HomeMy WebLinkAbout971007.tiffRESOLUTION RE: GRANT SITE SPECIFIC DEVELOPMENT PLAN AND PLANNED UNIT DEVELOPMENT (PUD) FINAL PLAN, S #418, FOR C-3 (COMMERCIAL) USES - FLATIRON STRUCTURES COMPANY, C/O QUINLAN CONSTRUCTION, INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a public hearing was held on the 21st day of May, 1997, at 10:00 a.m. for the purpose of hearing the application of Flatiron Structures Company, c/o Quinlan Construction, Inc., 5540 Central Avenue, Boulder, Colorado 80301, requesting a Site Specific Development Plan and Planned Unit Development (PUD) Final Plan, S #418, for C-3 (Commercial) uses for a parcel of land located on the following described real estate, to -wit: Lot 2 of RE #1201, in part of the W1/2 SW1/4 of Section 11, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, the applicant was represented at said hearing by Gary Shaw, Vice President of Quinlan Construction, Inc., and WHEREAS, Section 28.14 of the Weld County Zoning Ordinance provides standards for review of such a Final PUD Plan, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission, and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The applicant has complied with all the application requirements listed in Section 28.9 et seq., of the Weld County Zoning Ordinance. 2. The request is in conformance with Section 28.14 of the Weld County Zoning Ordinance as follows: A. Section 28.13.1.1 - The proposal is consistent with the Weld County Comprehensive Plan. The applicant has demonstrated that the proposed PUD Final Plan meets the Mixed Use Development, Planned Unit Development, and Commercial goals and policies of the Weld County Comprehensive Plan. Pig Oa; 74.4/Ret PL0999 PUD FINAL PLAN - FLATIRON STRUCTURES COMPANY, C/O QUINLAN CONSTRUCTION (S #418) PAGE 2 Section 28.13.1.2 - The PUD Final Plan conforms to the approved PUD District in which it is proposed to be located. The subject property shall be required to maintain compliance with the standards of Sections 28 and 33 of the Weld County Zoning Ordinance, as well as the requirements of Ordinance No. 191. In addition, the utility plan for the PUD was conditionally approved by the Weld County Utility Coordinating Advisory Committee on March 13, 1997. C_ Section 28.13.1.3 - The uses, buildings, and structures which would be permitted shall be compatible with the existing or future development of the surrounding area as permitted by the existing zoning and with the future development as projected by the Comprehensive Plan or master plans of affected municipalities. The proposed PUD Final Plan is compatible with the future development as permitted by the PUD District and plans of affected municipalities. The City of Longmont, Town of Mead, and the Tri-Area Planning Commission reviewed the request and have no objection to the land use as proposed. D. Section 28.13.1.4 - The PUD Final Plan conforms with the Performance Standards outlined in Section 35.3 of the Weld County Zoning Ordinance. Prior to the development of Lots 1, 3, and 4 of the Flatiron PUD, completion of a Site Plan Review application as set forth in Section 23 of the Weld County Zoning Ordinance will be required. E. Section 28.13.1.5 - There will be compliance with Section 50, Overlay Districts, of the Weld County Zoning Ordinance. The property is not located within any of the Overlay Districts. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Flatiron Structures Company, c/o Quinlan Construction, Inc., requesting a Site Specific Development Plan and Planned Unit Development (PUD) Final Plan, S #418, for C-3 (Commercial) uses on the above referenced parcel of land be, and hereby is, granted subject to the following conditions: 1. Prior to approval of the Improvements Agreement According to Policy Regarding Collateral for Improvements by the Board of County Commissioners, the agreement shall be amended to identify Flatiron Structures Company, LLC, as the entity responsible for installation and maintenance of the landscape materials listed in the agreement and as shown on the landscape map. 971007 PL0999 PUD FINAL PLAN - FLATIRON STRUCTURES COMPANY, C/O QUINLAN CONSTRUCTION (S #418) PAGE 3 2. Prior to recording the PUD Final Plan plat: A. The Board of County Commissioners shall review and approve the Improvements Agreement According to Policy Regarding Collateral for Improvements (Private Road Maintenance) including the form of collateral. The security for the agreement shall be tendered and accepted by the Board of County Commissioners. The Flatiron PUD covenants shall be approved by