Examples of such uses allowed within the Estate Zone District are, but not limited to, one single family dwelling per legal lot, light agricultural and/or livestock environments such as equestrian or 4-H Club projects and accessory buildings as per bulk requirements. Building envelopes are also proposed to protect views and ensure consistent house and out-building locations. A Homeowners Association is proposed for this Minor Subdivision (please find enclosed copy of HOA Conditions and Restrictive Covenants). These covenants are not intended to circumvent the existing zone district restrictions, but to isolate and further regulate certain aspects of a bulk requirement. 4. A concern did arise regarding the Oil/Gas facilities on the site. Doug Campbell, a representative for Patina Oil and Gas was present at the Board of County Commissioners meeting for zone change approval on July 15, 1998. He expressed concern with all underground gas/oil lines possibly not being located through the process. A second meeting was held in the field with a Patina representative (Emery) on July 28, 1998. It was decided that all underground facilities had been located correctly within this Minor Subdivision as annotated through the Sketch Plan and Zone Change procedures. -Page 1 - 18. Please find enclosed, a Drainage Report dated August 3, 1998 as prepared by Foundation Engineering. Also please find a Final Drainage Plan as required by Section 10.12 and 10.13 of the Weld County Subdivision Ordinance. 19. Please find enclosed a list of the surrounding property owners within 500' as prepared by APO of Colorado. 20. There is an existing well head and tank battery currently located within the proposed Minor Subdivision. A meeting took place at the site on 12-29-97 with the Oil and Gas Company representatives (Patina and Duke) and the applicant. The meeting was arranged to discuss this proposal and to acquire locates of their underground facilities (buried pipelines) to ensure the protection of said facilities and the proper placement of easements,access points and setbacks. They had no conflicts or objections with this proposal as long as setbacks, access and facility easements are addressed through the process. Please find enclosed a list of the mineral owners and lessees having an interest in the subject property as prepared by D&M Services. 22. This proposal complies with the Weld County Comprehensive Plan and the zone district in which the proposed use is located in many ways. For example: Section 21.6.2.1 • Agricultural Goal 4 — This proposal is providing 5 Estate Residential Lots within the County. This site is nonprime farmground thus insuring the preservation of quality farmground to remain in production. The Goal states to provide a mechanism for the division of land, which is agriculturally zoned, but to maintain and enhance productive ground. The size of the proposed lots could lend for continuance of agricultural activity, however small,the thinking and making of an Ag based county still would remain as a top priority. Building envelopes and setbacks are also proposed for each individual lot to aid in the protection of views and ensure consistent house and out-building locations as well as minimizing the impacts on surrounding agricultural uses. • Agricultural Goal 6 - Major utilities such as water, electric and telephone are adjacent to the siteand readily available. • Agricultural Goal 7 —The "Right to Farm Covenant" shall be placed on the Final Plat in an effort to provide a measure of protection to adjacent farming activities as well as alerting potential lot owners that long standing agricultural activities shall not surrender to residential uses. • Residential Goal 2 and 3 — As stated above, major utilities such as water, electric and telephone are adjacent to the site and readily available. -Page 3- 982303 Section 21.6.2.2 • The uses allowed on the subject property are compatible with the surrounding land uses. The proposed site does not lie within an urban growth area, and we are not proposing an urban scale development. Section 21.6.2.3 • Adequate water and sewer service can and will be made available to the site to serve the uses permitted within the proposed Minor Subdivision. Water will be provided by North Weld County Water District and each lot will have an Individual Sewage Disposal System. Section 21.6.2.4 • County road facilities providing access to this development are adequate in size to meet the requirements for this proposal. 23. This site has limited agricultural value. The easterly portion of the site is basically not being farmed due to soil conditions. These conditions have been addressed and can be overcome, if needed, by ways of engineered foundations and septic systems. This leaves approximately 25 acres,at best,with limited agricultural possibilities. Dividing this site into 5 lots,with irrigation water provided to each lot, seems to be a good way to provide for small agricultural projects for each individual lot in attempt to continue agricultural activities. 