RE: APPROVAL OF RECORDED EXEMPTION NO. 1315 - GORDON AND CLEONNE STEINMILLER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant
to Colorado statute and the Weld County Home Rule Charter, is vested with the
authority of administering the affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held
in the Chambers of the Board, that a certain parcel of land, to be divided into two
parcels, as shown on the plat known as Recorded Exemption No. 1315, does not come
within the purview of the definition of the terms, "subdivision" and "subdivided
land" , and
WHEREAS, the request for Recorded Exemption No. 1315 was submitted by Gordon
and Cleonne Steinmiller for property which is located in part of the N/2 NE/4 of
Section 17, Township 6 North, Range 67 West of the 6th P.M. , Weld County, Colorado,
being more particularly described in the plat which shall be provided by the
applicant and known as Exhibit "A" , said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to be
approximately 15 acres and 4.8 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is ,
exempt from the definition of the terms , "subdivision" and "subdivided land" .
The above and foregoing Resolution was , on motion duly made and seconded,
adopted by the following vote on the 9th day of January, A.D. , 1991.

Dear Commissioners:
This Recorded Exemption is submitted by Gordon and Cleonre Steinmiller.
The parcel of land on which this request is being made is described as
part of the N} NE} of. Section 17, T6N, R67W of the 6th P.M. , Weld County,
Colorado. The property is located approximately .75 miles north of the
Town of Windsor, west and adjacent to State Highway 257. This request is
to separate a 4.8 acre tract from a 20.4 acre tract creating two parcels
of 4.8 acres and 15.6 acres. This is the total contiguous land holding of
the applicant.
The subject parcel is within Windsor's Urban Growth Boundary, however,
the Department of Planning Services' staff has concerns about the level
of development and the potential for continued division occurring in this
quarter-section. This application represents the second Recorded
Exemption involving the subject property and would create the sixth
parcel in the forty acres comprising the NE} NE} of this section. The
original Recorded Exemption (RE-526) was amended twice to expand the size
of the smaller lot from 1.52 acres to its' current size of 20.43 acres.
The existing parcels in the NEI NE} of this section range in size from
one-quarter acre to 20 acres more or less. If this application is
approved the density in the prescribed area would be one unit for every
6.6 acres. Parcel splits have reached a level where continued divisions
would evade the purpose of the Weld County Subdivision Regulations as
defined in Section 1-3. Residential development in rural areas
necessitates an increased demand for police and fire protection, school
busing, utilities and other urban services. As density increases so do
service demands.

It is the opinion of the Department of Planning Services` staff that the
applicant has failed to show how this proposal is consistent with
efficient and orderly development. Any further divisions in this area
will create additional accesses onto Highway 257. Currently seven
parcels access onto highway 257 within one-quarter mile of the subject
property. The use of the Recorded Exemption process to create this type
of linear subdivision evades the purpose of the Weld County Subdivision
Regulations and allows driveways to have direct access to arterials.
Section 8-8 of the Weld County Subdivision Regulations reads as follows:
"Driveways shall not be permitted to have direct access to major
or minor arterial streets."
Highway 257 is designated as a minor arterial in the Weld County
Comprehensive plan.
The intent of the recorded exemption process is to create lots in
accordance with the adopted policies and regulations. The applicant has
not demonstrated in the submitted application materials that this
proposal is consistent with those policies.

application meets the approval criteria of Section 9-2 E. (1) (a) through
(m) of the Weld County Subdivision Regulations, you will be notified that
the recorded exemption is approved. If the staff determines that the
application does not meet the approval criteria, you will be notified and
asked to appear before the Board of County Commissioners at a public
hearing. You will be informed of the hearing date prior to the hearing.
The Board of County Commissioners will then consider your application and
make a final decision on the recorded exemption.

any town or municipality lying within three miles of the property in
question or if the property under consideration is located within the
comprehensive planning area of a town or municipality. Therefore, our
office has forwarded a copy of the submitted materials to the Windsor

Gentlemen:

The enclosed Application proposes the division of Lot B of
Second Amended Recorded Exemption 526 into a larger parcel
containing 15 . 183 acres and a smaller parcel containing 4 . 86
acres. The reason for the Application is to create a parcel of
land which will be conveyed to Timothy Lind on which he will
build a home adjacent to the residence of his parents adjoining
the southeast corner of Lot B. The property is located on the
west side of Highway 257 approximately one half mile north of
Windsor . Although the property is included in the A
(Agricultural) District, the property is not cultivated, and is
used only for residential purposes and for pasture for a few head
of horses.
The Application is consistent with the Weld County
Comprehensive Plan which is designed in part to encourage
residential development on non-prime agricultural land adjacent
to existing municipalities. Furthermore, the property is located
within the urban growth boundary, and therefore is compatible
with future development.

After division of the property, both parcels will continue
to be used for residential and limited grazing purposes . These
uses are consistent with the zoning for the property, and are
also consistent with uses of surrounding land which are also used
for residential and limited agricultural purposes.
The proposal will not be inconsistent with efficient and
orderly development because it is located within an area
designated by the Town of Windsor and Weld County for growth and
development. Utility service is presently available to the
property, and it is located adjacent to a paved highway. The
property presently receives domestic water from North Weld County
Water District , and such service will be available to the
additional parcel as shown by the enclosed letter from NWCWD.
Sewage disposal for the additional tract will be by septic tank.
The property is not located within a flood plain, geologic
hazard area or overlay district.

Dear Mr. Grubb:
We have received the Steinmiller application for a Recorded Exemtpion,
and we have the following comments:
1. Projected traffic on S.H. 257 indicates the need for a 150-foot
total right of way, 75 feet each side of the highway centerline.
Since the existing width along this property is 50 feet west of
the centerline, additional width to meet the projected need should
be protected by reservation or, prferably, dedication, as permitted
by County regulations.
2. If the new dwelling will require a separate access from that of
the smaller parcel, the parties must obtain an Access Permit from
this office. An on-site review reveals that a joint use access
for both parcels is phsysically impractical and maybe cost prohibitive.
A separate access could be permitted.
Our comments on state highway access are based on the information
presented for this property only. If the property owner has any