the Weld County Attorney's Office and be ready for recording in the Office of the Clerk and Recorder. C. The PUD Final Plan plat shall be amended as follows: Interior lot line utility easements, minimum total width of twenty (20) feet apportioned equally on abutting properties, shall be shown on Lots 1, 3, and 4, as required by the Utilities Coordinating Advisory Committee. ii. The landscape map shall clearly identify the easement and detention pond areas for use as open space on the site. The mylar copy shall delineate the species, number, and location of landscape materials to be installed by the property owner at the entrance to the PUD, as required in Sections 28.11.4.2 through 23.11.4.7 of the Weld County Zoning Ordinance. 3. Prior to the release of any future building permits within the Flatiron PUD: A. Evidence that all requirements of the St. Vrain Sanitation District, as stated in a letter from Lee Lawson dated February 3, 1997, have been satisfied shall be provided to the Department of Planning Services. B. The property owner/developer shall have an off -site road agreement addressing construction of public improvements on the east 1-25 Frontage Road reviewed and approved by the Colorado Department of Transportation and the Weld County Attorney's Office. The agreement and form of collateral shall be accepted by the Board of County Commissioners and security tendered. 4. The following notes shall be placed on the PUD Final Plan plat prior to recording: A. The uses permitted within the PUD Final Plan for Flatiron Structures Company include 4 (four) lots for C-3 (Commercial) uses which comply with PUD District requirements and as described in the application materials. 971007 PL0999 PUD FINAL PLAN - FLATIRON STRUCTURES COMPANY, C/O QUINLAN CONSTRUCTION (S #418) PAGE 4 Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. C. Central Weld County Water District shall provide water service to all uses within the Flatiron PUD. St. Vrain Sanitation District shall provide sewage disposal to the Flatiron PUD. E. Installation of all utilities shall comply with Section 10, Design Standards, of the Weld County Subdivision Ordinance. F. All uses within the Flatiron PUD shall maintain compliance with the Mountain View Fire Protection District requirements. G. A 30 (thirty) -foot shared access easement (Book 1246, Reception No. 02193215, 9/29/89) from 1-25 Frontage Road shall provide ingress and egress to the property. H. The cul-de-sac within the Flatiron PUD is private and shall be built to County standards. The cul-de-sac shall be maintained by the lot owners or developer. All uses within the Flatiron PUD shall maintain compliance with the Colorado Department of Transportation requirements. J. All uses within the Flatiron PUD shall maintain compliance at all times with the U. S. Army Corps of Engineers' requirements and standards. K. All development shall be subject to the PUD District requirements as set forth in COZ #495, approved by the Board of County Commissioners on July 12, 1995. L. The Flatiron PUD shall comply with signage and setback requirements as set forth in Ordinance No. 191 and Section 42.3 of the Weld County Zoning Ordinance. M. Prior to the development of any lot within the Flatiron PUD, a Site Plan Review application shall be submitted to and approved by the Department of Planning Services and all conditions met, in accordance with Section 35.4 of the Weld County Zoning Ordinance and Ordinance No. 191. 971007 PL0999 PUD FINAL PLAN - FLATIRON STRUCTURES COMPANY, C/O QUINLAN CONSTRUCTION (S #418) PAGE 5 In accordance with the submitted application materials, open space/landscape area per lot shall be equal to (meet) or exceed: Lot 1: 26% Lot 3 18% Lot 4 23% O. All requirements of the St. Vrain Sanitation District regarding completion of the sewer line shall be met prior to the release of any future building permits within the Flatiron PUD. P. Prior to the issuance of each building permit, the Flatiron PUD Architectural Control Committee shall provide a letter to the Department of Planning Services indicating its approval of the proposed structure. Q. All construction on site shall meet the requirements of the Weld County Building Inspection and Public Works Departments, the Weld County Zoning and Subdivision Ordinances, and the approved covenants. 5. The PUD Final Plan plat shall meet all requirements of Section 28.11.5 as set forth in the Weld County Zoning Ordinance and be submitted to the Department of Planning Services within 30 days of approval by the Board of County Commissioners.
