Main, Keenesburg, Weld County, Colorado, the Board of Trustees of the Town of Keenesburg will conduct a public hearing on the Petition for Annexation for the area known as the Hy -Planes Annexation. The Resolution fixing the foregoing hearing date and property description accompanies this Notice. The hearing shall be for the purpose of determining and finding whether the area proposed to be annexed meets the applicable requirements of C.R.S. 31-12-105 and C.R.S. 31-12-105 and Section 30 of Article II of the Colorado Constitution, to determine eligibility for annexation, and to determine if the area should be annexed to the Town of Keenesburg. The Petition, property description and a complete map of the area proposed to be annexed are on file with the Town Clerk at the Town Hall located at 140 S. Main, Keenesburg, Colorado, and may be inspected during normal business hours which are from 8:00 a.m. to 3:00 p.m., Monday through Friday. ,,o2x Cheryl J� Town Clerk RESOLUTION NO. 1997-1 A RESOLUTION FINDING THAT THE PETITION FOR ANNEXATION OF THE HY-PLANES ANNEXATION IS IN SUBSTANTIAL COMPLIANCE WITH C.R.S. 31-12-107(1) AND SETTING A DATE FOR A HEARING BEFORE THE BOARD OF TRUSTEES OF THE TOWN OF KEENESBURG TO CONSIDER THE ANNEXATION OF THE AREA PROPOSED TO BE ANNEXED. WHEREAS, the owners of 100% of the property known as the Hy -Planes Annexation have filed a petition for annexation of such property to the Town of Keenesburg and; WHEREAS, the Board of Trustees has determined that the petition is in substantial compliance with C.R.S. 31-12-107(c) and that a hearing should be set to determine whether the area proposed to be annexed meets the applicable requirements of Section 31-12-104 and 31-12-105 C.R.S. NOW THEREFORE BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF KEENESBURG: Section 1. The Board of Trustees finds that the petition for annexation of certain property known as the Hy -Planes Annexation and more specifically described in the property description attached hereto as Exhibit "A" is in substantial compliance with C.R.S. 31-12-107(c) and section 30 of Article II of the Colorado Constitution. Section 2. The Board of Trustees hereby sets a public hearing for the 3rd day of March ,19 97 at the hour of 7:30 p.m. at the Town Hall, Town of Keenesburg, 140 S. Main Street, Keenesburg, Weld County, Colorado for the purpose of determining and finding whether the area proposed to be annexed meets the applicable requirements of C.R.S. 31-12-104 and 105, and to determine whether the area should be annexed to the Town of Keenesburg. PETITION FOR ANNEXATION OF UNINCORPORATED TERRITORY IN THE COUNTY OF WELD STATE OF COLORADO TO THE TOWN OF KEENESBURG. COLORADO To the Board of Trustees of the Town of Keenesburg: The undersigned, in accordance with the Municipal Annexation Act of 1965, Title 31, Article 8, Colorado Revised Statutes, 1973, as amended, hereby petition the Board of Trustees of the Town of Keenesburg for annexation to the town of Keenesburg the following described unincorporated territory located located in the County of Weld, State of Colorado, to wit: SEE EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREEOF BY REFERENCE And in support of the said petition, Petitioners allege that: 1. It is desirable and necessary that the above described territory be annexed to the Town of Keenesburg; 2. Not less that one sixth of the perimeter of the area proposed to be annexed is contiguous with the Town of Keenesburg; A community of interest exists between the territory proposed to be annexed and the Town of Keenesburg; 4. The territory proposed to be annexed will be urbanized in the near future; 5. The territory proposed to be annexed is integrated or is capable of being integrated with the Town of Keenesburg; 6. No land held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate; (a) is divided into separate parts or parcels without the written consent of the Landowners or Landowners thereof, unless such tracts or parcels are separated by a dedicated street, road, or other public way; (b) comprising seventy five acres more or less 7. The signer of the petition comprise the Landowners of more than fifty percent of the territory proposed to be annexed, exclusive of streets and alleys; 8. The mailing address of the signer, the legal description of the land owned by the signer, and the date of signing of each signature are all shown on this Petition; 9. Attached to this petition is the Affidavit of the circulator of this Petition that each signature is the signature of the person whose name it purports to be; 10. Accompanying this petition are seven prints of an annexation map containing the following information; (a) a written legal description of the boundaries of the boundaries of the area proposed to be annexed; (b) a map showing the boundary of the area proposed to be annexed; (c ) within the annexation boundary map there is shown the location of each ownership tract in unplatted land, and if part or all of the area be platted, then the boundaries and the plat number of plots or of lots and blocks are shown; (d) next to the boundary of the area proposed to be annexed is drawn the contiguous boundary of the Town of Keenesburg, and the contiguous boundary of any other municipality abutting the area proposed to be annexed; (e) the dimension of the contiguous boundaries are shown on the map. Petitioner request that the Town of Keenesburg approve the annexation of the area proposed to be annexed. P P2 N, NOTARY BOA 299, K, crasb c, CO 30643 IMPACT REPORT Hy -Planes Annexation Keenesburg, Colorado The following impact report is based on the requirements of Section 31-12-108.5 of the Colorado State Statutes, and refers to 75.5 acres located south of Interstate 76, west of Weld County #59, and adjacent to the Town of Keenesburg. A) 1. The attached map details the present and proposed boundaries of the municipality in the vicinity of this annexation. 2. The attached map indicates the location of water and sewer infrastructure available to serve the property. No extension of utilities or streets are anticipated in the vicinity of the annexation. Extension of all infrastructure within the property will be determined at the time of subdivision. 3. The attached aerial photo depicts existing land uses in the vicinity of the proposed annexation. The property is planned for residential and airport/commercial development. Specific land uses will be determined at the time of subdivision. B) To date, no pre -annexation, or annexation, agreement has been negotiated. As such, no agreement is attached. C) Municipal water, and sewer provided by the Keenesburg Sanitation District, are available at the southwest corner of the property. No municipal extension of utilities will be necessary to provide service to the property. D) All municipal service extensions will be undertaken by the developer, and constructed to the Town's specifications. E) The following Districts are within the area to be annexed: Weld County School District RE -3J South East Weld Fire Protection District F) The impact of the proposed annexation on the local school district is anticipated to be minimal in that 11 residential lots are projected, and the remainder of the property is projected as light industrial zoning. School impacts will be evaluated prior to subdivision approval. Hello