24. Domestic water and water for Fire Protection shall be provided by North Weld County Water District (see attached water letter dated April 13, 1998). Currently NWCWD has a watermain within Weld County Road No. 66. This proposal will tap into said watermain and install a watermain from WCR 66 to the proposed cul-de-sac within the Minor Subdivision. The proposed watermain will be installed per NWCWD Standard Requirements and Specifications. Each lot shall have an individual water meter. 25. Each lot for the proposed Minor Subdivision shall have an Individual Sewage Disposal System (ISDS) installed per the Weld County Health Department requirements and specifications. Please see enclosed Preliminary Subsurface and Percolation Investigation Report as prepared by Foundation Engineering. This report indicates that 4 of the 5 sites tested are suitable for allowing absorptive septic systems. 26. Please see enclosed Geologic and Mineral Evaluation Report as prepared by Foundation Engineering. This report identifies possible conditions within the site and methods to overcome these possible hazards. The report concludes that the development intended is compatible with the geologic conditions at the site. 27. The internal roadway shall consist of two(2) 10' driving lanes and have a depth of four(4)inches of gravel base (see attached road plan and profile sheet). This typical street cross section should be adequate in functional classification as well as structural capacity to meet the traffic requirements of this Minor Subdivision. All lots within this proposal shall have access onto the internal road system only. No lots shall be permitted to access directly onto Weld County Road No. 66. 28. Weld County Road No. 66 is classified as a Locator road. Its width and structural appearance should have the ability to handle the increased traffic load of this proposed 5 Lot Minor Subdivision. State Highway 392 is approximately 1.5 miles northeast of this site providing arterial road transportation to and from many destinations. -Page 4- 982303 29. The construction of the internal road system shall be the responsibility of the developer. Maintenance, snow removal, and other matters pertaining to the internal road system of the Minor Subdivision shall be the sole responsibility of the Homeowners Association as established and enclosed herein. 30. This proposed Minor Subdivision is not part of or contiguous with a previously recorded subdivision or unincorporated townsite. 31. There will be no on-street parking permitted within this Minor Subdivision as set forth within the HOA Conditions and Restrictive Covenants. 32. No additional access shall be permitted onto W.C.R. 66 other than the access approved through the Minor Subdivision process. There is an existing entrance off of WCR 66 to an OillGas tank battery. We propose this access to remain in place; however, a note shall be placed on all applicable maps indicating the restrictive use of said access to the tank battery by OillGas traffic only. 33. All lots within this development shall have access onto the internal road system only. No lots shall be permitted to access directly onto Weld County Road No.66. 34. Facilities providing drainage and stormwater management will be according to the Final Drainage Report and Final Drainage Plan enclosed herein and shall be adequate to serve the site. 35. The maximum number of lots for this Minor Subdivision shall not exceed five(5)lots. 36. Service Impacts: • Schools — The school district responded as a referral agency and found no conflicts with this proposed Minor Subdivision. Law Enforcement - This Minor Subdivision will be served by the Weld County Sheriffs Department for protection and safety. We are assuming that no additional patrols will be needed for the additional 5 lots proposed. Fire Protection - This development will be served by the Plattevalley Fire Department. Due to the location of this site, it is our belief that the impact shall be minimal to the Fire District. It is our intent to meet the Fire District's needs for fire flow and access. Construction shall comply with all codes as adopted by the Weld County Commissioners. Ambulance-Ambulance service will be provided by Weld County Ambulance. The Plattevalley Fire Department as well as Air Life of Greeley will provide additional emergency service. Again, we feel that with the additional 5 lots proposed, minor impact shall occur regarding Ambulance service. Law Enforcement, Fire Protection and Ambulance services are based on an as needed basis. I .. . -- Steve Stencel Project Manager -Page 6- 982303 DECLARATION OF COVENNANTS CONDITIONS AND RESTRICTION FOR GRANDVIEW ACRES MINOR SUBDIVISION ARTICLE I—PREAMBLE Declarant is the owner of that certain real property situate in Weld County, Colorado, described on Exhibit "A" hereof(the property). The Property has been platted as