RE: APPROVE CORPORATE EASEMENT FOR U S WEST COMMUNICATIONS, INC. ON
WELD COUNTY PROPERTY AND AUTHORIZE CHAIRMAN TO SIGN -
NWY4, S5, T6N, R64W
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Corporate Easement on Weld County
Property described as the NW% of Section 5, Township 6 North, Range 64 West of the 6th P.M.,
Weld County, Colorado, being more fully described in Exhibit "A" to said easement, between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld
County, on behalf of the Public Works Department, and for U S West Communications, Inc., with
terms and conditions being as stated in said easement, and
WHEREAS, after review, the Board deems it advisable to approve said easement, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Corporate Easement on the above described Weld County Property
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Public Works Department, and for U S West
Communications, Inc., be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized
to sign said easement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 17th day of April, A.D., 1995.

CORPORATE EASEMENT
The undersigned Grantor(s) for and in consideration of Four Hundred
Dollars ($400.00) and other good and valuable consideration, the
receipt whereof is hereby acknowledged, do hereby grant and convey
unto U S West Communications, Inc., a Colorado corporation, whose
address is 1801 California Street, Denver, Colorado 80202, its
successors, assigns, lessees, licensees and agents a perpetual
easement and the right to construct, reconstruct, operate, maintain
and remove such telecommunications facilities from time to time, as
said Grantee may require upon, over, under and across the following
described land which the Grantor owns or in which the Grantor has any
interest, to wit:
See Exhibit "A" for easement description attached hereto and
incorporated herein by this reference.
Situate in county of Weld, State of Colorado.
Grantee shall have the right of ingress and egress over and across
the lands of the Grantor to and from the above -described property,
the right to clear and keep cleared all trees and other obstructions
as may be necessary. Grantee shall be responsible for all damage
caused to Grantor arising from Grantee's exercise of rights herein
granted. The Grantor reserves the right to occupy, use and cultivate
said easement for all purposes not inconsistent with the rights
herein granted. The rights, conditions and provisions of this
easement shall inure to the benefit of and be binding upon the heirs,
executors, administrators, successors and assigns of the respective
parties hereto. Any claim, controversy or dispute arising out of
this agreement shall be settled by arbitration in accordance with the
American Arbitration Association, and judgement upon the award
rendered by the arbitrator may be entered in any court having
jurisdiction thereof. The arbitration shall be conducted in the
county where the property is located.

Please find enclosed two copies of the U S West Corporate Easement
form, along with a survey of the easement location requested by Dave
Becker.
If you have any questions, please call me on 303-330-2741.
If the form is satisfactory, please have one copy signed by the
authorized individuals, notarized and returned to me at the above
address and we will record it with the Clerk and Recorder. When we
receive the signed copy, a check will be sent to you for $400.00.
