RESOLUTION
RE: APPROVAL OF SUBDIVISION EXEMPTION #576 - CLAUS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10)(d), CRS, as amended, and Section 2-19 of the Weld County Subdivision
Regulations, did determine at a public meeting held in the Chambers of the Board, that certain
parcels of land to be divided, as shown on the plat known as Subdivision Exemption #576, does
not come within the purview of the definition of the terms, "subdivision" and "subdivided land," and
WHEREAS, the request for Subdivision Exemption#576 was submitted by Clayton Claus,
3759 Weld County Road 36, Platteville, Colorado 80651, for property which is located in part of
Section 3, Township 3 North, Range 68 West of the 6th P.M., Weld County, Colorado, being more
particularly described in the plat which shall be provided by the applicant and known as Exhibit "A",
said plat to be recorded, and
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the above described parcels of land be, and hereby are, declared to be
exempt from the definitions of "subdivision" and "subdivided land" as set forth in Section
30-28-101(10), CRS, as amended, and Section 2-19 of the Weld County Subdivision Regulations.
BE IT FURTHER RESOLVED by the Board that approval of Subdivision Exemption #576,
submitted by Clayton Claus, be, and hereby is, conditional upon the following:
1. A Weld County septic permit is required for the proposed home septic system and
shall be installed according to the Weld County Individual Sewage Disposal System
(ISDS) regulations.
2. Any existing septic system(s) which is not currently permitted through the Weld
County Health Department will require an ISDS evaluation prior to the issuance of
the required septic permit(s). In the event the system(s) is found to be inadequate,
the system(s) must be brought into compliance with current ISDS regulations.
3. Prior to recording the plat:
a. An easement shall be dedicated for the benefit of Lot B of the recorded
exemption and the subdivision exemption lot, in accordance with Section
11.7.1.12.2 of the Weld County Subdivision Ordinance, as amended.

b. The applicant shall submit evidence to the Department of Planning Services
that any existing septic system(s) which is not permitted through the Weld
County Health Department has received an ISDS evaluation.
4. The applicant shall submit a mylar plat to the Department of Planning Services to be
recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.
BE IT FURTHER RESOLVED by the Board that the applicant shall submit a mylar plat to
the Department of Planning Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be drawn in accordance with the requirements of Section 11.13.9 of the
Weld County Subdivision Regulations. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be responsible for paying
the recording fees.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 25th day of March, A.D., 1996.

On April 12, 1996, an evaluation of the existing individual septic disposal
system at 3759 Weld County Road 36, Platteville, Colorado; Section 03, Township
03 North, Range 68 West, was conducted by Sheble McConnellogue.
The existing individual septic disposal system is of sufficient size and capacity
to adequately handle the proposed load. A copy of the evaluation has been
forwarded to the Department of Planning Services.

Gentlemen :
On October 6 , 1995 this office on behalf of Clayton Claus
submitted a Recorded Exemption application . Pursuant to our
request , this application has been on " hold " . At this time we are
withdrawing the October 6 , 1995 application due to the fact that we
submitted a modified application for Recorded Exemption and
Subdivision Exemption during January , 1996 .
We would request a refund of any " unused " application sums
paid during October of 1995 .