Grandview Acres Minor Subdivision simultaneously with this declaration. Declarant desires to develop the Property for residential purposes. Declarant deems it desirable to subject the Property to the covenants, conditions and restrictions set forth in this Declaration in order to preserve the values of the individual lots and to enhance the quality of life for all owners of such lots. Declarant therefore declares that all of the Property is and shall be held, transferred, sold, conveyed and occupied subject to the terms, restrictions, limitations, conditions, covenants, obligations, liens, right of ways;and easements which are set fort in the Declaration, all of which shall run with the Property and shall inure to the benefit of, and be binding upon, all parties having and right, title, or interest in the Property or and portion thereof, and such person's heirs, grantees, legal representatives, successors and assigns. Any restrictions or regulations not addressed specifically shall be in accordance with Weld County Estate Zoning, i.e., number and type of animals allowed on each lot, home occupations. ARTICLE II — DEFINITIONS 2.1 General: The words and terms defined in this Article shall have the meanings herein set forth unless the context clearly indicates otherwise. 2.2 Association: Shall mean and refer to Grandview Acres Minor Subdivision Homeowner's Association, a Colorado Nonprofit Corporation established pursuant to Article IV of this Declaration. The members of the Association shall be Lot Owners as defined herein. 2.3 Common Areas: Shall refer to all real Property or interests therein owned by the Association and easements and rights of way for the common use and enjoyment of the Owners, together with and including, but not by way of limitation, the road Grandview Lane, utilities, and utility easements. 2.4 Developer: Shall mean Larry G. Intermill owner of the Property, their successors and assigns. 2.5 Developer responsibilities: Shall refer to the road constructed pursuant to specifications required by Weld County and the right of adjacent to Grandview Lane. Developer shall install a gravel road according to the specifications of Weld County. The Association shall maintain, repair, and replace the road after the Developer has installed such facility. Developer shall plant non-weed vegetation on the right of the way adjacent to Grandview Lane. The Association shall maintain and replace non-weed vegetation after the Developer has planted such vegetation. 982303 2 2.6 Lot: Shall mean and refer to any parcel or plot of land located within the exterior boundaries of the Property described on the Exhibit"A" and owned by the"Owner", with the exception of any"Common Area". In the event; however, that an Owner divides a lot into smaller lots by complying with and satisfying the applicable rules, regulations and ordinances of the County of Weld and State of Colorado, each such resulting smaller parcel will then constitute a "Lot" for the purpose of these covenants. 2.7 Road and Utility Easements: Shall mean and refer to the road Grandview Lane and all utility easements presently existing on the Property or subsequently constructed by the Declarant on the tracts or parcels of the property. "Roads" and"Utility Easements" shall not include private driveways or utility extensions constructed by individual Owners to provide access and utilities to dwellings or other structures located upon such Owner's lot of the Property. 2.8 Single Family Dwelling: Shall mean an independent structure designed and occupies as a residence for a single family. 2.9 Subdivision: Shall mean and refer to Grandview Acres Minor Subdivision. 2.10 Other terms may be defines in specific provisions contained in the Declaration and shall have the meaning assigned by each such definition. ARTICLE III—USE AND OTHER RESTRICTIONS 3.1 Land Use and Building Types: A lot may be used only for one single-family dwelling. The primary residential building must include as a part thereof, a garage, or if a garage is not included as a part of the residence, then a separate garage structure shall have identical architectural design and exterior design and appearance consistent with that of the residence accommodated thereby. 3.1.1 Size: The dwelling space of the residence, exclusive of the garage and open porches, shall contain a minimum of 1,400 square feet of finished non-basement living space. The maximum height of the residence and any accessory building is not to exceed thirty (30)feet. 3.1.2 Pre-constructed Homes: No homes of a pre-constructed nature shall be permitted without prior written approval of the Developer. 3.1.3 Exterior Materials: The exteriors of all residences must be wood, masonry, stone, stucco, or material with a stucco-like appearance. Any vinyl or aluminum sided houses must be approved by developer or Homeowner's Association. 