RE: ESTABLISH SPECIAL TRUST FUND FOR CASE #95-CV-61 DEPOSIT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Weld District Court has ordered Weld County to establish a special trust
fund in the amount of $505,787.00 to assure availability of funds if compensation is found to be
owed to the Villa at Greeley, Inc., in Case #95-CV-61, and
WHEREAS,Weld County is willing to maintain and account for said fund in the Weld County
Treasury.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Special Trust Fund for Case #95-CV-61 in the amount of$505,787.00
be, and hereby is, created.
BE IT FURTHER RESOLVED by the Board that the Weld County Accounting Department
shall maintain required accounting records for said trust fund.
BE IT FURTHER RESOLVED by the Board that the Comptroller is directed to transfer
$505,787.00 from the General Fund to said trust fund on the books of the Weld County Treasurer.
BE IT FURTHER RESOLVED by the Board that principal can only be withdrawn from said
trust fund pursuant to a judgment or Order of the Weld District Court but that interest earned on
the principal may be returned to the General Fund.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 10th day of June, A.D., 1996.
