Dear Commissioners:
Bruce Barker, Weld County Attorney, has requested current and historical information
on East Eaton Water and Sanitation District located in Weld County.
I have enclosed a copy of the Order for Organization that occurred June 25, 1982. The
second page of this document has a legal description of the area known as East Eaton
Water and Sanitation District.
This is a small district geographically and in population. Currently the district does not
have a legal board. In 1994 the district legally canceled their biennial election because
no one ran for the board of directors. The remaining board appointed the needed
directors. That meant that in 1996 all directors would have been up for election.
However, because of personnal tragedy for the designated election official, all deadlines
for the May 1996 election were missed. According to 32-1-905(2.),C.R.S., when all
directors need to be appointed it is done by the board of county commissioners. Then
within six months of that appointment the district is required to hold a special election.
The department of local affairs field manager, Don Sandoval, is working closely with
this district to assist them in getting into compliance with the special district act. The
only area where they are out of compliance is in the election provision of Title 32.
There are circumstances in which this district must by law stay in existence. They do
provide a service that benefits the health of those who live in the district. They have
an outstanding loan with Farmer's Home for $21,700. Currently neither the county nor
the town of Eaton is interested in providing the same service to this area.

Once the appointment for the board of directors for East Eaton Water and Sanitation
District is made then it is my understanding that the Weld County Clerk and Recorders
Office is willing to conduct their board election on November 5, 1996. Don Sandoval
and myself are committed to working closely with this district to assist them in any way
possible to keep them in compliance.