3.2 Accessory Buildings: No more than three (3) accessory buildings in addition to the garage with a maximum square footage of 3,000 sq. ft. total, which are well constructed and neat of appearance, shall be permitted. No buildings with a Quonset type appearance are permitted. 3.3 Fencing: Fencing is to be keeping with the appearance of the surrounding rural setting, i.e., barb or barbless wire fencing, wire fencing, natural wood (unpainted), chain link, vinyl, and livestock panels are allowed. 3.4 Outdoor Storage: Shall be screened from public right of ways and adjacent properties. Tractors and machinery not being used for maintenance of the lot or other applicable use common on a small rural lot, and unlicensed vehicles of any kind will not be permitted on the tots, except in enclosed storage buildings. 3.5 Right of Way and Easements: The area known as Grandview Lane is right of way and is to remain open space; free of buildings, fences, trees, or shrubs. The developer will seed non-weed vegetation in the right of way; and thereafter, the Association will assume responsibility of the maintenance of said right of way. Easements and non-buildable areas for the installation and maintenance of utilities and drainage facilities are reserved as shown on the Plat. Within these easements, no structure, planting or other materials shall be placed or permitted to remain which may damage or interfere with the installation and maintenance of utilities, which may change the direction of flow of drainage in the easements. If any landscaping or structure is installed which violates such 982303 3 requirements in the right of way or easements and drainage areas, the Association may give the Owner written notice to remove such landscaping or structure. If the Owner fails to remove the landscaping or structure within thirty(30) days of receipt of notice, the Association my have such work done at the expense of the Owner of the lot. If the work is done by the Association at the Owner's expense, the Owner shall pay for such work within ten(10) days after notice is given in writing to the Owner as to the cost of such work. In the event of failure to pay within that time and if the Association thereafter incurs any attorney's fees and costs in collecting such amount from the Owner, all such attorney's fees and costs incurred shall likewise by a debt owed by the Owner to the Association. The easement area of each lot and all improvements on it shall be maintained continuously by the Owner of the lot. 3.6 Maintenance of Lots: The owner of each lot shall plant and maintain non-weed vegetation and remove any trash or other debris. If an Owner fails to maintain their lot in accordance with this requirement, the Association shall have the right to plant and maintain non-weed vegetation and remove any trash or other debris solely at the lot Owner's expense. The Owner shall be liable for reasonable attorney's fees and costs incurred by the Association in collecting such charges. 3.7 Nuisances: No noxious or offensive activities shall be carried on upon any lot, nor shall anything be done thereon which may become an annoyance or nuisance to the entire neighborhood. 3.8 Recreational Vehicles: No trailer, motor home, camper unit, boat of similar recreational vehicle shall be parked on Grandview Lane. 3.9 Private Drives: During construction of private drives to individual lots from Grandview Lane, individual lot owners must permanently install a twelve(12) inch culvert in the drainage ditch directly adjacent to Grandview Lane. 3.10 Compliance: Each lot owner shall maintain compliance at all times with the requirements of the Weld County Public Works Department, Weld County Health Department, Division of Wildlife, Platte Valley Fire Department and the Weld County Planning Department. 3.11 Oilfield Production: Oil/gas production vehicles have the right to access their production facilities within the subdivision without interference by lot owners. 3.12 Right to Farm Covenant: Weld county is one of the most productive agricultural counties in the United States. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize there are drawbacks, including conflicts with longstanding agricultural practices and lower level of services than in town. Agricultural users of the land should not be expected to change their long-established agricultural Practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; dust from animal pens, fields work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditched and reservoirs cannot simply be moved"out of the way" of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Weld County covers a land area of over 4,000 square miles in size (twice the size of the state of Delaware)with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. 