Kirkmeyer, Chair Commissioner George E. Baxter, Pro-Tem Commissioner Dale K. Hall Commissioner Constance L. Harbert Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Shani Eastin The following business was transacted: I hereby certify that pursuant to a notice dated August 21, 1996, and duly published August 29, 1996, in the North Weld Herald, a public hearing was conducted to consider the request of Western Mobile Northern, c/o John Pinello, for a Site Specific Development Plan and Second Amended Special Review Permit for a wet sand and gravel mining operation in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Shani Eastin, Planning Department representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She noted a letter of concern was received from an absentee surrounding property owner regarding noise and hours of operation; however, staff believes that issue is adequately addressed by the Development Standards, a copy of which the property owner received. Greg Lindsey, General Manager for Western Mobile Northern, represented the applicant and referenced maps of the site and proposal indicating the actual equipment will be moved back farther from 35th Avenue and landscaping will be added. He stated the amendment will also provide a safer access and less traffic congestion. Responding to questions from the Board, Mr. Lindsey confirmed accel/decel lanes already exist, and Ms. Eastin clarified a road maintenance agreement is required as part of this application. He stated the requested hours of operation are 6:00 a.m. to 10:00 p.m.; however, the typical hours of are from 7:00 a.m. to 5:00 p.m., with an occasional 24-hour shift being necessary. Amy Canzona, surrounding property owner, noted the growth in the area and that the use has changed to mostly residential; therefore, the hours of operation would be more appropriate if in line with the City of Greeley. She voiced other concerns about noise and the increased truck traffic on "F" Street, reiterating the site is largely surrounded by residential development. Responding to further questions from the Board, Ms. Eastin confirmed the Development Standard in the previously amended Permit regarding noise was pursuant to State statute. Trevor Jiricek, Health Department representative, confirmed he has never received a noise complaint about this facility, and the 961582 /92-- PL0405 RE: HEARING CERTIFICATION -WESTERN MOBILE (SECOND AMENDED USR#247) PAGE 2 Industrial noise limit has not changed for a number of years. He stated the limit decreases by five decibels at 6:00 p.m. Ms. Canzona noted the City of Greeley's hours for construction are from 7:00 a.m. to 5:00 p.m. Marilyn Everett, surrounding property owner, also voiced concern regarding noise and previous complaints made to the Health Department. Mr. Jiricek agreed the previous Development Standard was vague because it pertained to the Agricultural Zone District. Mr. Lindsey noted the company is fined if it goes over the allowed decibel limit, and the landscaping and berms will buffer the noise; he reiterated the equipment will also be moved back and reviewed various methods of preventing noise. Mr. Lindsey stated Western Mobile is willing to work with the neighbors and their concerns and noted even compliance with the municipal noise levels has not been a problem. He also reiterated the facility rarely runs more than eight to ten hours per day and confirmed agreement with all Conditions of Approval and Development Standards. Mr. Jiricek recommended amending Development Standard#16 by deleting"of 80 db(A)"; thus, the noise level is measured pursuant to State statute for the Industrial Zone District and reflects a reduction to 75 db(A) after 6:00 p.m. Mr. Lindsey agreed with the recommended amendment. (Changed to Tape#96-25.) Commissioner Hall moved to approve the request of Western Mobile Northern, c/o John Pinello, for a Site Specific Development Plan and Second Amended Special Review Permit for a wet sand and gravel mining operation in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Baxter, and it carried unanimously.
