a storm water drainage plan in accordance with
Section 10,12 of the Subdivision Ordinance to handle the storm water drainage on and off the facility prior to
recording the plat.

Dear Ms. Keithley:
I have reviewed the submitted material pertaining to the Spanish Assembly of God Church (Case
Number: USR-1162). The property is within the boundaries of the Mountain View Fire
Protection District and receives fire protection from the District. The Fire District does not
object to the project and has the following comments regarding the project:
• Buildings shall be designed and constructed in accordance with the provisions of the 1994
Edition of the Uniform Fire Code, as adopted by the Weld County Commissioners, and the
1994 Edition of the Uniform Building Code, as enforced by the Weld County.
• Minimum fire flow requirements for buildings are prescribed in Appendix III -A of the
Uniform Fire Code. Fire flow is the rate of the water supply, measured at a residual pressure
or 20 pounds per square inch, that is available for firefighting. Required fire flows vary with
the nature of the occupancy as well as building size and type of construction. The minimum
required fire flow for buildings, other than one- and two-family dwellings, is never less than
1,500 gallons of water per minute and may be as much as 8,000 gallons of water per minute.
The required fire flow and the number of fire hydrants that will be required will be
determined when more information is known about the building layout, type of construction
and size.
• A final site plan and building construction plans will need to be submitted by the
developer/general contractor to the Fire District for review and approval.
• Construction plans for the utilities must be submitted to the Fire District for review and
approval. The developer should be made aware that all fire hydrants and water mains must
be approved before combustible building materials are delivered to the site.
• A final inspection of the occupancy will be required by a member of the Fire District before
a Certificate of Occupancy is issued from Weld County.

Environmental Protection Services has reviewed this proposal; the following conditions are recommended to
be part of any approval:
1) No permanent disposal of wastes shall be permitted at this site.
2) Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions.
3) Fugitive dust shall be controlled on this site.
4) The maximum permissible noise level shall not exceed the commercial limit of 60 db (A) as measured
according to 25-12-102, Colorado Revised Statutes.
5) Adequate toilet facilities shall be provided for the public and employees.
6) The septic system is required to be designed by a Colorado Registered Professional Engineer
according to the Weld County Individual Sewage Disposal Regulations. In the event the hydraulic
flow from the septic system is greater than 2000 gal/day the system must be approved through the
site application process ( in accordance with the Regulations for the site application process, (5CCR
1002-12).

We have the following comments relative to the noted applicati

Land Use
Relative to the Town of Firestone's Comprehensive Plan Map, the subject
property is located near the boundary between the Residential Low Density and
Residential Medium Density areas. Based on the mapping we have received, it
appears that the subject property is almost completely within the Residential
Low Density area.
Religious institutions are not specifically identified on the Town's
Comprehensive Plan Map. However, it should be noted that Religious
churches, synagogue and temples are permitted in all land use categories
within a Planned Unit Development (Ref. Section 7.16.13 Firestone
Development Regulations), although such uses may be subject to additional
review or approval procedures. They are also permitted in certain standard
districts such as an R-1 (where a minimum one -acre lot size and 50 -foot
setback applies; Ref. Section 17.16.010 Firestone Municipal Code).
We might also note that the size, architectural character, etc. of the proposed
structure and activity level may be incompatible with the Town's current policy of
higher quality development standards associated with new larger scale
developments within the Town's Urban Growth Boundary; especially within
residential areas.
Intergovernmental Agreement ("IGA")
The subject property is within the Town of Firestone's Urban Growth Boundary.
Because the application is for Use by Special Review for neither a commercial
or industrial use, it appears that the applicant would not need to execute an
annexation agreement with the Town of Firestone pursuant to Section 4.3 (b) of
the IGA.

Section 4.3 (f) of the IGA specifically addresses street standards which are
particularly important for this application. As you may know WCR 15-1/2 has not
been improved in this area. Additionally, there may be significant traffic impacts
to WCR 22 and Elm and Maple Streets.
To the extent there are impacts on Town Streets, the owner should be required
to acknowledge the applicability and/or future applicability of the Town's access
code and road improvement standards.
Additional Comments
We will again be discussing this application at our Board meeting this
Thursday. We will transmit to you any additional comments that may be
generated at that meeting.