982303 4 County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for the public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Children are exposed to different hazards in the country than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. ARTICLE IV—THE ASSOCIATION 4.1 Articles of Incorporation and Bylaws: The interests of all lot owners shall be governed and administered by the Article of Incorporation and Bylaws of the Grandview Acres Minor Subdivision Homeowner's Association and by this Declaration. In the event of a conflict between the provisions of the Declaration and the Articles of Incorporation or the Bylaws of the Association, the terms of this Declaration shall be controlling. 4.2 Membership: Each owner of a lot, upon becoming an owner, shall be a member of the Association and shall remain a member for the period of his ownership. If more than one person has an ownership interest in a lot, each person will vote that portion of a lot equal to the portion of ownership. 4.3 Examination of Books by Mortgagee: The holder of any recorded first mortgage or deed of trust on a lot in the subdivision will, upon request be entitled to: (A): Inspect the books and records of the Association, (B): Receive an annual financial statement of the Association after the end of each calendar year, (C): And written notice of all meetings to the Association and shall be permitted to designate a representative to attend all such meetings. 4.4 Powers: The Association shall be granted all of the powers necessary to enforce all of the applicable provisions of this Declaration, and to govern, manage, maintain, repair, administer, and regulate Grandview Acres Minor Subdivision and to perform all of the duties required of it. Not with standing the above, the Association shall not be empowered or entitled to use hazard insurance proceeds for loss to the common areas improvements for other than repair, replacement, or reconstruction of such improvement. 4.5 Association Responsibilities: The maintenance and operation of Grandview Lane and all common areas shall be the responsibility and the expense of the Association, and the costs therefor shall be a common expense of all the lot owners. The Developer shall initially install the gravel road, Grandview Lane, and shall initially seed the areas disturbed by construction of said Grandview Lane; thereafter, the costs of maintaining, repairing, and replacing Grandview Lane of the right of way shall be borne by the Association. 4.6 Lot Irrigation: Grandview Acres Minor Subdivision Homeowner's Association shall own and maintain one(1) share of New Cache La Poudre Irrigation Company, one (1) share of New Cache La Poudre Reservoir Company through Lindies Lake Reservoir, and two (2) shares of North Side Lateral. The Developer and/or Homeowner's Association shall elect or appoint one(1) person to manage, control, maintain and operate the irrigation pump which is located at or near the sump located North of said Grandview Acres Minor Subdivision. The elected or appointed person shall be the only person permitted to the pump site and shall oversee all irrigation activities. Irrigation of each individual lot shall be the sole responsibility of that individual lot owner. The Homeowner's Association shall be permitted to use water and carrying ditch on the basis of four(4) days use and four(4) days out. The maintenance, up-grade, repairs, electric bill, and any other expenditures relating to the"Irrigation System" shall be paid for by the 982303 5 Homeowner's Association. The site is situate in the Southwest Quarter of Section 20, Township 6 North, Range 64 West of the Sixth Prime Meridian, Weld County, Colorado. More specifically, the site is on the north side of County Road 66 between County Roads 51 and 53. Currently,a gas well head and tank battery are located on the future Lots 4 & 5. Refer to vicinity and soil conservation maps on the subdivision plat. HISTORIC FLOWS Off-site flows have very little to no impact on this site. Irrigation ditches north of the site intercept flows from the north. Historic flow on this site is from north to south on the site. There is a borrow ditch on the north side of County Road No.66 with an existing fifteen(15)inch culvert at the current private drive on the south side of the site. • PROPOSED DRAINAGE IMPROVEMENTS No drainage improvements are planned for this site. Calculations are provided showing that the imperviousness of the site will be increased from 0.20 for the undeveloped site to 0.21 for the 1 982303 developed site. This is calculated with approximately 3,300 square feet of rooftop for each of the five lots (residences and outbuildings) and the gravel roadway in the center of the site. Borrow ditches will be constructed along each side of the new access road with culverts at property roads. All runoff will continue to flow north to south. All residences should be constructed a minimum of 2'-0" above surrounding grade to prevent flooding due to irrigation and/or stormwater. CONCLUSIONS 1. The site does not sit in a regulated flood plain and is not subject to severe flooding problems. 2. Runoff on this site will not be significantly increased as a result of this site being developed.
